Project summary The applicant wishes to perform maintenance excavation to his existing boat basin and replace his existing jetty, bulkhead and dock with new materials. His seafood business is located along the New River in Sneads Ferry. John W. Bowman Page 2 9. PROJECT DESCRIPTION: The project site is located at the end of a 1,000' long dirt road along New River in Sneads Ferry at Poverty Point. Signs along S.R. 1541 point to "Bowman's Seafood" fishhouse along New River. The one acre tract has an existing seafood wholesale/retail business along the waters edge; coolers and storage buildings; an existing wooden bulkhead with "U" shaped docks and an old tire jetty along the north side of the existing 170' by 100' boat basin. The wooden docks, bulkhead and soldier pilings holding the tire jetty are all in disrepair. The MHW contour runs around the edge of the existing boat basin. Accumulated shell materials and debris has raised the area around the old 180' long tire jetty to be just above MHW. 'Spring high tides inundate the site and recent high tides have caused additional failures of an 86' long section of bulkhead. The 42" wide docks are all in bad shape. The 170' by 100' boat basin has silted in to a -2' to -3' depth. The intertidal bottom is predominately mud and the site is classified as SA waters. The site is classified as a secondary nursery area but areas adjacent to it have nursery area characteristics. The applicant proposes to perform maintenance dredging of the entire 17,000 s.f. basin by dragline and throw the ±1,700 cubic yards of spoil on the existing dirt (85' by 85') parking lot. A 1'-2' temporary earthen dike will hold the material until it dewaters on site. Approximately 40 cubic yards of the coarser material will be placed behind the new 86' long bulkhead. A new 180' long timber jetty will replace the deterioated tire jetty near the entrance channel. It will consist of cresote piles with seawood sheating. Other boards of the existing dock will be rebuilt as needed. 10. ANTICIPATED IMPACTS: The project as described will cause the maintenance excavation of approximately 17,000 s.f. of disturbed mud bottom. Typical turbidity impacts are expected with dragline work of the bottom. Since a 100' throw is involved double-handling of materials will be a temptation of the contractor. Timing of such excavation work is an important factor to minimize turbidity impacts. The new bulkhead will cause the filling of 258 s.f. of intertidal area. The jetty will also disturb 180 s.f. of bottom. Neither of these two activities will significantly impact the resources. This may be the appropriate time to remove the old tire jetty. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. C. Division of Coastal Management. (2) The bulkhead alignment will approximate the mean high water level and will not be positioned farther than 3 feet waterward from the mean high water (MW) elevation contour or the deteriorated bulkhead at any point along its alignment. (3) All fill material to be placed below mean high water level will be confined behind the permitted bulkhead. (4) No marsh grass will be excavated and/or filled. (5) All excavated materials, except that placed landward of the authorized bulk- head, will be confined landward of the mean high water elevation and any regu- larly or irregularly flooded marshlands. (6) Excavation will not exceed 5 feet below the elevation of mean low water (MLW). (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval.
