Reference your application for a Department of the Army permit
to construct piers and docks on Little Port Creek, the Atlantic
Harbor of Refuge, near Atlantic, Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary, as revised
plans must be reviewed and the authorization modified.

of Refuge) as requested in the permittee's application dated rec' d 3/12/86 i ncl udi nc

This permit, issued on V// 06 , is subject to compliance with the application (where consistent
with the permit), all applicaKle special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) No marsh grass will be excavated and/or filled.
(2) Removal of derelict, abandoned vessels will be accomplished without excavating
any marsh or surrounding waters.
(3) The marina shall prominently post and enforce a no sewage discharge policy
for boats without holding tanks.
(4) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with the local
regulations for onshore sewage treatment.
(5) The dock system and mooring pilings will be marked with durable reflective
material to prevent or reduce the navigational hazard potential, in accor-
dance with the Wildlife Resources Commission's Uniform State Waterway
Marking System.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(6) No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work.
(7) The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without transferring it to a third party.
NOTE: Prior to the removal or demolition of dilapidated structures, an extensive
rodent control program may be necessary in order to prevent the migration
of the rodents to adjacent areas. The demolition wastes that are
accumulated should not be delivered to a local sanitary landfill site
since this volume of inert material would greatly reduce the life
of a sanitary landfill. For information concerning rodent control,
contact the local health department or the Vector Control Branch,
919/733-6407. For information concerning landfills control, contact
the Solid and Hazardous Waste Management Branch, 919/733-2178.

The applicants propose to replace the dilapidated piers and docks within the
Atlantic Harbor of refuge and construct 22 new boat slips within the 3 acre
boat basin located on Little Port Branch, classified SC.
The project has been reviewed to determine impacts to water quality. The
following comments are provided:
1. The project will not require 401 Certification.
2. It is recommended that the applicant provide marine pumpout facilities,
enforce a locked head policy, and post signs along the docks prohibiting
the overboard discharge of sewage.

9. Narrative description
The, applicants are the administrators of the Harbor of Refuge
system.in`Carteret County. Their responsibility-is to govern
the activities within and about the basins located in Beaufort,
Harkens 'Island, Atlantic; and Cedar Island.'.
Excluding the Beaufort facility, the operation of the harbors in
Harkers Island, Atlantic and Cedar Island is left to individuals..
who find and lay claim to space on a first come, first served ba-
sis. Clients are generally involved in commercial fishing enter-
prises. The lack of ownership and oversight among these indivi-
duals in the harbors, result in "rickedy", low investment type dock
structures 'attending the vessels, and little incentive to re-
.move debris or derelict abandoned boats. In an effort to change
this situation, the applicants propose to upgrade some of the At-
lantic Harbor facilities over the next three years.
The project site is along the south and southeast sides of the ex-
isting Atlantic Harbor of Refuge basin. The SE side is presently
bordered by Hwy. 70 right-of-way and a large number of fishing
vessels use the harbor waters adjacent to this. An enclosed shed
approximately 16' wide by 32' long is on the county parcel along
with a large number of docks and piers. Some abandoned vessels
exist in a marsh gut in this vicinity and other apparently aban-

The southern.side of the basin is bordered by 60-100' wide fring
of black needlerush marsh. Two piers cross this marsh from sepa-
rate adjacent properties.. These piers terminate in "T" configura-
tions which parallel the southern basin edge..
The applicants plan to construct a pier that will parallel the
southern edge of the basin. The pier will be 630' long and 6'
wide. Slips for 22 vessels will be provided along with a landing
deck near the highway. Obstructions to this construction will be
removed prior to the pier construction.
10. Anticibated impacts
Construction of the pier will result in the upgrading of the present
facilities in this area. A'aanc?oned -vessels, debris, and existing
pier structures will be removed•where they exist in the vicinity
of the proposed pier. Several fishermen will be displaced from
their existing facilities. The new pier will dock 22 vessels as
presently designed. Adjacent waters are classified as SC by
DEM and the basin and adjacent waters are currently closed to the
taking of shellfish.

K The applicants are the administrators of the Harbor of Refuge
system in Catteret County. Their responsibility is to govern
the activities within-and about the basins located in Beaufort,
Harkers Island, Atlantic and Cedar Island.

Excluding the Beaufort facility, the operation of the harbors in
Harkers Island, Atlantic and Cedar Island is left to individuals
who find and lay claim to space on a first come, first served ba-
sis. Clients are generally involved in commercial fishing enter-
prises. The lack of ownership and-oversight among these indivi-
duals in the harbors, result in "rickedy", low investment type dock
structures attending the vessels, and little incentive tore-
move debris or derelict abandoned boats. In an effort to change
this situation, the applicants propose to upgrade some of the At-
lantic Harbor facilities over the next three years.
The project site is along.the south and southeast sides of the ex-
isting Atlantic Harbor of Refuge basin. The SE side is presently
bordered by Hwv.. 70 right-of-way and a large number of fishing
vessels use the harbor waters adjacent to this. An enclosed shed
approximately 16' wide by 32' long is on the county parcel along
with a large number of docks and piers. Some abandoned vessels
exist in a marsh gut in this vicinity and other apparently aban-
doned vessels also exist in this area.

.On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed); which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received March 26, 1986, for a
Department of the Army permit to construct piers and docks on
Little Port Creek, the Atlantic Harbor of Refuge, near Atlantic,
Carteret County, North Carolina, indicates it to be a candidate
for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be
accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit

Reference the application of the Carteret County Harbor
Authority, represented by Mr. John P. Yost, for a Department of
the Army permit to construct piers and docks on Little Port Creek,
the Atlantic Harbor of Refuge, near Atlantic, Carteret County,
North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. This permit does not authorize the interference with any
existing or proposed Federal project and the permittee will not be
entitled to compensation for damage or injury to the authorized
structure or work which may be caused from existing or future
operations undertaken by.the United States in the public interest.
b. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work. Use of the permitted activity
must not interfere with the public's right to free navigation on
all navigable waters of the United States.
c. If the display of lights and signals on the authorized
structure is not otherwise provided for by law, such lights and
signals as may be prescribed by the U.S. Coast Guard will be
installed and maintained by and at the expense of the permittee.
