This permit, issued on , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead will be positioned in strict accordance with the permit plans. To prevent an unintentional violation of this authorization, representatives of the N. C. Division of Coastal Management and the Corps of Engineers are available to stake the alignment prior to construction. (2) All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. (3) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (4) Coastal wetlands will not be filled. (5) The backfill material will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (6) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction' or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTUs attached onal Condition This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit. expires on December 31, 1990 - In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Therefore, if your office has not acted on the request by February 9, 1987, the District Engineer will deem that waiver has occurred. The Duck area has been over the past several years the largest rapidly changing community in Dare County. There were 252 building permits issued in the Duck area from January 1, 1984 through January 31, 1985; included in this number were several multi-family complex developments. The recent application to establish a recreation facility in the neighborhood of this great potential population makes good sense in my opinion. Our planning needs to be flexible. The Dare County Planning Board would, I believe, greatly be dis- tressed to know tha the Land Use Plan is used on any occasion as the sole reason for denial of permit request by your office. Project summary The applicant proposes to construrt a hi,lkhpad alonTthe - Currituck Sound shoreline at Duck, N.C. J. P. PAUL BOLANOWSKI BIO REPORT PAGE 2 SITE DESCRIPTION: The applicant owns a lot on the Currituck Sound at Duck, N.C. This lot supports a wood frame commercial building known as the "Lion's Paw" which is serviced by a septic tank and drain field. The highground slopes towards the sound until it reaches a drop to a twenty foot wide section of "404" wetlands vegetated by myrtles. Westward of this area is a narrow fringe of Juncus and Spartina marsh. The "404 no permit to fill" alignment was staked by the Corps of Engineers on 13 May 1986 and reconfirmed 5 September 1986. This request is to authorize the construction of a bulkhead which will extend 10 feet waterward of the "404 no permit to fill" alignment. The bulkhead will tie into a bulkhead on the south side of the property approximately 10 feet landward of that bulkhead's waterward extent and will extend 139 feet to north and the un- bulkheaded adjacent property which supports a lush Spartina cynosuroides marsh. The proposed bulkhead alignment will extend 10 feet waterward of the 404 no permit to fill alignment" but will remain 10 feet landward of the open waters of Currituck Sound. Though this area exhibits "404 vegetation", the soils of the proposed fill area are sandy and support no coastal wetlands as defined by CAMA. ANTICIPATED IMPACTS: The proposed bulkhead alignment will result in the filling of 834 square feet of transitional "404 wetlands". CAMA RFVTFW_ The proposal may be inconsistent with the Dare County LUP, however, a letter received from the Dare County Planning Department for a similar proposal in this area indicates that was not their intent.
