Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. This permit, issued on n. VV , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The project will be conducted in accordance with the following plats: site plan, excavation and fill area plan view, "fill area", "boat ramp", "docks", "bulkhead and floating docks", "dry storage building" and "dry storage boat ramp", all dated received 6/25/86. (2) The floating dock closest to the property of W. H. Purser must maintain a 15 foot setback from the property line. (3) All backfill and earthen landscaping must be confined by the permitted bulkhead in such a way as to prevent any erosion or sediment runoff entering the adjacent wetlands or waterway. (4) All excavation and fill operations must take place in accordance with the approved work plat drawing. (5) All excavated spoil will be confined on the high ground and retained landward of the permitted bulkhead. See attached sheet for Additional This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification- not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Peter James Chagaris ADDITIONAL CONDITIONS Permit #192-86 Page 2 of 2 (6) All spoil material must be provided with a ground cover sufficient to restrain erosion within 30 working days of placement. (7) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (8) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (9) No wetlands vegetation will be filled upon outside of those areas as shown on the work plat drawing. Excavation within the existing boat basin will not exceed -5' on NWL. (10) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. (11) No person shall be allowed to live aboard vessels in the marina. (12) The marina shall prominently post and enforce a no sewage discharge policy. (13) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for on-shore sewage treatment. (14) The marina will display a sign showing the location of the nearest pumpout facility, listing the telephone numbers of local septic tank pumping services and including other appropriate waste disposal information. (15) Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the State of North Carolina and the United States of America. (16) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. NOTE: A preconstruction conference.should be held with the applicant, his contractors and representatives of the DCM and/or the U. S. Corps of Engineers prior to undertaking development authorized in this permit for condition review and bulkhead alignment staking. NOTE: Any change in development on the high ground will require a modification of this permit. NOTE: Section 401 Water Quality Certification #1974 was issued on September 16, 1986 for the project by the Division of Environmental Management. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Lawson Creek in conjunction with the proposed boat facilities in Craven County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction- related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the material used to fill a portion of the existing basin be clean material from an upland source. 3. That excavated material from the channel and basin be properly contained. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 16th day of September, 1986. Narrative description The project site is located on Pembfoke Road (SR 1200) lust off Hwy. 70 bypass next to the entrance to the Lawson Creek Park in the City of New Bern, Craven County. This 1.8 acre tract of land which in- cludes a highground boat basin, is situated on.the north sho.re of Lanes Branch a tributary of Lawson Creek and the Trent River. Tradition- ally, over the past several years the property and existing facili- ties have been operated as a commercial marina known as "Kimbrell's" with-sales and services provided. In more recent times the property and facilities have fallen into disrepair. At present, the existing masonary building shown on the work plat draw- ing has been refurbished as the marina office and service repair area. The land slopes noticeably away from the elevations of about 8' nearest the paved road to about 2-4' along the edge of the "L" shaped basin. An old concrete boat ramp which is in need of repair is located along the back edge of the boat basin and flanked on the west side by a newly rebuilt fuel dock. This property is bordered on the east side by another small man-made-boat basin owned by Mr. W. H. Purser. Law- son Creek Park, on.the opposite shoreline, is about 250' across Lanes Branch. It is certain that most all of .the lands surrounding these man-made basins were.formerly wooded swamp areas that were filled upon. ptesidual cypress trees and small patches of vegetation persists along the shoreline. The applicant was cautioned and encouraged in early June of 1986 tthe seek proper CAMMA permits while reconstruction was taking place covered boat slips which exist along the east side of the basin. Mr. Peter James Chagaris who is one of the new co-owners of the pro- perty has submitted a CAMA permit application and proposes to redevelop the site.as an active marina to be called "Cypress Marine". Initially, the applicant proposes to maintenance excavate by the..dragline method the access channel which measures 175' long by 75' wide to a depth of. -5" NWL. The actual basin area itself measures 120' long by 40' wide and will restore the -4' water depths. The maintenance excavation will produce approximately 2,111 cu.yds. of silty mud. As the work plat drawing shows, this material will be stockpiled on the'highground property and contained by the proposed bulkhead. The onsite visit revealed that approximately 300 sq.ft. of elevated wetlands in the form of si rpus threesquare will be displaced by the proposed exca- vation and spoil. The area of vegetated wetland occurs along the outer peninsula that separates the interior basin from the creek. As proposed, a portion of the boat basin along the upper end will be filled. This area measures 40' by 40' and material will be imported from a local borrow pit. As the work plat drawing shows, four floating docks will be constructed, along the outer bulkhead that faces Lanes Branch. In combination with the covered shed in the boat basin, this will provide some 10-15 stag- ing slips?going,and coming to the drystack facility. ` for .boats 10. The applicant has•calculated that only 10% of the CAMA 75•' estua- rine shoreline AEC will be rendered as impervious surfaces. Most of this area, approximately 25,000 sq.ft.r will be covered with crushed rock or marl while the drystack storage building accounts for 5;000 sq.ft. of impervious surface area. More sensitive areas closer to the actual creek will remain as natural vegetation and permeable to runoff water. Anticipated impacts The proposed bulkhead and backfill landscaping project will displace approximately 2,190 sq.ft. of bottomland within the man-made basin and about 300 sq.ft. of three-square wetlands along Lanes Creek. The surface waters of the basin will further be reduced by 1600 sq. ft. with the proposed filling of that 40 x 40' area. The surface waters of the Trent River, Lawson Creek and Lanes Branch, are classified by DEM as SB which are suitable for swimming and boating. The proposed project design has made plans to con- trol runofff water by incorporating natural areas of vegetation and the gravel parking lot. In terms of shellfish, the proposed marina is not a threat to water quality since oysters and clams do not occur in the New Bern area. The location of the drystack storage building appears to be positioned right on the applicant's easternmost property line. It is not cer- tain if this is consistent with local zoning requirements. In addi- tion, one of the four floating docks along the outer creek may not be consistent with CAMA's,15' sideline setback. However, this struc- ture,,because it is a floating dock, can easily be relocated else- where along the property. CAMA REVIEW This project has been reviewed with regards to the 1981 LUP for the City of New Bern.* That document-clearly supports public use and access to the waterways in and around the City of New Bern. The land classification map shows the highground properties of this area to be classified as "developed" where city water and sewer ser- vices are currently being provided to this commercial business lo- cated on Pembroke. Road. The surface waters of Lanes Branch and the wetlands associated with the project development are classified by the LUP,as "conservation." No development constraints have been identified within that document that would preclude the proposed project. Pro.]'pct summary Applicant proposes. to develop a. dry storate marina with scales and 'service with gas dock, boat ramp, wet slips in highground basin. 9. Narrative descri tp ion The project site is located on Pembfoke Road (SR 1200) lust off Hwy. 70 bypass next to the entrance to the Lawson Creek Park in the City of New Bern, Craven County. This 1.8 acre tract of land which in- cludes a highground boat basin, is situated on the north shore of Lanes Branch a tributary of*Lawson Creek and the Trent River. Tradition- ally, over the past several years the property and existing,facil.i- ties have been operated as a.commercial moremarina recentknown times the property. with sales and services provided. and facilities have fallen into disrepair,. At present, the existing masonary building shown on the work plat draw- ing has been refurbished as the marina office and service repair area. The land slopes noticeably away from the elevations of.about 81 nearest the paved road to about 2-4' along the edge of the "L" shaped basin. An.old concrete boat-ramp which is in need of repair is located along the back edge of the boat-basin and flanked on the west side by a newly rebuilt fuel dock. This property is bordered on the east side by another small man-made boat basin owned by Mr. W. H. Purser. Law- son Creek Park, on the.opposite shoreline, is about 250' across Lanes Branch. It is certain that most all of the lands surrounding these man-made basins were formerly wooded swamp areas that were filled upon. p,esidr,a.l cypress trees and small patches of vegetation persists along the shoreline. The applicant was cautioned and encouraged in early June of 1986 to seek proper CAMA permits while reconstruction was taking place to the covered.boat slips which exist along the east side of the basin. Mr. Peter James Chagaris who is one of the new co-owners of the pro- perty has submitted a CAMA permit application and proposes to redevelop the site as an active marina to be called "Cypress Marine". Initially, the applicant proposes to maintenance excavate by the_dragline method the access channel which measures 175' long by 75' wide to a 4epth of -5" NWL. The actual basin area itself measures 120' long by and will restore the -4' water depths., The maintenance excavation will produce approximately 2,111 cu.yds. of silty mud. As the work plat drawing shows, this material will be.stockpiled on the highground property and contained by the proposed bulkhead. The onsite visit: revealed that approximately 300 sq.ft. of elevated wetlands in the form of scirpus threesquare will be displaced by the proposed exca- vation and spoil. The area'of vegetated wetland occurs along the outer peninsula that separates the interior basin from the creek. As proposed, a portion of the boat basin along the upper end will be filled. This area measures 40' by 40' and material will be imported from a local borrow pit. As the work plat drawing shows, four floating docks will be constructed along the outer bulkhead that faces Lanes Branch. In combination with ?t the covered shed in the boat basin, this will provide some 10-15 stag- ing slips?going,and coming to the drystack facility. for boats Y R The applicant has calculated that only 10% of the CAMA,75' estua- rine shoreline AEC will be rendered as impervious surfaces. Most of this area, approximately 25,000 sq.ft., will be covered with crushed rock or marl while the drystack storage building accounts for 5;000 sq.-ft. of impervious surface area. More sensitive areas closer to the actual creek will.remain as natural vegetation and permeable-to runoff water. 10. Anticipated impacts The proposed bulkhead and backfill landscaping project will displace approximately 2,190 sq.ft. of bottomland within the man-made basin and about 300 sq.ft. of three-square wetlands along Lanes Creek. The surface waters of the basin will further be reduced by 1600 sq. ft. with the proposed filling of that 40 x 40' area. The surface waters-of the Trent.River, Lawson Creek and Lanes Branch, are classified by DEM as SB which are suitable for swimming and boating. The proposed project design has made plans to con trol.runofff water by incorporating natural areas.of vegetation and the gravel parking lot.. In terms of shellfish,_ the proposed marina is not a threat to water quality since oysters and clams do not occur in the New. Bern area. The location of the drystack storage building appears to be positioned right on the applicant's easternmost property line. It is not cer- tain-if this is consistent with local zoning requirements. In addi- tion, one of the four floating docks along the outer creek may not be consistent with CAMA's 1.5" sideline setback. However, this struc- ture, because it is a floating dock,.can easily be relocated else- where along the property. CAMA REVIEW This project has been reviewed with regards to the 1981 LUP for the Citv of New Bern. That document-clearly supports public use and access to the waterways in and around the City of New Bern. The land classification map shows the highground properties of this area to be classified as "developed" where city water and sewer ser- vices are currently being provided to this commercial business lo- cated on Pembroke Road. The surface waters of Lanes Branch and the wetlands associated with the project development are classified by the LUP,.as "conservation." No development-constraints have been identified within that document that would preclude the proposed project.
