Signature of Permittee Davenport Properties Corporation Permit #201-85 Page 2 of 3 ADDITIONAL CONDITIONS (2) Impervious surfaces during construction and after project completion must remain forever more at not more than ten (10)% of the project properties. Any proposed change from this limitation must be authorized by modification of this permit. (3) There must be maintained,' for the life of the permitted project, a thirty (30) foot undisturbed natural buffer adjacent to all classified waters at the project site. (4) The causeway road must not exceed the limitations staked by the Corps of Engineers and the Division of Coastal Management. Such delineation is shown on the attached plats. The permittee is encouraged to request a preconstruction onsite meeting to reconfirm the staked alignment. NOTE: An Erosion and Sedimentation control plan will be required for this project. This plan must be filed at least thirty (30) days prior to beginning any land disturbing activity. Submit this plan to the Department of Natural Resources and Community Development, Land Quality Section,_ 7225 Wrightsville Avenue, Wilmington, NC 28403. NOTE: The project site is an area designated as A-10 with a Base Flood Elevation of eleven (11) feet. NOTE: Retention and detention areas for stormwater runoff using man-made:: or natural swales, either vegetated or pnvegetated, can create mosquito breeding sites capable of producing large numbers of very pestiferous mosquitoes. Those who. construct or uAe such areas should be 'aware of this problem and of their responsibility ;to control these mosquitoes which readily migrate to other places. Mosquito production in' these areas can be reduced by designs which allow water to stand for no more than three days. Chemicals can also be used judiciously to control mosquito larvae. A good system or regular inspections (at least weekly during the warm months) can provide the information needed to manage these pests properly. The staff of the Vector Control Branch, (919) 733-6407 is available to inspect such areas and offer advice on how best to control mosquitoes there. NOTE: The permittee is encouraged to allow as much natural vegetation and undis- turbed area to remain throughout the site-as is considered feasible. Marina Construction (5) In order to protectJuvenile shrimp and fin fish populations, no excavation --or fi l i ng will be -permi tted":between `Apri?1` I and `September 30 of any year " without the prior approval of the Division of Coastal Management. ADDITIONAL CONDITIONS (7) A silt screen will be placed across the mouth of the canal, between the canal and the Atlantic Intracoastal Waterway (AIWW), while excavation is being accomplished within the basin and canal. (8) Excavation will not exceed 6 feet below the elevation of mean low water (MLW). (9) All excavated materials will be confined above meal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surroun- ding waters. (10) The disposal area effluent will be contained by pipe, trough or similar device to a point at or "below the mean low water level to prevent gully .. 7. (12) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards. , (13) The diked disposal area will be constructed a sufficient distance from the mean high water level of any marsh to eliminate the possibility of dike erosion into or upon, any marsh and/or surrounding waters. y.. (14) No marsh grass will be excavated and/or filled. (15) In order to prevent surface pollutants from leaving the basin, down turned elbows shall be added to the existing culverts at the west side. Marina Operation (16) Prior to occupancy of any boat slips, a marine pumpout facility will be installed and be,maintained operational for the life of the project. (17) A no, sewage discharge policy will be posted and enforced by the marina. (18) Living aboard boats is not authorized at this marina. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. NOTE: The permittee hereby recognizes the possibility that the structure herein may be subject to damage by wave wash from passing vehicles. Bent Tree Plantation Brunswick County Dear Mr. Sloane: Your application dated March 6, 1985 and recent revisions, for a Water Quality Certification under Section 401 of the Federal Clean Water Act as Amended has been reviewed by our staff. Your proposal is to develop an eight acre tract of land by constructing 60 multi-family housing units, club house, swimming pool, 10 slip boat basin, and parking areas adjacent to the Atlantic Intracoastal Water Way near Ocean Isle Beach. The issuance of a Water Quality Certification is a finding by this Division that the proposed activity will not cause a violation of water quality standards or discharge guidelines. There is an aspect of the project which causes us considerable concern as to the effect on water quality standards in these waters which are classified SA. This is the fecal coliform levels which are contained in the stormwater runoff. Information available to us at this time indicates that a violation of fecal coliform standards will be expected to occur as a result of stormwater runoff where effective impervious surface areas are in excess of 10% and waters are classified SA. Where effective impervious areas are greater than 10%, diversion, treatment or containment of the stormwater runoff up to the 100-year, 24-hour rainfall event would be needed to assure protection of the water quality standard. Sewage discharged from boats in the boat basin is likely to cause a violation of-the fecal coliform standards. In order for us to conclude that sewage discharge from boats will not occur, we would have to be satisfied that the project can and will prevent sewage discharge from boats on a long-term basis. Past experience has been that just providing marine pump-out facilities is insufficient to prevent sewage discharges from occurring. Also spill potential at the fueling docks is an area where specific plans will need to be developed to assure that the marina operation will not pose a threat to water quality. Because the stormwater runoff from the proposed project is expected to violate water quality standards and the operation of the boats could cause a violation of water quality standards due to sewage from boats and/or fuel spillage, I have concluded that the proposed project should not be certified. Your application for a Water Quality Certification is hereby denied. Should you redesign the project from the standpoint of stormwater impacts and boat operation in such a manner as to satisfy our concerns for water quality protection, I will reconsider this denial. It is suggested that you work closely with our Wilmington Regional Office in any'redesign of the proposed project. _ You do have the right to a review by the Environmental Management Commission, if the denial is unacceptable to you. The boat ramp will be aligned to traverse the minimum area of vegetated wetlands. C. In order to protect juvenile shrimp, no excavation will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management. d. All excavated material will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. # e s -2- e. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. f. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area to ensure maximum settlement of suspended solids. g. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and resultant unnecessary siltation. h. Excavation will not exceed 8-feet below the elevation of mean low water (MLW). . i. The scheme of development contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement,.and enlargement of the Atlantic Intracoastal Waterway (AIWW). Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the Corps of Engineers acting on behalf of the United States, lands are needed at any time for any purpose within the scope of the easement. Permanent buildings will not be constructed in areas subject to such easement. j. The permittee hereby recognizes the possibility that the structure herein may be subject to damage by wave wash from passing vessels. The project has been reviewed based on the stormwater management proposal dated December 19, 1985. The plan.indicates that stormwater runoff from 4 drainage areas will.enter 4 retention basins capable of effectively containing and percolating stormwater runoff from impervious surfaces during a 100 year - 24 hour storm. The attached calculations and soils reports were performed in accordance with the regional office requirements, and in conclusion, appear adequate to protect adjacent SA waters. Additional comments are provided as follows: 1. The project will require 401 certification. 2. It is recommended that the 401 certification be issued containing the following conditions: a. Turbidity in the receiving.waters shall not.exceed 25 NTU as a result of the project activity., b. The amount of impervious area in each subarea will be determined and runoff volume calculated for the 100 year storm event (10.5" precipitation in 1 hour; 4.5" precipitation max. intensity in 1 hour). After this volume is known, a retention system will be designed to insure that no discharge to surface waters will occur from impervious surfaces during the 100 year storm and that the retained runoff will percolate into the soil. See color-coded site plan for the various subareas. The revised percolation rates were obtained from the attached soils evaluation conducted by Mr. Ed Andrews, P.G. Tree Villas reveals that two types of basins should exist. Sites numbers 1 , 2 and 5 are suitable as infiltration basins with infiltration capacities (K) greater than 20 in/hr at the most restrictive unsaturated horizon. At site # 5, the, infiltration rate can be converted to 13.24 gallons per square foot per hour. With the water table surface at 6 feet, the infiltration rate will drain the volume of stored water in the drainage swales in approximately two hours. Sites 1 and 2 contain a total of 12,725 square feet of i-nfiltration area, with. a minimum infiltration rate of 56.25 in./hr. and the seasonal high water table at ± 7 ft. below LSD. Not taking into account storage and horizontal hydraulic conductivity (Khthe infiltration basins # 1,2 & 5 can drain ±500,000 gallons per hour. This will account for any first flush for any intensity storm. The retention basins at sites # 3, 4 and 6 do have vertically restrictive layers of either organic soil or silty clay deposits (site # 6). These will exhibit low vertical permeability. The site evaluation for #CA was at a low elevation, basically at the edge of the marsh. If the basin were constructed above the marsh using permeable sand (85% greater than .1. 0 mm diameter), the site could be used for infiltration. Specifically, site # 4, is suitable for modification due to it's proximity to the marsh. Site # 3 should be used strictly for storage, accounting for gradual drainage through the less permeable organic sand and r Mr. Joseph S. Site # 6 is underlain by2 to 3 feet of well sorted loose grained permeable sand which will allow for rapid horizontal movement as a two to three foot thick aquifer during saturation. It is recommended that the Drainage basins at sites # 1 and # 2 be the primary stormwater disposal sites with the other sites to act as retention ponds that will store the stormwater for gradual infiltration after the storm interval. Bent Tree Plantation Brunswick County Dear Mr. Sloane: Your application dated March 6, 1985 and recent revisions, for a Water Quality Certification under Section 401 of the Federal Clean Water Act as Amended has been reviewed by our staff. Your proposal is to develop an eight acre tract of land by constructing 60 multi-family housing units, club house, swimming pool, 10 slip boat basin, and parking areas adjacent to the Atlantic Intracoastal Water Way near Ocean Isle Beach. The issuance of a Water Quality Certification is a finding by this Division that the proposed activity will not cause a violation of water quality standards or discharge guidelines. There is an aspect of the project which causes us considerable concern as to the effect on water quality standards in these waters which are classified SA. This is the fecal coliform levels which are contained in the stormwater runoff. Information available to us at this time indicates that a violation of fecal coliform standards will be expected to occur as a result of stormwater runoff where effective impervious surface areas are in excess of 10% and waters are classified SA. Where effective impervious areas are greater than 10%, diversion, treatment or containment of the stormwater runoff up to the 100-year, 24-hour rainfall event would be needed to assure protection of the water quality standard. Sewage discharged from boats in the boat basin is likely to cause a violation of the fecal coliform standards. In order for us to conclude that sewage discharge from boats will not occur, we would have to be satisfied that the project can and will prevent sewage discharge from boats on a long-term basis. Past experience has been that just providing marine pump-out facilities is insufficient to prevent sewage discharges from occurring. Also spill potential at the fueling docks is an area where specific plans will need to be developed to assure that the marina operation will not pose a threat to water quality. Because the stormwater runoff from the proposed project is expected to violate water quality standards and the operation of the boats could cause a violation of water quality standards due to sewage from boats and/or fuel spillage, I have concluded that the proposed project should not be certified. Your application for a Water Quality Certification is hereby denied. Should you redesign the project from the standpoint of stormwater impacts and boat operation in such a manner as to satisfy our concerns for water quality protection, I will reconsider this denial. It is suggested that you work closely with our Wilmington Regional Office in any'redesign of the proposed project. You do have the right to a review by the Environmental Management Commission, if the denial is unacceptable to you. Your request for Commission review must be in writing, identifying the specific items to be contended, within 10 days of your receipt of this denial. Sewage discharged from boats in the marina is likely to cause a violation of the fecal coliform standards. In order for us to conclude that sewage discharge from boats will not occur, we would have to be satisfied that the project can and will prevent sewage discharge from boats on a long-term basis. Past experience has been that just providing marine pump-out facilities is insufficient to prevent sewage discharges from occurring. Also spill potential at the fueling docks is an area where specific plans will need to be developed to assure that the marina operation will not pose a threat to water quality. Because the stormwater runoff from the proposed project is expected to vio- late water quality standards and the operation of the marina is likely to cause a violation of water quality standards due to sewage from boats and/or fuel spill- age, I have concluded that the proposed project should not be certified. Your application for a Water Quality Certification is hereby denied. Should you re- design the project from the stand point of stormwater impacts and marina- operation in such a manner as to satisfy our concerns for water quality protection, I will reconsider this denial. They therefore, propose to reduce the number of open water slips along the AIWW from 96 down to 10. Two twin concrete boat ramps are still proposed as well as two parallel fixed "L" shaped transient docks. The original proposal called for the excavation of 2.84 acres of AIWW intertidal bottom while this modification reduces the dredged area down to .86 of an acre. The revised drawing is attached. Two twin concrete boat ramps are still proposed as well as two parallel fixed "L shaped transient docks. Project summary the applicants propose to construct 60 multi-family units, dig; an openwater boat basin for 96 slips, construct a twin ramp launching area and build a clubhouse with pool facility at the "Bent Tree Plantation" waterfront along the AIW,,T. AAAL, DCS, LTD - "BENT TREE PLANTATION" PAGE 2 9(a) SITE DESCRIPTION: The project site is located along the north side of the AIWW approximately 1.5 miles east of the Ocean Isle Beach Bridge across from Ocean Isle's eastern most finger canals. The 8 acre tract also borders the western edge of the Shangrila Subdivision. A new large lot residential subdivision (Bent Tree) borders the property to the north and a small tidal creek borders the western boundary. The waterfront topography of Bent Tree Subdivision consists of a high ridge which crests at 23' above MSL and gradually slopes down to the AIWW's MHW contour. The horizontal distance covers approximately 1,000' of slope. The site is entirely wooded with a mixture of pine and live oak. The waterward perimeter of the tract is bordered by a mixture of high marsh consisting of black needlerush (Juncus roemerianus); saltmarsh hay (Spartina patens); sea oxeye (Borrichia friitescens) and salt grass (Distichlis spicata). Upland grass species are also introduced within 20' of the springhigh tide line. A 30'-60' wide cordgrass (Spartina alterniflora) fringe is also found along the AIWW on both sides of the tract, but not within its mid-section. The bare intertidal areas consist of fine sand-shell and silt. Heavy boat traffic along the AIWW has caused much of this area to be denyded and disturbed. The site is classified as a secondary nursery area and the waters are SA. 9(b) PROJECT DESCRIPTION: The applicants propose to construct 60 condominium units which are to be housed within 15 quadraplex structures. These buildings will be aligned around a large looping cul-de-sac along the southwestern corner of the tract. The road will stay in-place to serivice a new clubhouse facility containing a swimming pool and various marina services. It is proposed that 47 turf stone parking spaces will be constructed adjacent to this building. A 96 slip open water marina is also proposed with two 15' by 92' long boat launching ramps containing 15 cubic yards of cement fill. The open water basin will measure 1,030' in length by 120' in width and be dredged to a -8' (MLW) depth. Approximately 15,000 cubic yards of bottom will be removed by hydraulic dredge to an approved Corps spoil area across the AIWW. Also about 150' of bul.kheading is needed along both sides of the ramps. All docks are to be fixed piers with interior mooring pilings. A fuel dock with sewage pump out capacity is also proposed. All wastewater is to be pumped and treated at an approved upland site off the property. DCS, LTD - "BENT TREE PLANTATION" PAGE 3 10: ANTICIPATED IMPACTS: The project as proposed will cause the filling of approximately 600 s.f. of mixed high marsh habitat for the twin 15' ramps. Also approximately 2.84 acres of relatively unproductive sand-shell public bottom will be excavated for the large boat basin. The proposed 96 slip open water marina appears to be rather ambitious for the relatively narrow waterfront portion of the tract. No marsh is to be dredged for the basin and a minimum 10' buffer must be maintained to prevent the undermining of these wetlands. The design water depths of a basin in this area should gradually slope (get greater depth) towards the AIWW. A permanent pumping station with identifed hookup facilities around the ramps should be made mandatory, however, the fuel dock with its attendant handling facilities could further degrade the SA waters. Stormwater is to be retained on the site through the use of a 30' wide vegetative buffer and by limiting impervious surfaces in two parking areas immediately within the estuarine shoreline zone. Runoff generated from the interior development may also cause negative impacts to SA waters. The overall net density on the tract may exceed those limits envisioned in the land use plan. C. S., Ltd., represented by Mr. Tripp Sloan, to excavate a channel and basin and construct a dock and boat launching facilities on the Atlantic Intracoastal Waterway (AIWW), at Bent Tree Plantation, near Ocean Isle Beach, Brunswick County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The alignment of the proposed basin will be restricted to eliminate the excavation of any intertidal areas. Excavation will not approach closer than 10 feet waterward of the mean low water (MLW) elevation contour. b. The boat ramp will be aligned so as to traverse the minimum area of wetlands. C. In order to protect juvenile shrimp, no excavation will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Managoniont. All excavated material will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. e. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. f. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. g. Flow from the diked retention area will be confined by pipe, trough or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and resultant unnecessary siltation. h. Excavation will not exceed 8 feet below the elevation of mean low water (MLW). i. The scheme of development contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement and enlargement of the Atlantic Intracoastal Waterway (AIWW). Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the Corps of Engineers acting on behalf of the United States, lands are needed at any time for any purpose within the scope of the easement. Permanent buildings will not be constructed in areas subject to such easement. j. The permittee hereby recognizes the possibility that the structure permitted herein may be subject to damage by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of boats moored thereto from damage by wave wash and the permittee shall not hold the United States liable for any such damage. Limited (Public Notice No. 85-N-010-0151)wA MAY 7 1985 Dear Colonel Hanson: OPERA TTON SysFCT(QN BRANCH This is in response to the subject permit application proposing the construction of two boat launching ramps (15' x 92') and a 96 slip open water marina (1,030' x 120' x -8'(MLW) along the Atlantic Intercoastal Waterway (AIWW), Brunswick County, North Carolina. As a result of the boat ramp construction, about 600 square feet of mixed high marsh dominated by blackneedle rush (Juncus roemerianus), salt hay (Spartina patens), sea oxeye (Borrichia frutescens) and salt grass (Distichlis Licata) will be eliminated. The creation of the boat basin will involve the removal of 15,000 cubic yards of bottom material by hydraulic dredge to an approved Corps disposal site across the AIWW. This activity will eliminate approximately 2.84 acres of valuable highly productive intertidal habitat located in a secondary nursery area. We have reviewed the subject public notice and have discussed the anticipated impacts of the proposed project with biologists from the U.S. Fish and Wildlife Service and from the State Division of Coastal Management. It is evident that the proposed activity will eliminate a valuable aquatic resource, and will result in an unacceptable adverse environmental impacts. In addition, the work could be modified to greatly reduce these negative impacts and still result in a viable project. Consequently, because of these determinations, it is our belief that the proposed project is contrary to the Section 404 Guidelines and should be denied unless the applicant -2-- agrees to construct the planned boat basin at an upland location, and relocate the boat ramps to avoid high marsh areas. Additionally, the State of North Carolina Division of Shell- fish Sanitation has not yet determined if shellfishing areas will be closed as a result of marina operations at this site.
