By letter of July 22, 1986, after issuance of North Carolina Department of Natural Resources and Community Development permit No. 130-86f we informed you that the work was consistent with our general permit No. SASiWBO-N-000-0291. Reference also your recent request to modify the permit to change the location of three of the permitted ;piers and to include construction of a bridge across the existing access canal. Through coordination with the Korth Carolina Division of Coastal Management, we have learned that the State permit was modified on October 8, 1987. Accordingly, we consider the proposed modification to be consistent with, and authorized by, the aforementioned general permit. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The pier will be constructed in accordance with the attached project plans. (2) A minimum vertical clearance of 31 feet will be left between the bottom of the bridge and NWL to prevent blockage of navigation. (3) The activity will ibe conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (4) A pumpout system will be installed to service boats with holding tanks, as noted by application and permit plat, sheet 2 of 3. (5) The marina shall prominently post and enforce a no sewage discharge policy for boats without holding tanks. (6) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. Project summary The applicant is proposing to construct four 200' long piers each having 14 finger piers 12' in length. Environmental settin The applicant owns Twin Lakes Campground which began in the late 1960's and early 1970's as "Pleasant Waters" subdivision and marina. During this period of time Mr. Crisp excavated a series of canal systems and basins of various shapes, and subdivided the surrounded lands as residential lots. During 1978, Mr. Crisp applied for a permit from the U.S. Army Corps of Engineers to remove an earthen plug which separated the canal system from Chocowinity Bay. This permit was issued with a condition that pilings be placed across the canal to prevent boat traffic from entering the canal. In 1981 Mr. Crisp applied for permission from the U.S. Army Corps of Engineers to remove the pilings. After conducting a water quality monitoring study, Mr. Crisp was allowed to remove the pilings. The present canal system is several thousand feet in length with various widths and depths. The main boat basin is approximately 700' long by approximately 400' in width with an average depth of + 6.0' at NWL. The basin is approximately 1200' from Chocowinity Bay. The applicant states that the original subdivision had 36 platted lots, all of which have now been sold except for seven. Much of the land surrounding the canal system is utilized for agriculture. Recently permits have been issued to Mr. Crisp to fill prong A (see plat) of the canal system. Project proposal The applicant is proposing to construct four pier systems within the boat basin of the Twin Lakes Canal System. Each main pier will be 200' long by 6' in width. Each.pier will have 14 finger piers 12' in length by 3' in width. This will enable each pier to moor approximately 28 boats. Tie-off pilings will also be placed alongside of each pier. Each pier will also have electrical outlets, spigot for water and a portable transfer tank for sewage pumpout will be available. Environmental iMact Concerns generated about the proposed project should be those of water quality problems which may result due to the marina development within the canal system. No wetland vegetation will be excavated and/or filled. David L. We recommend that the following conditions be included in the State authorization: a. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters on the United States. b. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. c. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash.
