This permit, issued on ` 1 y C , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All backfill materials shall be obtained from a highground source and confined
behind the permitted bulkhead.
(2) The disturbed areas shall be properly graded and provided. a ground cover
sufficient to restrain erosion within 30 days of project completion.
NOTE: The bulkhead backfill is also authorized under General Water Quality
Certification #1272 issued on November 10, 1978 by the Division of Environ-
mental Management for such activity.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

, The Subject application has been reviewed for water quality
impacts and the following ccamnents are offered:
1. The proposed project will require a 401 Certification but
meets our conditions for general certification for bulkheads
and associated fill.
2. It is recommended that marine pumpout facilities be provided
and a locked-head policy posted and enforced prohibiting any
overboard discharge of sewage from vessels using the pier
facilities. Such measures are needed to adequately protect
the fecal coliform standards of these SA waters.

Carteret County
The applicant proposes to construct a 60 foot pier and reconstruct a
30 foot section of existing pier. A 90 linear foot bulkhead is also
proposed along the shoreline alignment. The project is located
adjacent to Westmouth Bay near Harkers Island, classified SA, and
currently closed to shellfishing.
The project has been reviewed to determine impacts to water quality.
The following comments are provided:
1. The project will require 401 certification, but should meet the
conditions of a general 401 certification for bulkhead
construction and associated backfill.
2. It is recommended that marine pumpout facilities are provided,
enforcement of a locked head policy, and signs posed along the
pier prohibiting overboard discharges of sewage, in order to
adequately protect fecal coliform standards for SA waters.

.9. Narrative description
The applicant's property is a one-third acre parcel located adja-
cent to Wallace Garner Harbor off Crystal Drive and SR 1399 on Har-
kers Island. The project can be found by turning off SR 1335 at the
Mormon Church and left on SR 1399. Crystal Difve is the left be-
fore reaching the harbor, and the lot is the second one on the
right.
The property is characterized by 3-4'astructureeapproximatelyly
with domestic yard grass. A low, enclosed
30' wide by 40' long exists at the site and its purpose is unknown.
A delapidated dock exists on the west side which follows the ap-
proximate alignment of the proposed dock the subject of this ap-
plication.
The applicant proposes to reconstruct the pier and extend it across
the water side of the lot. A bulkhead is proposed on the land side
of the pier which will average 2' offshore of the bank along its
length. No marsh exists at the site. The purpose of the project
is to provide dockage primarily for the applicant's commercial ve-
sels.
10. Anticipated impacts
Conducting the project as proposed will result in a dock structurft
covering about 450 sq.ft..of public trust areas.
will be filled by the proposed bulkhead with backfill. An ad-
jacent deck completely over highground will be constructed the same
width as the dock. No other development is proposed for the -site
at this time.
Adjacent waters are classified as SA according to DEM and shell-
.fishing in the harbor is closed according to the Div. of Health
Services.
