Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. This permit, issued on I // 2y196 , is subject to compliance with the application (where consistent with the permit), all ap?ble re lations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) All development will be done in strict accordance with the attached appli- cation and plats. (2) The marina shall prominently post and enforce a "no sewage discharge" po-licy. (3) No person shall be allowed to live aboard vessels in the marina. (4) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. (5) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. (6) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. b. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. c. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. -2- d. The slips are sufficiently large to handle large boats. While there are only 4 slips, there is the capacity to moor 7 large boats, 35 footers. The project has been reviewed to determine impacts to water quality. The following comments are offered: 1. A 401 certification is not required for the proposed project. 2. The property is split by Front Street and the development is proposed in the area bordering Taylors Creek. Presently the site has little or no high ground; Taylors Creek comes to the bulkheaded shoreline which protects the Town's right of way. A pier about 116' long extends outward from this. The pier has a 16' square-deck approximately 3/4 of the way out and indi- vidual boat slips flank both sides of the pier waterward of the deck structure. The applicant is proposing to remove about 35' of the existing pier and replace this with a floating concrete structure about 70' long. This strucure will be moored by pilings and will have accommoda- tions for four vesels in the proposed slips and will generally re- place the previously existing easternmost boat slip. 10.
