(1) The riprap material will not be positioned farther than 9 feet waterward from the toes of the existing bulkheads at any point along its alignment. (2) The riprap material will be clean and free of any pollutants, except in trace quantities. . Metal products, organic materials, or unsightly debris will not be present.' (3) The activity shall be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction-related discharge (increases such that the turbidity in the Stream is 25 NTUs or less are not considered significant). (4) The riprap material shall be of such size as to not be carried off by wave action and that the material consist of clean rock or masonry material free of debris or toxic materials. (5) No marsh may be excavated or filled outside of the alignment indicated on the plat. .. . . . - - .. - This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the riprap material be of such size as to not be carried off by wave action and that the material consist of clean rock or masonry material free of debris or toxic materials. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 25th day of July, 1986. Carteret County. 9.• Narrative description ` .The applicant's property consists of an approximately 700 acre tract of land and waterfowl impoundment area located adjacent to North River and off the Crow Hill Road (SR 1331) near the community of Otway, Carteret County. Anyone wishing to visit the site should contact-the farm manager in order to gain access to the project site. Approximately 25 years ago two large diked impoundment areas (about 150 acres each) were constructed for.the purpose of waterfowl habi- tat. The western dike.system over the years has been beached and now allows salt water to move freely in and out of the impoundment area. The eastern dike syste, however, still remains as a fresh- water impoundment and has a population of bass residing within. Over the years portions of the northernmost dike system have been stabilized by a variety of methods, including wo-oden•bulkheads and riprap. Most recently (within the last year) about 400 lin.ft. of dike.system was authorized by Gen. Permit to be stabilized by rip- rap material. The applicant is now requesting permission to stabilize two existing bulkhead systems by the placement. of riprap material which would be 9-10' waterward of the existing structures. The exist-. ing bulkheads are approximately 5' in height with one being approxi- mately 278' on .length-and one about 3721. Portions of the bulkheads have deteriorated at. the-base of the structure.to the point where- backfill material is leeching away into adjacent waters. The apparent deterioration caused at the base of the bulkhead appears to be from marine growth. There are no,vegetated wetlands waterward of the westernmost bulkhead. There are, however, two patches of Spartina alterniflora that are located-waterward of the easternmost bulkhead. One measures about 15' long by up to 6' in width, and one pocket measures approximately, 18' long by up to 10' in width. These marshes .are showing signs of undermining from erosion. 10. Anticipated impacts The project as proposed will result in the placement of about 650 lin. ft. of riprap material waterward of an existing bulkhead. This rip- rap placement will result in the filling in of approximately 6,175 sq.ft. of bottom area below the MHW line with about 350 cu.yds. of riprap material. Additionally, approximately 15.5 sq.ft. of Spartina " alterniflora marsh will be filled by this project. Before any fill material is placed in the water the applicant is proposing to place filter cloth along the base of the bulkhead and underneath the pro- posed riprap. The applicant has.indicated that the requested width of 9-10' is needed in order to provide proper slope for adequate pro- tection of the existing bulkhead structures. Project summary The applicant proposes to stabilize two existing bulkheads, by 1 }'placing riprap waterward of the structures at a site adjacent to Narth River off SR 1331 (Crow Hill Rd) near the commuj i ty of Otway - Carteret County. 9. Narrative description - The .applicant's property consists of an approximately 700 acre tract of land and waterfowl impoundment area located adjacent to North River and off the Crow Hill Road (SR 1331) near the community of Otway, Carteret County. Anyone wishing to visit the site should contact the farm manager in order to gain access to the project site. Approximately 25 years ago two large diked impoundment areas (about 150 acres each) were constructed for the purpose of waterfowl habi- tat. The western dike system over the years has been beached and now allows salt water to move freely in and out of the impoundment area. The eastern dike syste, however, still remains as a fresh- water impoundment and has a population of bass residing within. Over the years portions of the northerizmost dike system have been stabilized by a variety of methods, including wooden bulkheads and riprap. Most recently (within the last year) about 400 lin.ft, of dike system was authorized by-Gen. Permit to be stabilized by rip- rap material. The applicant is now requesting permission to stabilize two existing bulkhead systems by the placement of riprap material which would be 9-10' waterward of the existing structures. The exist- ing bulkheads are approximately 5' in height-with one being approxi- mately 278' on length and one about 372'. Portions. of the bulkheads have deteriorated at the base of the structure to-the point where: backfill material is leeching away into adjacent waters. The apparent deterioration caused at the base of the bulkhead appears to be from marine growth. There are no vegetated wetlands waterward of the westernmost bulkhead. There are, however, two patches of Spartina alterniflora that are located waterward of the easternmost bulkhead. One measures about 15' long by up to 6' in width, and one pocket measures approximately 18' long by up to 10' in width. These marshes are showing signs of undermining from erosion. 10. Anticipated impacts The project as proposed will result in the placement of about 650 lin. ft. of riprap material waterward of an existing bulkhead. This rip- rap placement will result in the filling in of approximately 6,175 sq.ft. of bottom area below the MHW lrne with about 350 cu.yds. of riprap material. Additionally, approximately 155 sq.ft. of Spartina alterniflora marsh will be filled by this project. Before any fill- .material is placed in the water the applicant is proposing to place filter cloth along the base of the bulkhead and underneath the pro- posed riprap. The applicant has.indicated that the requested width of 9-10' is needed in order to provide proper slope for adequate pro- tection of the existing bulkhead structures.
