This permit, issued on is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) All excavation and construction must be undertaken in accordance with the permitted work plat drawings dated received 10/14/86 and where applicable for additional boat slips, blueline sheet 6 of 6 dated 4/30/87. (2) The bulkhead alignments will be positioned landward of the salt marsh cord- grass and the mean high water shoreline: -The alignments will be staked off by representatives of _the-Corps of Engineers and/or DCM. (3) Excavation will not exceed 7 feet below' the elevation of mean low water (MLW). (4) No excavation or fill will take place in any marsh or waterway outside of the alignment as indicated on the permitted plats. (5) All excavated materials will be confined above the mean high water line and retained behind adequate dikes to prevent spillover into the surrounding waters. See attached sheet for Additional Condition This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires . further Departmental approval. All work must cease when the permit expires on December 31. 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ADDITIONAL CONDITIONS Permit #3-87 Page 2 of 2 (6) The disposal area effluent will be confined by pipe, trough, or similar device to a point at or below the mean low water level to prevent gully erosion and siltation. (7) The terminal end of the pipeline will be positioned at or greater than fifty feet from any part of the dike and a maximum distance from the spillway to allow settlement of suspended solids. (8) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. (9) The diked disposal area will be constructed a sufficient distance from the mean high water shoreline to eliminate the possibility of dike erosion into the surrounding waters. (10) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction- related discharge. (11) The marina shall prominently post and enforce a no sewage discharge policy. {12) No person shall be allowed to live aboard vessels in the marina. (13) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. (14) A pumpout facility to service boats in the marina will be installed and operable prior to reoccupancy of the marina. NOTE: Any change in the overall development plans will require a re-evaluation by DCM and/or a modification of the permit. NOTE: It is recommended that the effluent pipe from the diked disposal area be directed back into the entrance channel that is undergoing dredging. This will help to ensure that the rate; of dredging does not exceed the the disposal area's capacity. NOTE: This project has the potential to create moderate mosquito problems. The Application provides adequate assurance that the discharge of riprap material into a wetlands area adjacent to the waters of Bogue Sound in conjunction with the proposed pipe relocation in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. OPERATIONS BRANCH Subject: Regional Office Review & Recommendat-ions Application for Permit for Excavation and/or Fill Brandywine Bay Inc.- Bogue Sound Carteret County The applicant proposes to relocate an existing 24 inch storm drainage pipeline serving the Brandywine Bay Subdivision. The project would require the backfilling of the existing route caused by erosion, and requires the placement of rip-rap 10 feet waterward of the MHW contour to regain the eroded embankment. The proposed outfall would require a 15' x 15' rip-rap splash pad to prevent future erosion. The project is located along Bogue Sound, classified SA, and currently open.to shellfishing. The project has been reviewed to determine impacts to water quality. The following comments are provided: 1. A 401 Certification will be required, and should contain the following conditions: a. Turbidity shall not exceed 25 N.T.U. as a result of the project activity. b. All-rip-rap material shall be free of toxic material and shall be of sufficient size as to prevent its movement by wave or tidal action. c. Rip-rap shall be placed no further waterward than 10 ft. from the MHW contour. 2. It is expected that the proposed project will not serve to increase the volume or amount of pollutants from runoff beyond the existing useage. The existing outfall conveys stormwater runoff which could contribute to violations of fecal coliform standards for SA waters. The project as proposed should not change the volume or characteristics of the discharge. The project would serve to reduce or remove the possibility of future erosion from the existing outfall. 3. Narrative description Mr. Leonard Bloxam has submitted a Major CAMA application on behalf of Brandywine Bay,.Inc. to authorize the relocation of one of their primary stormwater drainage pipes, and to perform other necessary work, to restore the original drainage location. The project site is located on the banks of Bogue Sound between Oak Bluff Condominiums on the west and Bogue Village on the east which is located within Brandywine Bay about 2 mi. west of'More- head City off Hwy. 24 in Carteret County. Continuous erosion and gully washing has plagued the existing storm drainage Pipeline since the heavy rains and storms which occurred in the fall of 1985. Each successive rain storm has caused another 4' section of drainage pipe to drop off which, in turn, causes the 20' high bluff to erode deeper, wider and further back into the hillside. P!Iase one of the applicant's proposal involves completely removing cne existing 24" drain pipe and backfilling the eroding bluff with eartheB material and stabilizing the shoreline with riprap. Most of the riprap will be placed waterward of the MHW shoreline and will measure about 10' wide by 75' long. The lot on which this work will take place can then be sold as part of the single family sub- division. Phase 2 of the project will involve relocating the 24" concrete pipe and storm drain about 200' to the west on an easement which will pass through the common ground properties.owneed by the condominium association. Approximately 250 lin.ft. of new storm pipe will be in- stalled to a point of discharge at the base of the 20' high bluff. Here again, the applicant proposes to use riprap to create a splash apron measuring about 15' x 15' in front of the discharge pipe. This should help-prevent stormwaters from eroding the inter-tidal sand flats immediately in front of the discharge pipe. 10. Anticipated impacts The surface waters of Bogue Sound at the project site have been classified as SA by DEM and at present these waters are open to the harvesting of shellfish. In the past few months a new developer of a 36-unit condominium complex on 4 1/2 acres have designed a storm- water system which now connects directly into the Brandywine drain- age system. This new drainage system has added additional volumes of runoff water and potential pollutants that may, once the project is completed, impact the quality of water in and around the Brandy- wine area. Narrative description Mr. Leonard Bloxam has submitted a Major CAMA application on behalf of Brandywine Bay,.Inc. to authorize the relocation of one of their primary stormwater drainage pipes, and to perform other necessary work to restore the original drainage location. The project site is located on the banks of Bogue Sound between Oak Bluff Condominiums on the west and Bogue Village on the east which is located within Brandywine Bay about 2 mi. west of'More- head City off Hwy. 24 in Carteret County. Continuous erosion and gully washing has plagued the existing storm drainage pipeline since the heavy rains and storms which occurred in the fall of 1985. Each successive rain storm has caused another 4' section of drainage pipe to drop off which, in turn, causes the 20' high bluff to erode deeper, wider and further back into the hillside. Phase one of the applicant's proposal involves completely removing cne existing 24" drain pipe and backfilling the eroding bluff with eartheh material and stabilizing the shoreline with riprap. Most of the riprap will be placed waterward of the MHW shoreline and will measure about 10' wide by 75' long. The lot on which this work will take place can then be sold as part of the single family sub- division. Phase 2 of the project will involve relocating the 24" concrete pipe ' to the west on an easement which will abnllt pass through the common ground properti.es.owne association. Approximately 250 lin.ft. of new storm pipe will be in- stalled to a point of discharge at the base of the 20' high bluff. } Here again, the applicant proposes to use riprap to create a splash apron measuring about 15' x 15' in front of the discharge pipe. This should help prevent stormwaters from eroding the inter-tidal sand flats immediately in front of the discharge pipe. 10. Anticipated impacts The surface waters of Bogue Sound at the project site have been classified as SA by DEM and at present these waters are open to the harvesting of shellfish. In the past few months a new developer of a 36-unit condominium complex on 4 1/2 acres have designed a storm- water system which now connects directly into the Brandywine drain- age system. This new drainage system has added additional volumes of runoff water and potential pollutants that may, once the project is completed, impact the quality of water in and around the Brandy- wine area. Bloxam, for a Department of the Army permit to riprap and backfill an eroded area and to construct a storm sewer outfall structure in Bogue Sound in the Oak Bluff area, near Morehead City, Carteret County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The fill and riprap materials will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. b. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge.
