THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to City of Charlotte pursuant
to an application filed on the 28th day of October, 1985 to make stream
relocations and culvert crossings on Taggart Creek.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Taggart
Creek in conjunction with the proposed roadway construction in
Mecklenburg County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. That the banks of the relocated channel shall
be riprapped prior to diversion of the streamflow
into the new channel.
3. That wet concrete not be allowed to come into
contact with surface waters of the State.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

PUBLIC NOTICE
CITY OF CHARLOTTE, 600 East Trade Street, Charlotte, North Carolina
28202, has applied for a Department of the Army permit TO PLACE FILL MATERIALS
IN THE WATERS AND WETLANDS OF TAGGART CREEK TO STRAIGHTEN THE CHANNEL
ASSOCIATED WITH INSTALLATION OF FOUR CONCRETE BOX, ROADWAY CULVERTS FOR RAMPS
AND LOOPS OF THE TYVOLA ROAD INTERCHANGE OFF THE BILLY GRAHAM PARKWAY AT
WILMOUNT ROAD, CHARLOTTE, Mecklenburg County, North Carolina.
The following description of the work is taken from data provided by the
applicant. Plans submitted with the application show the proposed placement
of approximately 4,320 cubic yards of select fill materials as follows:
a. Work at site No. 1 requires the placement of approximately 580 cubic
yards of fill material for the installation of a triple, 12-foot by 12-foot
reinforced concrete box culvert under ramp A.
b. Work at site No. 2 requires the placement of approximately 440 cubic
yards of fill material for the installation of a triple 12-foot by 12-foot
reinforced concrete box culvert under loop A.
c. Work at site No. 3 requires the placement of approximately 1,600
cubic yards of fill material to straighten 280 linear feet of Taggart Creek
channel so that it will flow under the proposed Wilmount Road Bridge.
d. Work at site No. 4 requires the placement of approximately 1,700 cubic
yards of fill material for the installation of a triple 12-foot by 12-foot
reinforced concrete box culvert under ramp D and loop D.
The total project is to require the excavation of approximately
90,000 cubic yards of earthen material. All excess material is to be disposed
of in an upland area. The highway contractor will be responsible for meeting
all applicable sedimentation and erosion control regulations established by
the North Carolina Department of Natural Resources and Community Development.
All disturbed areas will be vegetated after completion of the highway work.
The purpose of the work is to provide more improved traffic movement. Plans
showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor

will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with,
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of

the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
December 17, 1985.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the North
Carolina Division of Environmental Management, Post Office Box 27687, Raleigh,
North Carolina 27611-7687, on or before December 11, 1985, Attention:

Written comments pertinent to the proposed work, as outlined above, will
be received in this office, Attention: Mr. Mike Smith, until 4:15 p.m.,

Dear Mr. Mills:
Please find attached your copy of the City of Charlotte's applications for
permits to allow excavation and filling in Taggart Creek. This will allow us
to construct concrete box culverts under the proposed loops and ramps of a new
interchange between the existing Billy Graham Parkway and our proposed Tyvola
Road Extension project. At present the landowners along Taggart Creek are as
shown on the application forms. The City is now in the process of acquiring
this land and will be the landholder before any construction can be done or
permit utilized. We plan to begin construction in early April, 1986. In order
to meet our deadline for completion of the Tyvola Road project, we ask that the
applications be processed as quickly as your schedule allow so that we can meet
our early April deadline.
The applications are also being sent to the Corps of Engineers in Wilming-
ton, North Carolina.

permit is needed,.and how to submit a permit application.

Enclosed is the application of the city of Charlotte for a
Department of the Army permit and a State Water Quality
Certification to place fill material in the waters and wetlands of
Taggart Creek associated with construction of the Tyvola Road
Interchange, Charlotte, Mecklenburg County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request
for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by January 6, 1986, the District Engineer
will deem that waiver has occurred.

In keeping with your request, this office has circulated to interested
state review agencies U. S. Army Corps of Engineers Public Notice ....
0035 dated November 7, 1985, which describes a project proposal by the
City of Charlotte. The project, involving the placement of fill material
into waters and wetlands of the state, is located on Taggart Creek off
of the Billy Graham Parkway at Wilmount Road, Charlotte, in Mecklenburg
County. ,
Based on a coordinated agency review, the state will interpose to
objection to the project provided 1) standard erosion control techniques
be utilized to prevent sedimentation; 2) the steep sandy banks will be
stabilized by planting fescue or lespedza and native trees throughout
the floodplain and along the streambank down to the waters edge. Density
of tree plantings should follow standard stream improvement guidelines
(trout stream guidelines) and seedlings should have holes dug, mulched,
and fertilized; 3) large boulders will be placed in the stream (at least
one boulder every 150 feet) to create deeper holes and to improve cover.
Additionally, the Division of Health Services has requested that
the information on the attached sheet be entered into the record.

v We note that several water transmission and distribution lines
are located.in the path of and adjacent to the proposed
project. We are concerned that unless precautions are taken by
the contractor, these lines may be damaged or ruptured during
construction. The contractor should be required to contact the
appropriate water system officials with regard to specific
implementation of a work schedule.
No Comment
The proposed project will'be constructed near water resources
which are used for drinking. Precautions should be taken to
prevent contamination of the watershed or stream by oil,
asphalt plant spills or other harmful substances.
Back flow preventors should be installed on all incoming
potable water lines.
The applicant should be advised that plans and specifications
of all 4ater system improvements must be approved by the
Division.of Health Services prior to the award of a contract or
the initiation of construction. For information, contact the

Municipal and/or county sanitary landfills should not be used
for disposal of any solid wastes created as a result of this
proposed project. The amount of solid waste involved is
usually large and would decrease the anticipated life of an

Borrow pits and all ditches should be drained to alleviate

U. S. 158 as requested in the permittee's application dated 9/13//85 including
attached plats, 9, 1-8 of 8 dated "rev. November 6,1985" and overview plat, no date.
This permit, issued on 6 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) Excavation of -the proposed 155-foot long, 100-foot wide basin will be deleted
from the plans.
(2) Wetland losses associated with widening existing cbm*,ls will be avoided
by ;confinixlg excavation to. the hi,ghground side of the c inels.
(3) All spoil will be placed directly on highground and retained in such a manner
to prevent its entry into adjacent marsh or waters, except that which will
be placed behind the permitted bulkhead. No fill material shall. be placed
below the MHW line to create an artificial beach.
(4) No bulkhead will. be positioned farther than 3 feet waterward of the existing
shoreline except in the area of the southernmost reach of the shoreline
where a maximum waterward distance of 6 feet may be required to negotiate
deteriorated, scattered shore protection materials.
(5) A 25 to 30 foot vegetated buffer will be maintained between paved areas
and adjacent waters.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.
