Pamlico County
Modification to the existing developed area at Deaton's
Yacht Service is proposed for the construction of a 60 foot
by 70 foot metal work building. The site without this
building is estimated to be 60% impervious presently. The
construction of the building would convert 750 square feet
of pervious area to impervious area. By letter dated July
28, Mr. Deaton submitted a revised plat (copy attached)
showing two areas which are currently impervious which will
be converted to pervious areas by clearing, grading, and
seeding. Based upon this proposal, it is not expected that
the proposed building will cause any net impact on water
quality in the adjacent SA waters.

Bob Deaton owns and operates an existing marine repair facility located
adjacent to Whittaker Creek in Oriental, North Carolina. The property is
approximately one acre in size and is bordered to the north by Tarpon Channel
and to the east by Whttaker Creek. Mr. Deaton's operation involves repair
work on wooden and fiberglass sailboats. Sand blasting and spray painting
are conducted on a very limited basis (3 times last 5 years). A 2S'x 481office/
work building and marl paved area exist on the site. I estimate the site to
be approximatley 60% impervious under current conditions.
The proposed modification involves the construction of a 60 x 70 ft. metal
work building. The placement of the building would convert 750 square feet
of pervious area to impervious area. By letter dated July 28, 1986, Mr. Deaton
submitted a revised plat (copy attached) showing two areas which are currently
impervious which will be converted to pervious area by clearing, grading
and seeding. This compromise worked out with Mr. Deaton will effectively reduce.
the impervious area at the site.
It is not anticipated that the Division would object to the proposed project.

I have enclosed a drawing which shows the areas to be converted
from impermable surface to permeable surface. As we discussed
on the phone, I have tried to increase the permable surface area
by 1500 square feet. This has been accomplished by changing two
different areas on the property. Area 1 is a total of 870 sq.
feet, and would provide a grass strip beside the marsh area.
Area 2 is 756 sq. feet, and this makes a total area of 1626 sq.
feet to be converted from rock surface to grass.
It is my understanding that these areas to be converted are part
of the permit application, and we would have to comply in order
to construct the building.

Dear Mr. Deaton:
By copy of North Carolina Department of Natural Resources and
Community Development letter to you of March 13, 1986, we have
been informed that your application for State authorization to
excavate a basin area and install pilings at the intersection of
Tarpon Channel and Whittaker Creek, off of the Neuse River,
Oriental, Pamlico County, North Carolina, has been denied. Under
the administrative rules of our regulatory program, denial of
required State authorization precludes favorable consideration of
a Federal permit. Accordingly, your Department of the Army
application is hereby denied, and your file has been retired.
Additionally, we received unfavorable comments from the
National Marine Fisheries Service (copy enclosed). Their reaction
to your proposal is the result of anticipated significant adverse
impacts. I have provided this Federal agency's comments to alert
you to concerns in addition to those identified in the State's
denial letter. While appealing the State permit is the next step
in pursuing State authorization, you should be aware that Federal
agency comments will be unchanged by the outcome of that appeal.
Because of this Federal agency's influence on Department of the
Army permit decisions, it is unlikely a Department of the Army
permit would be available unless your project can be modified to
lessen its impacts.

Mr. Bob Deaton has submitted a proposal to modify his previously
existing permit (to be renewed in accordance with the July 24,
1984 renewal criteria reference 2.A.). He wishes to add pilings
and slips to an existing pier and to also construct a building
fpr his boat maintenance business.
The project involves some development proposed by Mr. Deaton in an
earlier application which was reviewed by this office from DEcem-
ber 2, 1985, to March 13, 1986. The application was denied based
on the proposed excavation of previously undisturbed primary nur-
sery area estuarine habitat. Mr. Deaton now proposes to just
place the pilings and piers in the same location. The piers and
pilings will accommodate three additional vessels.
Mr. Deaton also desires to construct a 60' square shed for housing
his boat repair a#id painting business. Construction has been coor-
dinated with representatives of DEM in regards to stormwater handl-
ing and would be an asset to this facility as sanding, scraping,
and painting activities are currently be done outside.
I recommend that Permit No. 110-82 be renewed and modified with.
the same conditions as on the original permit. The proposed build-
ing plans should be circulated to and and certified by DEM.
Whittaker Creek is a primary nursery area as designated by DMF and
is classified as SA waters according to the Div. of Env..Management
and is currently closed to shellfishing by the Div. of Health Services.

The Subject application has been reviewed for water quality impacts
and the following comments are offered:
1. The project will contain less than 10% total impervious area
and provides an adequate buffer area to MHW contour, therefore
stormwater impacts are not expected to be significantly
different than natural conditions.
2. The applicant's current methods of boat maintenance provide
sufficient protection to prevent blasting and painting
residues from entering adjacent waters.
3. The project will not require a 401 certification.

The project site is located adjacent to Whitaker Creek in Oriental, North
Carolina. Whitaker Creek is classified SA waters and is designated a primary
nursery area by DMF.
Mr. Deaton operates an existing marine maintenance facility. Repairs to fiber-
glass sailboats comprises about 95% of the work performed at this site. The
vessels are lifted out of the water and carried to high ground for repairs. A
portable screen (20 x 50 x 20 ft.. high) is used around the vessels during sanding
and painting.
The applicant proposes to excavate an additional boat basin 50 x 25 x -7 ft.
deep adjacent to the shoreline. Approximately 140 yards of spoil material will
be excavated by dragline and hauled away to a high ground site.
The property is approximately .9 acre in size. A 25' x 50' workshop is situated
more or less in the center of the property. Existing storm drainage sheet flows
across a vegetated buffer strip on to. the adjacent property. The total impervious
area of the development is less than 10%. Vegetated buffers appear to be adequate.
There should not be any significant stormwater impacts associated with. this
proposed project. This office has no objections to the DF/CAMA permit.

Narrative 'descri'ption
Permit No. 110-82 was issued to Deaton Yacht Service in 1982. The
permit was originally for the construction of a bulkhead, mainte-
nance excavation and pier structures adjacent to the facility lo-
cated in Oriental, Pamlico County._ The permit has been modified
twice since in order to allow the construction of piers to support
a travel- lift and for more dockino space. All construction au-
thorized so far has been completed in accordance with the permitted
project plans.
The applicant is now proposing to excavate an additional estuarine
area and construct more docks inorder to expand his storage ca-
pacity of'yachts awaiting repair.The proposed excavation area is
about 350' offhosre and 55' long, and will be duq to -7' MWL deep.
Pilings will be added in the excavated area to accommodate three more
vessels.
Whittaker Creek is a designated primary nursery area by the DMF,
is classified as SA according to DEM, and is currently closed to
shellfishinq by the Div. of Health Services.

Conducting the project as proposed will result in the excavation
of 1,925 s4.ft. of shallow, subtiday estuarine area to a depth of
-7'. Approximately 200 cu.yds, of spoil material will be pro-
duced'during the excavation. Short term turbidity should be ex-
pected in the immediate project area.

On January 27, 1981, we issued general permit No. SAWCO80-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received December 2, 1985, for a
Department of the Army permit to excavate a basin.area and install
pilings at the intersection of Tarpon Channel and Whittaker Creek,
off the Neuse River, in Oriental, Pamlico County, North. Carolina,
indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing
of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWCO86-N-069-0088 and will be
coordinated by Mr. Ernest Jahnke, telephone (919) 343-4467. He is
available to address questions or comments you may have.
