Reference your application for a Department of the Army permit
to reconstruct and expand dock facilities on Taylors Creek,
Beaufort, Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on I // 2y196 , is subject to compliance with the application (where consistent
with the permit), all ap?ble re lations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All development will be done in strict accordance with the attached appli-
cation and plats.
(2) The marina shall prominently post and enforce a "no sewage discharge" po-licy.
(3) No person shall be allowed to live aboard vessels in the marina.
(4) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations
for onshore sewage treatment.
(5) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized work.
(6) It is possible that the authorized structure may be damaged by wavewash
from passing vessels. The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the permitted

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Dear Mr. Parker:
Reference the application of Mr. Richard Chadwick, Jr., for a
Department of the Army permit to reconstruct and expand dock
facilities on Taylors Creek, Beaufort, Carteret County, North
Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. This permit does not authorize the interference with any
existing or proposed Federal project, and the permittee will not
be entitled to compensation for damage or injury to the authorized
structure or work which may be caused from existing or future
operations undertaken by the United States in the public interest.
b. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work.
c. If the display of lights and signals on the authorized
structure is not otherwise provided for by law, such lights and
signals as may be prescribed by the U.S. Coast Guard will be
installed and maintained by and at the expense of the permittee.

d. It is possible that the authorized structure may be
damaged by wavewash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper steps
to ensure the integrity of the permitted structure and the safety
of moored boats from damage by wavewash. The permittee will not
hold the United States liable for any such damage.
e. The permittee will maintain the authorized work in good

f. If the permittee discovers any previously unknown historic

Carteret County
The applicant proposes to place piling and construct boat slips in
Taylors Creek classified SC. The slips are sufficiently large to
handle large boats. While there are only 4 slips, there is the
capacity to moor 7 large boats, 35 footers.
The project has been reviewed to determine impacts to water quality.
The following comments are offered:
1. A 401 certification is not required for the proposed project.
2. It is expected that violations of water quality standards would
occur unless the following conditions are incorporated into the
CANA permit.
a. That a locked head policy be established and strictly
enforced.
b. That a pump-out station be installed.
C. That there be no live-aboards or transient dockage allowed.
d. That signs be posted on the dock prohibiting the overboard
discharge of sewage and addressing the operation of the
pump-out facility.
This office would have no objections to the proposed project provided
the above conditions are adhered to.

9. Narrative description
This property is located at 213 Front Street, Beaufort. The property
is split by Front Street and the development is proposed in the
area bordering Taylors Creek.
Presently the site has little or no high ground; Taylors Creek
comes to the bulkheaded shoreline which protects the Town's right
of way. A pier about 116' long extends outward from this. The
pier has a 16' square-deck approximately 3/4 of the way out and indi-
vidual boat slips flank both sides of the pier waterward of the deck
structure.
The applicant is proposing to remove about 35' of the existing pier
and replace this with a floating concrete structure about 70' long.
This strucure will be moored by pilings and will have accommoda-
tions for four vesels in the proposed slips and will generally re-
place the previously existing easternmost boat slip.

The project if conducted as proposed will involve about 3,850 sq.ft.
of public trust area which is currently.used for docking vessels.
The adjacent waters are classified as SC according to DEM and are
currently closed to shellfishing according to the Div. of Health
Services.

and replace this with a floating concrete structure about 70' long.
This strucure will be moored by. pilings and will have accommoda-
tions for four vesels in the proposed slips and will generally re
place the previously existing easternmost boat slip.
10. Anticipated impacts
The project if conducted as proposed will involve about 3,850 sq.ft.
of public trust area which is currently.used for docking vessels.
The adjacent waters are classified as SC according to DEM and are
currently closed to shellfishing according to the Div. of Health
Services.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received September 8, 1986, for a
Department of the Army permit to reconstruct and expand your
existing docking facility on Taylors Creek in Beaufort, Carteret
County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management, If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWC086-N-016-0525 and will be
coordinated by Mr. David Baker. He is available to address
