Dear Colonel Warren:
In accordance with your request, this office has circulated to interested
state review agencies U. S. Army Corps of Engineers Public Notice ... 0103
dated January 16, 1986 which describes a project proposal by Dan C. Austin
and Associates of Raleigh. The project, involving stream channel relocation
to facilitate road improvements, is located on Marsh Creek off of Quail
Forest Drive in Raleigh.
Based on a coordinated agency review, the state will not interpose
an objection to the wetland alteration provided the following conditions
recommended by the N. C., Wildlife Resources Commission are made a part
of any permit issued. These recommendations are as follows:
1) Construction be modified such that no further filling of wetlands
is perpetrated;
2) The integrity of the stream should be maintained by the use of gravel
and rubble rather than concrete, and the banks and stream border should
be planted with native trees to retain some wildlife habitat;
3) A border of native trees and shrubs at least 10 feet wide should be
planted along the edge of the wetlands to protect them from encroachment
and as mitigation for wetlands illegally filled.
It is noted that the recommendations of the N. C. Wildlife Resources Commission
and the U. S. Fish and Wildlife Service to reconstruct a "natural" stream
bed- may be in direct conflict with Water Quality Certification No. 1888
issued on March 5, 1986.

The Division of Water Resources further recommends that special effort
be taken to minimize adverse effects of the channelization activity on
downstream riparian landowners. That agency reports that some residents
living adjacent to Marsh Creek have noticed increased flooding in recent
years which may or may not be a result of development.
Finally, if not already submitted by the applicant, a detailed sedimenta-
tion and erosion control plan must be submitted for approval by the City
of Raleigh under its erosion control program.
Should you require additional input from the state on this matter,
do not hesitate to contact this office.

THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Dan C. Austin & Associates
pursuant to an application filed on the 6th day of January, 1986 to
relocate a portion of stream and fill the original stream bed.
The Application provides adequate assurance that the discharge of
fill material into the waters of a tributary to Marsh Creek in
conjunction with the proposed access road in Wake County will not result
in a violation of applicable Water Quality Standards and discharge
guidelines. Therefore, the State of North Carolina certifies that this
activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500
and PL 95-217 if conducted in accordance with the application and
conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. That the new channel shall be stabilized with
riprap or concrete lining prior to diversion of
the creek into the new channel.
3. The existing stream bed to be filled shall be
dewatered prior to introduction of fill into
the existing channel.
4. That wet concrete shall not be allowed to contact
surface waters.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

I have no exception to the request by Dan C. Austin
& Assoc. to construct a new access road to his property.
However, the relocation of the stream, locally called
the Norwood Pond Canal which flows into Marsh Creek,
causes me considerable concern and I must oppose this
relocation because it will not, in my opinion, solve
Mr. Dan C. Austin & Associates' problem and will cause
more problems for me.
My property, containing only six and one half
acres, is bordered on the north side by Marsh Creek
and Dan C. Austin's property which has been developed
into apartments, with Marsh Creek being the boundary
line. On the west side, which has also been developed
into apartments, a sewer line has been constructed
across a portion of my property, without my permission,
in order to tie into the main sewer line that follows
Marsh Creek.
When I first learned of this, I did not think
it would do anv damage to speak of to my property,
but now I find that it has caused Marsh Creek to fill
up about two feet where the sewer line crosses Marsh
Creek and for approximately 100' to 150' upstream.
The stream bed has practically filled up level with
the ground. This causes even the normal flow of water
to spread out on both sides of the creek and on my
side has caused water to stand approximately six inches
deep over about one eighth of an acre on the north
side of my property and Marsh Creek. Dan Austin &
Assoc. moved in sufficient dirt to raise the level
of their land to get it out of the flood plain so that
apartments could be built.
Since the north side of Marsh Creek has been
raised, when the creek overflows more water was forced
to the south side of the creek, causing my pond to
wash out and a monetary loss of about $5,000.00. Therefore,
I do not feel that I can sit still and wait for further
damage.
. Since the land along Marsh Creek has been cleared,
leveled, and paved at least twice the amount of water
flows into this creek after a heavy rain and the stream
is not large enough to take care of this extra water.
The proper solution to this problem is to increase
the size of Marsh Creek to at least two times its present
size and to clear out the trees and smaller brush that
are now growing in the present stream bed.
Changing the course of the Norwood Pond Canal
as proposed by Dan C. Austin would simply make this
canal enter Marsh Creek where the stream has adequate
banks but would not solve the problem that exists further
upstream.

PUBLIC NOTICE
DAN C. AUSTIN AND ASSOCIATES, Post Office Box 17601, Raleigh, North
Carolina 27619, has applied for a Department of the Army permit TO EFFECT
CONSTRUCTION OF AN ACCESS ROAD IN RALEIGH, Wake County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show the proposed construction of a 30-foot-wide access road from
Quail Forest Drive to a proposed apartment complex. The proposed roadway
construction will involve relocating approximately 380 linear feet of
previously-channelized, 10-foot-wide stream into a 17-foot-wide (top width)
excavated channel. Approximately 500 cubic yards of high ground clay is to be
placed in the existing channelized stream north (upstream) of the tributary's
confluence with wetlands on Marsh Creek. The new stream channel will be
constructed through high ground for a length of approximately 270 feet. This
high ground section will be constructed with 2:1 side slopes and lined with
concrete. The new channel is proposed to continue for an additional 13.5 feet
in length through previously disturbed overflow wetlands to end at Marsh
Creek. All material excavated for the new creek channel (upland and wetland
sections) will be placed and retained on high ground on the property. The
applicant proposes to place riprap in the finished stream channel immediately
upstream and downstream of the proposed concrete-lined section for structure
stabilization.
The northwestern 340 linear feet of roadway will be constructed on high
ground. An elevated timber bridge will convey traffic over the proposed
concrete-lined channel. South of the bridge, the proposed roadway will
traverse a 110-foot-long area of previously cleared wetlands. The proposed
roadway will be constructed at existing grade or below throughout the wetland
crossing to satisfy local floodway construction restrictions. Approximately
130 cubic yards of sandy clay and organics will be excavated for the wetland
crossing and retained on high ground. Construction of the wetland crossing
will involve the discharge of approximately 68 cubic yards of paving material
into wetlands onsite. Wetlands contiguous with and alongside Marsh.Creek at
the project site have been previously altered by construction of a sewerline
through the area. Project wetlands are characterized as predominantly cleared
with scattered red maple, elm, willow, and poplar. These wetlands exhibit
evidence of frequent flooding. The unnamed tributary on the property is
bordered by high ground along both channel banks and exhibits signs of

F. ;previous chcihnelization. The purpose of the proposed work is to provide
access for a proposed apartment complex. Plans showing the work are included
with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit. .
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM), issues, denies or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management., Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.

The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
February 26, 1986.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the North

Enclosed is the application of Dan C. Austin and Associates
for a Department of the Army permit and a State Water Quality
Certification to complete the placement of fill material in waters
and wetlands of Marsh Creek to facilitate roadway and apartment
construction in Raleigh, Wake County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request
for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by March 14, 1986, the District Engineer
will deem that waiver has occurred.

Dear Mr. Jolly:
In responce to the letter concerning the Marsh Creek Apartment
Project addressed to me, dated December 9, 1985, from Iv1r, Charles
W. Hollis of the Regulatory Branch, I am forwarding herewith
one (1) completed application form for the issuance of a "Permit
to excavate and/or fill" in connection with this project.
As you are aware, work commenced on this project several months
ago without a permit. Since meeting with you and learning of the
need of a 11404 Permit" work has been haulted. The property
owner has restored the wetlands as you requested. The need of a
permit was an oversight on the part of everyone involved. The
property owner fully intends to follow all Dept. of the Army
