This permit, issued one _? , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may subject permittee to a fine, imprisonment or civil action; or. may cause the permit to be null and void. (1) For the purpose of delineating the location of the proposed building, parking and general septic tank/drain field layout, the attached plat entitled "A Proposed Bulkhead Plan for Coastal Concepts, Inc." dated 12/31/86 shall be followed. Any building construction in the area labeled "Future Development may take place only after a modification of this permit. For the purpose of delineating other project details, including stormwater control, sheets 1 and 2 of 2 dated 12/5 and 12/6/86 respectively, control. Stormwater Management (2) The earth dike separating the swamp from the marsh shall remai.n in place. (3) The top strata, approximately 7, inches of soil silt loam shall be removed from under the parking area and replaced with a more permeable soil. (4) The parking lot shall be of gravel. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Bulkhead Construction The bulkhead will be constructed on an alignment in strict accordance with the permit plans. The alignment is 136.45 feet waterward of the centerline of N. C. Highway 50/210. (8) All backfili materials will be obtained from an upland source and confined landward of.the permitted bulkhead. (9) The fill material will be clean. and free of any pollutants, except in trace quantities.. Metal products, organic materials, or unsightly debris will not be used. NOTE: In order to prevent'.future-: problems the bulkhead should be constructed using batter pilings:rather than tie-backs-to deadmen. Preston Howard, Jr. Wilmington Regional Office SUBJECT: Regional Office Review & Recommendations Application for Permit for Excavation and/or Fill Coastal Concepts, Inc. - AIWW Pender County The applicant proposes to bulkhead his property in order to construct an office building and parking area. The project is adjacent to the AIWW in Surf City classified SA and open to shellfishing. The project was originally received by our office June 11, 1986 for review. The project's stormwater management plan did not meet the intent of the BPJ which were in place at the time. After a revised plan was submitted and deemed inadequate, the project was placed on administrative hold. Following the EMC adoption of new stormwater requlations the project was reviewed again. On September 23, 1986, this office received a letter from the applicant's consultant, Siteworks Design Group, suggesting a new approach. The suggestions were as follows: 1. That the parking lot be gravel. 2. That the roof runoff be directed away from the saltwater marsh towards the front of the building. 3. That all runoff be directed to the freshwater swamp area and that the freshwater will not be disturbed. The project has been reviewed to determine impact to water quality. The following comments are offered: 1. That the project will require 401 certification and the following condition be part of that certification: That the fill used be from an upland source free from any toxic material. This is the result of the owner agreeing to install a gravel parking area, thereby bringing the impervious area within 575 feet of the high water line to less than 30 percent. Project summary The applicant proposes to bulkhead and fill his property in Order to construct an office building. i I ,W 1 r' f Coastal Concepts Page 2 9. PROJECT DESCRIPTION: The project is located on the southwest side of N.C. 50 and N.C. 210 within Surf City in Pender County North Carolina. This area is a part of the original cause- way. Relic fill material exists over a portion of the lot. The lot to the east has been filled extensively as has the property to the west. The shoreline of the property is at the upper limit of the Corps "404" wetland jurisdiction. Due to the existance of the relic fill there is an abrupt slope along the interface of the fill and adjacent wetlands. This slope rises 1.0'-2.0' across the property. The area adjacent to the existing building to the east has been dug to alleviate drainage away from the building. There is an isolated pocket of trapped "404" at the northwest corner of the property (approximately 2,250 s.f.). An earthen dike was placed here sometime in the past. Myrtles and other woody species vegetate the area. Just waterward of the dike there is Spartina atens; Iva frutescens; Juncus romerianus and Salicornia spp. At the other side of the lot there is a stand of Spartina-cynosuro es, This is growing down at the normal "404" elevation as well as up the face of and the top of the slope (from approximately 3.3' MSL to 4.1' MSL on an average). Approximately 1,000 s.f. of this species exists at this corner. That portion of the totAl stand which is growing up the face and on top of the slope is interspersed with trumpet creeper (Campsis radicans) and Virgin Creeper (Parthenocisurs quinquefolia). Extending waterward from the entire shoreline the marsh changes from Juncus romerianus nearer in to dwarf Spartina alterniflora further out. The mean high water contour ranges from approximately 192' to 354' waterward of the top of the slope across the property. The applicant is proposing to bulkhead the property with backfill and to construct a two-story office building on the property. In order to provide sufficient room for parking the building must be located as near to the highground/wetland interface as possible. The applicant has revised his plans since the original submittal and now proposes to establish the alignment of the bulkhead approxi- mately 136.45' waterward of the centerline of the highway. The structure will be constructed of sufficient height to provide a proposed grade of 5.5' MSL. The building will be set in 2' off the bulkhead. It will begin at 6.0' MSL and will be two-story. The original calculations indicated that approxi- mately 2,250 s.f. of wetland area would be filled. Based on the modification this figure can be downgraded to approximately 950 s.f. of a mixture of transitional species. In order to minimize the runoff from the property, plans indicated that the parking lot drainage will be collected and will be placed in 6" perforated pipe underground. ANTICIPATED IMPACTS: The giant cordgrass marsh and other transitional species which will be consumed by this project are wetlands in name only. The location of the cordgrass along the face and on top of the slope effectively remove it from contact with all but -storm tide ranges. The loss of these species.along the highground/marsh interface is not seen as a significant negative adverse impact. The removal of the existing dike from across the mouth of the "404" wetland pocket will allow this area to function in a more productive manner while at the same time still - allow for the interception of stormwater runoff from the existing road.
