Your revised plans involve the installation of a temporary cofferdam to facilitate construction of a boat ramp and bulkhead. Your proposed revision has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080-N-000-0291. Therefore, you may commence construction activity in strict accordance with State authorization, modified June 23, 1987, and the enclosed plan. Box 612, Grandy, NC 27939 authorizing development in Currituck . County at Currituck Sound near Grandy off of U. S. 158 .as requested in the permittee's application dated 6/27/86 including attached plats, 10, 1-2 and 4-8 of 8 dated 6/24/86, 7-8 dated revised 11/6/86. 3 of 8 and cofferdam cross section dated received 5/6/87. This permit, issued on ' , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) Wetland losses associated with widening existing channels will be avoided by confining excavation to the high ground side of the channels. Wetland losses from the new basin will be mitigated,as delineated by plat sheet 8 of 8 dated 6/24/86. (2) The wetland mitigation area must be carefully graded to wetland elevations. If soils are _ not appropriate for wetland types after grading, an organic mulch must be applied. Species planted in the wetland area shall include cypress (Taxodium distichum), gum (Myssa sylvatica or Myssa aquatica) immediately adjacent to the water with water oak uercus nigra an w17-ow oak (Quercus phellos) planted in areas between the road sou er and wetter areas closer to the water. Understory vegetation and ground cover shall reflect species composition in nearby forested wetlands. After stabilization, the mitigation areas shall be allowed to undergo natural plant community succession in order to realize optimum wildlife habitat value. Replacement of dead trans- plants shall occur until the area is adequately revegetated. (3) The mitigation area must be created and vegetated prior to basin excavation. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Currituck Shores Leisure Resort Permit #31-87 (Campshores) ' Page 2 of 2 i ADDITIONAL CONDITIONS (4) All materials used to construct the temporary cofferdam will be removed and and confined landward of waters and any regularly or irregularly flooded vegetated wetlands. (5) The materials used to construct the temporary cofferdam will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or debris will not be used. (6) All spoil will be placed directly on highground and retained in such a manner as to prevent its entry into adjacent marsh or waters, except that which will be placed behind the permitted bulkhead. No fill material shall be placed below the MHW line to create an artificial beach. (7) No bulkhead will be positioned farther than 3 feet waterward of the existing shoreline at the time of construction. (8) A 25 to 30 foot vegetated buffer will be maintained between paved areas and adjacent waters. (9) Three to four foot diameter culverts must be maintained between the 30 foot wide channels to be excavated in wetlands and the adjacent access channels. (10) The activity, including cofferdam construction and removal, will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (11) An erosion/sedimentation control plan must be submitted and approved at least 30 days prior to subject commencement. The plan must contain all temporary and permanent measures to be utilized. (12) The plans and specifications for the sewer system to serve this project have been reviewed by the Department of Human Resources Sanitation Branch staff. Final permits must be obtained through the Currituck County Health Department prior to construction. Before the permits can be granted, an owner's association must be established. (13) The installation of the sewer system must be completed under the supervision of the local health department and the design engineer must certify the system installation. (14) Plans and specifications for the water system to serve this project have been reviewed by the Department of Human Resources Engineering Planning Branch. The plans and specifications must be approved prior to construction. NOTE: Due to the complexity of the sewer system, a licensed operator should be obtained to operate -it. urrituck Shores Leisure Resort (Campshores Permit #31-86 Page 3 of 3 ADDITIONAL CONDITIONS W'?s NOTE: This project may increase mosquito production in the area for two reasons. Filling wetlands and runoff from impervious surfaces may cause severe changes in the water levels in surrounding wetlands and marshes. For information concerning appropriate mosquito control measures, the permittee should contact the Vector Control Branch at (919) 733-6407. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. NOTE: Water quality concerns in the dead end canals on the project area can be partially resolved by installing two additional culverts. One culvert should be installed beneath the road to connect the basin/access channel with the internal canal/pond system. The other culvert should be installed between the dead end canal and southernmost canal underneath the 14 ft. dirt road near the project area's southwestern corner. Such measures would enhance water circulation, thereby increasing flushing action and decreasing the potential for creating stagnant water bodies. Currituck Shores Leisure Resort recognizes the value of their fish and wildlife resources, especially in terms of the importance they play in a camper's visit to the resort. Wildlife conservation and management techniques will be incorporated into Currituck Shores' development plan. Specific goals will be to increase food supplies, manage for good habitat and sustain water quality. Steps to acheive these goals include: 1. Prevent erosion on disturbed areas by immediate seeding with Bermuda and/or fescue grass. 2. Preserve existing vegetative buffers on the property such as the old orchard and hedgerows in Phase I. These areas provide food and cover. 3. Increase habitat values of existing areas by encouraging fruit producing trees, shrubs and vines such as myrtle, wild grape, oak, green briar, persimmon and hickory. New landscape plantings shall include species favored by wildlife such as dogwood, autumn olive, Crataegs and yaupon. 4. Preserve a wooded natural area from further development. (see sheet 3 of 8 ) 5. Restrict access on the marshes to protect ground nesting song birds and waterfowl. 6. Leave dead trees in the woods for nesting cavities. 7. Place 3 or 4 logs on the edge of the existing pond and channel for sunning spots for turtles. 8. Install wood duck boxes in wooded areas. 9. Stock pond by NC State Fish Hatchery, Edenton. 10. There have been certain field modifications of the C.A.M.A. permit #31-86 issued February 18, 1986, which have reduced excavations, construction, and loss of wetland. These are listed on page three of the permit application. Please consider this new re-quest for a boat basin. It is reduced in size from the September 1985 permit application. I have contacted Mr. David Rackley and Mr. Ries Collins, U.S. Fish & Wildlife Service, Mr. Ron Seckler, National Marine Fisheries Services and Ms. Alison Arnold, Corps of Engineers for help in developing an appropriate plan. Ms. Arnold meet on site June 12, 1986 to further define regulations and discuss alternatives. We feel this plan adequately mitigates the previous concerns by the review agencies. As mitigation for "404 wetland" loss, we propose to designate an area of replacement habitat that will be modified to the same type habitat as lost by excavation of the boat basin. This will be done by grading the mitigation tract to the contour of adjoining forested wetland, replanting with native wetland species and then allowing the area to continue natural revegatation as a wetland community. Our planting plan will be done in consultation with the Division of Ecological Services, US Fish & Wildlife Services, Raleigh, North Carolina. The square footage of wetland habitat replacement is 16,825 sq. ft., which is larger than that destroyed by excavation of the boat basin (9,650 sq. ft.). The proposed 40' channel' around the picnic area was constructed as a 30' channel and only 2.6' deep (see sheet 5 of 8). 5. The proposed bulkhead along the soundfront will not be built. Existing rock rip-rap will hold the shoreline. 6. Camping lots near proposed boat basin will be tent camping only. 7. Camper pads for the RV sites will be 10'x32' gravel pads, not concrete pads. Gravel pads are already being used in Phase I. 8. All roads and parking in the sound front area are clay or gravel, and not asphalt. The changes in #7 and #8 should help to reduce runoff. B. Mitigation Tract As mitigation for '404 wetland' loss, we propose to designate an area of replacement habitat that will be modified to the same type habitat as lost by excavation of the boat basin. This will be done by grading the mitigation tract to the contour of adjoing forested wetland, replanting with native wetland , species and then allowing the area to continue natural revegatation as a wetland community. Our planting plan will be done in consultation with the Division of Ecological Services, U.S. Fish and Widllife Service, Raleigh, North Carolina. 4 Page 4 ATTACHED NOTE Campshores, Inc. CAMA Permit for Major Development The square footage of wetland habitat replacement is 16,825 square feet, which is larger than that destroyed by excavation of the boat basin (9,650 square feet). Please see plan sheet 8 of 8. C. Conservation of Fish and Wildlife Resources. Currituck Shores Leisure Resort recognizes the value of their fish and wildlife resources, especially in terms of the importance they play in a camper's visit to the resort. Wildlife conservation and management techniques will be incorporated into Curri.tuck Shores' development plan. Specific goals will be to increase food supplies, manage for good habitat and sustain water quality. Steps to acheive these goals include: 1. Prevent erosion on disturbed areas by immediate seeding with Bermuda and/or fescue grass. 2. Preserve existing vegetative buffers on the property such as the old orchard and hedgerows in Phase I. These areas provide food and cover. 3. Increase habitat values of existing areas by encouraging fruit producing tirees, shrubs and vines such as myrtle, wild grape, oak, green briar, persimmon and hickory. New landscape plantings shall include species favored by wildlife such as dogwood, autumn olive, Crataegus and yaupon. 4. Preserve a wooded natural area from further development. (see sheet 3 of 8 ) 5. Restrict access on the marshes to protect ground nesting song birds and waterfowl. 6. Leave dead trees in the woods for nesting cavities. 7. Place 3 or 4 logs on the edge of the existing pond and channel for sunning spots for turtles. 8. Install wood duck boxes in wooded areas. 9. Stock pond by NC State Fish Hatchery, Edenton. 10. CURRITUCK SOUND LEISURE RESORT George*H. Wood November 25, 1985 BIO REPORT PAGE 2 PROJECT DESCRIPTION` The applicants own a large tract of land which extends from U.S. 158 to the Currituck Sound near Grandy, N.C. The roadside property has been used for small commercial enterprises with the land directly behind this field much in large fields actively used for agriculture. The parcel adjacent to the sound supports a single family residence, a private boat basin and ramp. Two large areas of red maple and gum swamp exist in this area. At the sound side of,one of these areas of wooded wetlands is a small pond which is connected under a dirt road by a culvert to a canal which extends into the highground via drainage ditches. To the east of this canal is 540 linear feet of Juncus marsh which grades into an additional 500 linear feet 6f red maple and gum wooded wetland. The west side is bordered by 300 feet of highground adjacent to the sound, then a pond and wooded swamp. A second canal extends into the highground approximately one half the way along the shoreline to the west. This canal is bordered by highground to the east and 180 linear feet of Juncus and 370 linear feet of wooded swamp to the west. The "404" jurisdiction line has been staked by the Corps of Engineers and is depicted on the plats. The applicants propose to affect improvements to the parcel to develop a 400 unit campground with two club houses, two boat basi.ns and a sand beach. I shall describe the planned improvements by referring to each sheet of the attached plats. Sheets 2-5 of 8 depict the portion adjacent to the sound and extends about one third towards the road. The property beyond this point is depicted in the overview plat and is currently being developed. OVERVIEW PLAT This area which was agricultural fields will support 335 of the campspaces, one of the clubhouses, a pool, tennis courts, reception center and a large sewage disposal system which is currently being reviewed by the Division of Health Services. SHEET 2 OF 8 h On the south of the property depicted in this plat is the head of one of the drainage ditches which empties into the canal on the east side of.the tract. The head of the other canal ends. at the upper right hand side of the plat where the excavation of a 150 foot long by 100 foot wide by -4 foot deep boat basin is proposed. This basin is proposed in the red maple/gum swamp and will be:,accomplished by dragline with the spoil being placed directly in durnptrucks and used elsewhere in the project. A thirty eight foot wide by 30 foot long boat ramp is proposed to be constructed in the basin. Sixty four campsites are proposed in this area, each with a 10 foot by 50 foot concrete pad and serviced by the sewage disposal system. CURRITUCK SOUND LEISURE RESORT BID REPORT PAGE 3 PROJECT DESCRIPTION SHEET 2 OF 8 CONTINUED The interior of the basin will be bulkheaded. Asphalt roads will provide access to the campsites. SHEET 3 OF 8 The existing basin at the top of this page is proposed to be bulkheaded along the highground and stop at the wetland edge. An additional 18 foot by 10 foot boat slip will be excavated into the highground. The canal in the middle of the page will be broadened from its existing 25 foot width to 30 feet by excavating the marsh side. The highground side of the canal (the side to the south) will be stabilized by bulkheading and the bulkheading will continue down the shoreline of Currituck Sound. Rock rip rap has.been placed along the shoreline of the sound and the applicant has requested that the bulkhead extends waterward of this rock to facilitate its construction. This desire will result in the bulkhead being aligned 5 to 8 feet waterward of the normal water contour. No marsh exist along this shoreline. The brick house has already been removed and proposed for this area is a parking area, club house and pool. At the bottom of this page is depicted the proposed 40 foot wide channel to be excavated in "404" marsh. The remaining marsh in the middle may then become dry enough to utilize as picnic area. SHEET 4 OF 8 A twelve foot wide by 135 foot long pier with a 600 square foot tee is proposed to extend into Currituck Sound. Six 30 foot long jetties will be installed along 150 feet of the shoreline, with the highground pushed down to create a sand beach. Bulkhead will be Constructed around the shoreline tip into the canal to abate erosion. Its alignment is also proposed to be 5 to 8 feet waterward of the NWL. The canal will be widened to 30 feet by excavating on the marsh side resulting in the excavation of 5,400-square feet of Juncus marsh. The existing pond will be deepened to -5 feet and drain via a culvert into the -4 foot deep canal. The adjoining waters of Currituck Sound are reported to be -4 feet deep. SHEET 5 OF 8 The canal will be widened to 30 feet by excavating on the sound side. This will result in the excavation of 1,800 square feet of wooded swamp and 6000 square feet of highground. The construction of the bulkheads and boat ramps will result in the filling of 3,560 square feet of shallow water habitat. Sixty.-five concrete pads, asphalt roads, parking areas, bath houses, swimming pools and a clubhouse will contribute to impervious surfaces in the project area. The boat basins are for use by small motor boats and therefore will not contribute to over board discharges. A review of your applioation reoeived September 25, 1985, for a Department of the Army permit to maintain and improve two channels, excavate a basin, construct piers, boat slips and jetties, and construct and'backfill a 1,850-foot-long bulkhead on Curri tuck Sound, south of Grandy, Curri tuck County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be 'withdrawn from this general permit process for any reason, you will be written and informed of its further management. If there are no unresolved differences of State-Federal positions or policy, the final action taken on your application by the State will result in your receiving written notice from us that your application has been successfully processed under our general permit.
