(1) All excavation and construction must be undertaken in accordance with the permitted work plat drawings dated received 10-14-86. (2) The bulkhead alignments will be positioned landward of the salt marsh cord- grass and the mean high water, shoreline. The alignments will be staked off by representatives of the Corps of Engineers and/or DCM. (3) Excavation will not exceed 7 feet below the elevation of mean low water -'(4) No excavation or fill - wit-1 take place in any marsh or waterway outside of the alignment as indicated on the permitted plats. (5) All excavated materials will be confined above the mean high water line and retained behind adequate dikes to prevent spillover into the surrounding waters. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. (7) The terminal end of the pipeline will be positioned at or greater than fifty feet from any part of the dike and a,maximum distance from the spillway to allow settlement of suspended solids. (8) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. (9) The diked disposal area will be constructed a sufficient distance from the mean high water shore line to eliminate the possibility of dike erosion into the surrounding waters. (10) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction- related discharge. (11) The marina shall prominently post and enforce a no sewage discharge policy. (12) No person shall be allowed to live aboard vessels in the marina. (13) All floating structures, other than boats, wised for habitation or commerce (as defined in 15 NCAC 7M. 0602) shall be in conformance with local regulations for on-shore sewage treatment. (14) A pumpout facility to service boats in the marina will be installed and operable prior to reoccupancy of the marina. NOTE: Any change in the overall development plans will require a :re-evaluation by DCM and/or a modification of the-permit. NOTE: It is recommended that the effluent pipe from the diked disposal area be directed back into the entrance channel that is undergoing dredging. This will help to ensure that the rate of dredging does not exceed the disposal area's capacity. NOTE: This project has the potential to create moderate,.mosquito problems. Carteret County The applicant proposes to revamp an existing marina by dredging the entrance channel and highground basin, repairing an existing breakwater and installing three new bulkheads. This work will be done adjacent to Bogue Sound, classified SA. The proposed project has been reviewed to determine impacts on water quality. The following comments are provided: 1. The project will require 401 Certification. 2. It is recommended that the conditions listed below be included in this Certification. a. That earthen banks behind the bulkhead be stabilized with vegetative cover as soon as possible after construction to minimize erosion. b. That construction of the bulkhead does not restrict tidal flow or drainage of adjacent areas. C. That the fill placed behind the bulkheads be clean and free of toxic material. d. That every reasonable effort be made to perform all work in a manner that will prevent excessive increases in turbidity and settleable solids concentrations in the water body. e. Narrative description Brandywine Bay is an extensive residential community located on Bogue Sound just 3 miles west of Morehead City off Hwy. 24 in Carteret County. The overall development was started in the mid- 1970s and includes a large section of single family residences, an 18 hole golf course, townhouse style condominium units and a high- ground boat basin. The "marina" provides no sales or services and only caters to the residents within Brandywine. There are only 32 existing boat slips within the marina basin and there are no plans for expansion. Initially, excavation of the access channel and highground boat basin was authorized by State Permit No. 743 in the n/o Cameron Brown In- vestments.group, in June of 1976. After the fifth permit renewal the original permit expired in October of 1981. Today, the owners of Brandywine propose to maintenance excavate and completely refurbish the physical structures of the existing marina basin. The project plans show maintenance dredging of the access channel measuring 100' long by 60' wide. The access channel ex- tends southward towards the AIWW and dredging will restore the -7' water depths on mean low tide. Elsewhere, shallow spots within the access channel alignment will be hydraulically dredged. The spoils will be pumped to a small diked disposal area located on a finger of land just east of the channel. The shoreline around the spoil disposal area is well protected with granite rock riprap. The spoil area contains only about 13,000 sq.ft. and maintenance dredging will have to be accomplished on an incremental basis. In this metYiod the deep water spoil will have to be trucked off site in order to make room for additional hydraulic.spoil. This method will also be used in the hydraulic maintenance dredging within the highground marina basin that measures 115' wide by 240' long. In this area the original'-6' of water depth will be. restored. An onsite inspection of the access channel reveals that no submerged aquatic vegetation or shellfish resources occur within the project alignment. A limited amount of dragline excavation will also have to be accomplished along the access channel and within the marina basin. These areas are well identified on the project drawings, and are easily reached from land by a dragline apparatus. Along the western side of the marina basin the original bank has slumped over time, filling in portions of the basin. A triangular shaped fringe of marsh grass has developed. Approximately 1500 sq.ft. of salt marsh cordgrass mixed with cattail will be displaced by the proposed excavation. Spoil material taken from this area will be temporarily stock-piled on the high ground next to the basin before the material is reused as fill elsewhere on the project. As listed on Sheet 3 of 6, approximately 3,000 cu.yds. of material will be removed from the marina basin, and 5,000 cu.yds will be removed from the access channel. Additional work within the basin involves construction wooden bulkhead along the western side. The bulkhead about 360' long. On the-east side of the marina entrance, the shoreline has also eroded. A 235' long bulkhead is proposed for this area.' The bulkhead will connect to the existing structure at the mouth of the marina basin and will intersect on-the east side with the existing rock riprap near the disposal site. Protecting the west side of the access channel extending into Bogue Sound, is a wooden breakwater that measures about 845' long. It is supported by a series of four wing-walls. The applicant proposes to repair and replace sections of the breakwater as necessary. The applicant has no plans for developing the highground property around the existing marina. 10. Anticipated impacts Most of the proposed elements which are included' in the application are justifiable maintenance needs. In combination with new bulkhead construction and excavation of some 1500 sq.ft. of saltmarsh vegeta- tion the projectproposal warrants a new major permit review. i The proposed maintenance dredging of the basin and access channel should create no significant impacts on the existing water quality since tidal flushing is very complete within the structured system. The notation is made that the surface waters of Bogue Sound are classi- fied as SA and are permanently closed to shellfishing. It is also un- derstood that the applicant has no plans for increasing the number of boat slips or developing the highground property adjacent to the marina basin. The proposed hydraulic dredging of the access channel and basin will have to be accomplished in an incremental fashion. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. w' r -2- e. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. f. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. g. Flow from the diked retention area will be confined by pipe, trough, or similar- device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosio?i and resultant unnecessary siltation. h. Excavation will not exceed 7 feet below the elevation of mean low water (MLW). i. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Nrative description Brandywine Bay is an extensive residential community located on Bogue Sound just 3 miles west of Morehead City off Hwy. 24 in Carteret County. The overall development was. started in the mid 1970s and includes a large section of single family residences, an 18 hole golf course, townhouse style condominium units and a high ground boat basin. The "marina" provides no sales or services and only caters to the residents within Brandywine. There are only 32 existing boat slips within the marina basin and there are no plans for expansion. Initially, excavation of the access channel and highground boat basin was authorized by State Permit No. 743 in the n/o Cameron Brown In- vestments group, in June of 1976. After the'fifth permit renewal the original permit expired in October of 1981. Today, the owners of Brandywine propose to maintenance excavate and completely refurbish the physical structures of the existing marina basin. The project plans show maintenance dredging of the access channel measuring 100' long by 60' wide. The access channel ex- tends southward towards the AIWW and dredging will restore the -7' water depths on mean low tide. Elsewhere, shallow spots within the access channel alignment will be hydraulically dredged. The spoils will be pumped-to a small diked-disposal area located on a finger of land just east of the channel. The shoreline around the spoil disposal area is well protected with granite rock riprap. The spoil area contains only about 13,000 sq.ft. and maintenance dredging will have to be accomplished on an incremental.basis. In this method the deep water spoil will have to be trucked off site in.order to make room-for additional hydraulic spoil. This method will also be used in the hydraulic maintenance dredging within the highground marina basin that measures 115' wide by 240' long. In this area the original -6' of water depth will be restored. An onsite inspection of the access channel reveals that no submerged aquatic vegetation or shellfish resources occur within the project alignment. A limited amount of dragline excavation will also have to be accomplished along the access channel and within the marina basin. These areas are well identified on the project drawings, and are easily reached from land by a dragline apparatus. Along the western side of the marina basin the original bank has slumped over time, filling in portions of the basin. A triangular shaped fringe of marsh grass has developed. Approximately 1500 sq.ft. of salt marsh?cordgrass mixed with cattail will be displaced by the proposed excavation. Spoil material taken from this area will be temporarily stock-piled on the high ground next to the basin before the material is reused as fill elsewhere on the project. As listed on Sheet 3 of 6, approximately 3,000 cu.yds. of material will be removed from the marina basin, and 5,000 cu.yds will be removed from the access channel. t :,p , Additional work within the basin involves construction wooden bulkhead along the western side. Wave action has significantly eroded the highground bank which separates the basin from the open waters of Bogue Sound. On the east side of the marina entrance, the shoreline has also eroded. A 235' long bulkhead is proposed for this. area. The bulkhead will connect to the existing structure at the, mouth of the marina basin and will intersect on the east side with the existing rock riprap near the disposal site. Protecting the west side of the access channel extending into Bogue Sound, is a wooden breakwater that measures about 845' long. It is supported by a series of four wing-walls. The applicant proposes to repair and replace sections of the breakwater as necessary. The applicant has no plans for developing the highground property around the existing marina. 10. Anticipated impacts Most of the proposed elements-which are included, in the application are justifiable maintenance needs. In combination with new bulkhead construction and excavation of some 1,500 sq.ft. of saltmarsh vegeta- tion the project proposal warrants a new'major permit review. The proposed maintenance dredging of the basin and access channel should create no significant impacts on the existing water quality 'since tidal flushing is very complete within the structured system. The notation is made that the surface waters of Bogue Sound are classi- fied as SA and are permanently closed to shel.lfishing. It is also un- derstood that the applicant has no plans for increasing the number of boat slips or developing the highground property adjacent to the marina basin. The proposed hydraulic dredging of the access channel and basin will have to be accomplished in an incremental fashion.
