Thomas Rhodes, Secretary In keeping with your request, this office has circulated to interested state review agencies U. S. Army Corps of Engineers Public Notice .... 0473 dated December 4, 1986 which describes a project proposal by the City of Charlotte. The project, involving the filling of 1.5 acres of open water and wetland to construct a golf course, is located on an unnamed tributary of Sugar Creek in Charlotte, Mecklenburg County. Based on a coordinated agency review, the state will interpose no objection if the following stipulations, as recommended by the N. C. Wildlife Resources Commission, are made a part of any permit that is issued. The mitigation proposal is acceptable provided that drainage from the existing pond in no way affects the function of the existing wetlands or proposed created wetlands. Reportedly, noxious fumes were emenating from a pond on the site and it is unknown if there are any toxic substances present. For your information, the Division of Environmental Management issued Section 401 Water Quality Certification No. 2016 for the project proposal on January 20, 1987. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Sugar Creek tributary in conjunction with the proposed golf course in Mecklenburg County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). 2. That appropriate sedimentation and erosion control measures shall be employed to minimize turbidity and siltation impacts from the project. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 20th day of January, 1987. OPERATIONS URMC H This Office has reviewed the subject proposal for the placement of fill material in 1.5 acres of the waters and wetlands of an unnamed tributary to Sugar Creek. The placement is necessary to facilitate the construction of the York Road Renaissance Golf Course. Based on our review, we anticipate no adverse effect on water quality except during the actual filling operation when turbidity would be expected to increase. Fish and wildlife habitats in the immediate area of the fill will also be disturbed, however, this should be relatively insignificant. We, therefore, have no major.objection to the proposal. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed placement of fill material in approximately 1.5 acres of wetlands to facilitate the construction of the York Road Renaissance Golf Course. Approximately 0.2 acre has already been filled. The work includes the establishment of cart crossings, the construction of lakes and ponds and general grading. The applicant proposes a mitigation plan which includes the creation of 3.0 acres of wetlands within the golf course boundaries. The mitigation plan, dated October 10, 1986, was prepared by MR. ALAN B. SMITH, Ecological Consultant. Copies of the mitigation plan are available upon request. In summary, the mitigation plan calls for the enlargement of an existing wetland area by lowering the elevation of adjacent high ground. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. -2- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies- 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. 4 -3- Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after January 13, 1987. SAWC086-N-060-0473 December 4, 1986 PUBLIC NOTICE THE CITY OF CHARLOTTE, ENGINEERING DEPARTMENT, Suite 400, Cameron Brown Building, 301 McDowell Street, Charlotte, North Carolina 28204, represented by WOOLPERT CONSULTANTS, 8731 Red Oak Boulevard, Charlotte, North Carolina 28210, has applied for a Department of the Army permit TO PLACE FILL MATERIAL IN 1.5 ACRES OF THE WATERS AND WETLANDS OF AN UNNAMED TRIBUTARY TO SUGAR CREEK ASSOCIATED WITH THE CONSTRUCTION OF THE YORK ROAD RENAISSANCE GOLF COURSE IN CHARLOTTE, Mecklenburg County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed placement of fill material in approximately 1.5 acres of wetlands to facilitate the construction of the York Road Renaissance Golf Course. Approximately 0.2 acre has already been filled. The work includes the establishment of cart crossings, the construction of lakes and ponds and general grading. The applicant proposes a mitigation plan which includes the creation of 3.0 acres of wetlands within the golf course boundaries. The mitigation plan, dated October 10, 1986, was prepared by MR. ALAN B. SMITH, Ecological Consultant. Copies of the mitigation plan are available upon request. In summary, the mitigation plan calls for the enlargement of an existing wetland area by lowering the elevation of adjacent high ground. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. -2- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. -3- Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after January 13, 1987. The information in your letter has been presented to and discussed with the City of Charlotte. In addition, several visits have been made to the site by City representatives to review the areas -in question. Acting on behalf of the City of Charlotte, we offer the following additional information relating to the Project, to familiarize the Corps of Engineers with our situation and the ultimate position we take in this matter. The history of the Project and site is presented in detail for your benefit and review. On December 1.2, 1983, the City of Charlotte commissioned Woolpert Consultants to complete an overall Master Plan for York Road Community Park, formerly a part of the 375-acre York Road Landfill site. Kidwell-Hurdzan, Golf Course Architects, and Law Engineering Testing Company, Geotechnicians, were selected as co-consultants, to assist in the planning of the Park. The Master Planning process took 12 months to complete. The final Master Plan was presented and approved.by City Council on October 8, 1984. The total estimated cost of the Park, as shown on the Master Plan, is $12,832,120. As part of the process, Woolpert Consultants analyzed the natural. elements of the site and prepared a technical evaluation of the landfill property. A drainage-elevation study was conducted in analyzing the site. Hollis August 6, 1986 ?+ a Page 2 information regarding floodway boundaries, drainageways, and poorly drained areas of the site. The Charlotte Official Flood Area Map, prepared by the U.S. Army Corps of Engineers; the 1977 Soil Survey of Mecklenburg County, prepared by the U.S. Soil Conservation Service; and Hydric Soils of the United States, 1985, prepared by the US Department of Agriculture, were resources to complete this study. These documents indicated that the 100-year flood elevations along the edge of the Sugar-Irwin Creek range from 591 to 594 feet above sea level. Poorly drained areas were identified adjacent Sugar-Irwin Creek and the two first order tributaries of Sugar-Irwin Creek that drain the site. There are no hydric soils on site, as classified by the National Technical Committee for Hydric Soils. Woolpert Consultants and Kidwell-Hurdzan visually inspected the entire site, including the drainageways, during the preparation of the Master Plan. In our judgment, the majority of the poor drainage on site is a result of proximity to drainageways, nearly level topogra- phy, and loamy subsoils. The poorly drained areas along the two tributaries to Sugar-Irwin Creek are dry. They probably experience occasional wetness when these intermittent streams have flow (following heavy rain events). These areas are not normally inundated by surface or ground water. We discovered some wet spots on site, between Holes #11 and #16, and a small one between the drainageway and the perimeter of Golf Hole #16 Fairway. Soils underlying these wet spots are typcially somewhat poorly drained and low in organic matter. A drawing of the Golf Course showing these areas has been en- closed for your review. The Master Plan best-suited for the Park site is based upon the constraints and opportunities identified from the drainage-elevation study, in addition to information gathered on cultural features, soils, slopes, and vegetation. Our final task in completing the Master Plan of York Road Commu- nity Park was to design the physical layout of all the recreational improvements determined by the City of Charlotte. The layout of the Golf Course evolved during the Site Design Phase of the Master Planning process. Several plans were studied, resulting in the final Master Plan adopted by Charlotte City Council. X,. Ms. Alison Arnold and Mr. Charles W. Hollis August 6, 1986 Page 3 Many site factors had to be taken into consideration with the design of the Golf Course: o The Golf Course is located entirely on the west side of Tyvola Road Extension (a future six-lane major thoroughfare, presently under construction), to ensure that the public need not cross the roadway. o Because of a Duke Power transmission line corridor which passes the site, the Golf Course will be segmented into two nine-hole courses; nine golf holes will be placed on each side of the corridor. o To locate the irrigation pond on a flat site not previously land- filled, and to supply additional land in routing the back nine holes of the Golf Course, we recommended that the City of Char- lotte acquire the 63-acre parcel of land owned by the Austin Powder Company. The City is currently involved in condemnation proceedings to acquire this property. They are expecting to pay more than the appraised value of the land, because of an inflated offer from a local developer to purchase and use the site for an office park. We bring this to your attention because most of your concerns regarding wetlands occur on this property. This land is highlighted on the enclosed Exhibit. o The routing of the golf holes was strongly influenced by the site's topography, drainage patterns, and vegetation. o The golf holes follow the alignment which requires the least amount of earthwork in completed areas of the landfill and provides the least disturbance to the remaining portions of the site. The majority of the golf holes run parallel with the existing topography, creating flatter grades and better sight distances for the safety of the player. o The routing of the golf holes requires that the two drainageways passing through the site be incorporated into the design. The drainageway nearest York Road is to be preserved, with its vegetation, except where Golf Holes #1, 3, 8, and 9 unavoidably have to cross. The second drainageway passing through the Austin Powder Property was originally intended to be expanded for the location of the irrigation lake. The small man-made quarry adjacent Green #17 and some of the inundated areas of the site previously mentioned are to be preserved as marshes or water features. These areas will be treated as natural visual elements for the public to enjoy during play on the Golf Course. . 4, 7* # Ms, Alison Arnold and Mr. Charles W. Hollis August 6, 1986 Page 4 The back nine holes of the Golf Course are routed to preserve some large specimen deciduous and evergreen trees located throughout this area. The Austin Powder Property, logged several years ago, is the proposed setting for the irrigation lake. This minimizes clearing requirements and reduces potential impact on the site. The entire Master Planning process of York Road Community Park was subject to public review. Five public meetings were held to review the Project. Citizens were encouraged to participate and provide input into the planning process. The detailed site analysis, along with the conceptual plans for the Park, were presented at these meetings. Throughout the public involvement process, the Charlotte Community has been in total support of the Project. They are espe- cially interested in the Golf Course as an innovative reclamation land use proposed on the large municipal landfill. No concerns were ever voiced about the interrelationship of the Golf Course with the drainageways or wet areas of the site. On February 1, 1985, Woolpert Consultants entered into another agreement with the City of Charlotte for preparation of construction drawings of the entire Park. During 1985, the plans for the Golf Course were further detailed and adjusted, due to better base and field information. Additional soil borings were taken throughout the Golf Course, especially in the area of the proposed irrigation lake and all culvert crossings. These borings revealed deep, well-drained alluvial soils, which are weak in supporting a water retention embank- ment. Because of this constraint, the irrigation lake was relocated between Tee 912 and Green #14, away from the soft soils. The area between Hole #16 and Hole 1;11 is to be preserved as a large natural marsh. Golf Hole #16 was adjusted during this period, because new soil boring information indicated similar soft soil characteristics in certain areas. A small marsh-like area adjacent the fairway is to be preserved, to create a water feature. A detailed hydrological report was prepared to assist in the design of the culverts and irrigation lake. All construction drawings were formally reviewed and approved by the City of Charlotte to insure compliance with all local standards. Their review included the design of the culverts and the irrigation lake. The North Carolina Department of Natural Resources and Community Development also reviewed and approved the drawings relating to erosion and sedimentation control. I. *` , •:. Ms. Alison Arnold and Mr. Charles Hollis August 6, 1986 Page 5 During this review period, conducted in April, 1986, we began our correspondence with the Corps of Engineers regarding this Project. Our purpose was to determine if any Army 404 permits would be required as part of this Project, since the site adjoins the Sugar-Irwin Creek Floodway. Our initial contact, on April 2, 1986, was with Mr. Michael Smith of your District. Copies of the plans and soil borings were sent to your office, to his attention, for review. Ms. Becky Ward, Project Engineer, Woolpert Consultants, explained the details of the Project to him by phone. Mr. Smith indicated that he was unable to make a determination regarding permits without inspecting the site and reviewing the plans. It was our understanding that your District would first review the plans, and, if it appeared that any permits would be required for this Project, the Corps of Engineers would contact our office requesting inspection of the site for final determination. During this critical review period in the month of April, we never received a site inspection request from your office. We interpreted this to mean we did not need any special permitting from the Corps of Engineers. With approvals from all regulatory agencies, Woolpert Consultants began advertising the Project on the first of May, to attract bids from interested contractors. We again contacted Mr. Smith of your office on May 1, 1986, to discuss a design change in the irrigation system. He informed us that his responsibilities within the District had changed and that we should contact Ms. Alison Arnold. Ms. Becky Ward spoke with Ms. Arnold and, again, sent information regarding the Project to your office for review. Ms. Arnold requested an inspection of the site on May 21, 1986. The bids for construction of the Golf Course were received on May 20, 1986, the day before Ms. Arnold conducted her site inspection. The City of Charlotte was legally bound to the bids received on May 20, 1986. Two apparent options were available to the City, as summarized below: o Reject the bids and address all the findings of the Corps of Engineers, as stated in the report letter dated May 28, 1986. This would require a damaging time delay and, ultimately, increase cost due to rebidding the Project. Ms. Alison Arnold and Mgr. Charles W. Hollis August 6, 1986 Page ,6 o Or, accept the bids and address all the findings of the Corps of Engineers, working closely with the District and insuring that those areas of concern are not disturbed by the Contractor and suitable mitigation is provided. This would enable the Project to stay on schedule, while we address the permit requirements of the Corps of Engineers. Based on Woolpert Consultant's recommendations, the City of Charlotte selected the latter option. Moore Golf, Inc., the Project Contractor; is currently on site, beginning construction of the Golf Course. They have been instructed not to clear or grade those areas identified in your report letter. We have, however, directed the Contractor to stake the entire Golf Course to interpret the relation- ship of each individual golf hole with the areas requiring a permit. We hope this history of York Road Community Park is helpful in your review of this Project and that you can appreciate the process we have followed and our willingness to work with the Corps of Engineers on this project. We would now like to respond to your findings, outlined in your letter of May 28, 1986, and the subsequent actions we would like to propose in acquiring the Army 404 permits for this Project. Regarding the requirement for the Army 404 permits. Based upon our latest review of the Army Corps of Engineers Regulatory Program and definition of its authority, we concur that the golf hole cross- ings over the unnamed tributary through the landfill and the construc- tion of Golf Hole 816 Fairway adjacent a second unnamed tributary are subject to the permit process. We also expect the fill for Fairway #11 to require a permit. We do not feel that Fairways #12 and #13 and Green #17 justify an Army 404 permit. The proposed fill for these holes is restricted to only tee and green locations. The fairways will remain at natural grade. The areas to be filled are no greater than one-half acre and do not present any real impact with the Sugar-Irwin Creek, tributaries, or inundated areas of the site. Regarding redesign of the Golf Course to avoid the placement of Golf Hole #16 adjacent the existing drainageway. As previously discussed, the location of this hole was determined by numerous site. and routing factors, making it truly water dependent within this area. •4 Ms. Alison Arnold and Mr. Charles W. Hollis August 6, 1986 Page 7 We believe that, by placing the hole as proposed, there is less overall impact to the site, with greater buffers between holes for the players' safety. The way the hole is currently designed, the hill- sides on both sides of the hole and natural stands of specimen trees can be preserved. The wet areas discovered during our planning of the Golf Course will be preserved as marshes. Improvement of any loss of wetland-related benefits could be provided through increasing the extent of wet areas along Holes #12, #13, and #16 and through the creation of the lake near Sugar-Irwin Creek. We question whether the entire area of Golf Hole #16 (from base of hillside to base of hillside) should be interpreted as a wetland. We understand that, during inspection of the site, you observed within this area some vegetation typically found in saturated soil condi- tions. To address your findings, Mr. Donald McSween, the City Arborist, was asked to inspect the plant materials within the area of Golf Hole #16 to help delineate the boundaries of the wetland. There are some plants in the area, such as black willow and cattails, that are typical of riparian vegetation. Trees typical of forested wetlands in Western North Carolina, green ash and red maple, are also present. Other trees indicative of well-drained conditions were found in the same area. The trees, not expected in wetland areas, include: red oak, hickory, dogwood, and redbud (Jim Brown, National Wetlands Inventory Section, U.S. Fish and Wildlife Service, Region 4 office). We concur that a delineation of wetland boundary should be made in this area to allow the Corps to make a final jurisdictional determina- tion. The City is in the process of obtaining a local botanist familiar with wetlands in Mecklenburg County area. Regardinq itigation of Any Adverse Effects. We realize that wetland areas provide numerous benefits, including: flood and erosion control, aquifer recharge, water quality improvement, exceptional wildlife habitat, and recreational opportunities. Municipal water supply is not effected by this project, because the City of Charlotte draws its water from surface water reservoirs.
