This permit, issued on V.R a) Y6 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the pennit to be null and void. (1) In order to protect juvenile fin fish populations, no excavation or filling will be permitted between March 1 and September 30 of any year without the prior approval of the Division of Coastal Management. i (2) The excavation will be conducted below the normal water level and not exceed 3 feet below the elevation of normal water. (3) The bulkhead will not extend waterward more than 15 feet from the normal water level at any point along its alignment and will average no more than 5 feet waterward of the normal water contour at the time of construction. The permittee and/or his contractor is urged to meet with representatives of the Division of Coastal Management prior to project initiation to stake the alignment. (4) All fill material to be placed below normal water level will be confined behind the permitted bulkhead. NOTE: Filter fabric should be placed behind the bulkhead prior to backfilling in order to prevent excessive turbidity. L_ (See attached sheet for Additional Conditions) I This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Conner Permit #134-86 Page 2 of 2 ADDITIONAL CONDITIONS (5) All excavated materials will be confined landward of the normal water elevation contour and dewatered prior to placement landward of the permitted bulkhead. (6) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (7) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (8) Erosion and sedimentation control structures (silt fences, hay bales, etc.) must be utilized to prevent spoil material from re-entering adjacent waters or other adjacent properties. (9) The back fill/spoil material will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (10) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. lss._. We recommend that the following conditions be included in the State authorization: a. The bulkhead will be positioned in strict accordance with permit plans. b. All excavated materials will be confined landward of the normal water elevation contour and dewatered prior to placement landward of the permitted bulkhead. c. Excavation will not exceed 3 feet below the elevation of normal water. d. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. e. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of _ construction or construction-related discharge. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Therefore, if your office has not acted on the request by September 23, 1986, the District Engineer will deem that waiver has occurred. Project summary The applicant proposes to maintenance dredge and construct a bulkhead along a man made canal off of Coinjock Bay near Maple. 41' . * SANDRA CONNER BIO REPORT PAGE 2 SITE DESCRIPTION The applicant owns two lots which are bordered by Coinjock Bay to the east and a man made canal to the south. The Bay side of the property is bulkheaded and the canal side is not. The grassy lawn supports an existing single family residence and shed which is serviced by a septic tank and drain field. The canal is silted over at the mouth and currently provides 1 foot of water at normal water level. A small fringe of highly disturbed marsh (probably Phragmites spp.) approximately 4 feet wide and 40 feet long exists along the inner portion of the canal adjacent to a concrete parking pad. An old boat basin exist on the inner lot and is approx- imately 15 feet wide and 40 feet long. The applicant is proposing to bulkhead the canal bank in a straight alignment which will result in an alignment of 4 feet below normal water along the first 226 feet due to the highly scalloped shoreline. Also proposed is to bulkhead across the old boat basin resulting in an alignment of 15 feet below normal water for 40 feet. Once the bulkheading has been completed, the canal will be maintenance dredged to -3 feet normal water level and all spoil placed on highground for dewatering. The spoil will then be pushed behind the bulkhead. ' ANTICIPATED IMPACTS The bulkhead construction and backfill will result in the filling of 1,502 square feet of canal bottom and approximately 160 square feet of Phragmites spp. The dredging will deepen 3,500 square feet of shallow water habitat to -3 feet NWL. Some short term and localized turbidity can be expected. CAMA REVIEW The project site is classified as rural in the Currituck County LUP. This proposal is consistent with that Plan.
