authorizing development in Chowan County at the Albemarle Sound adjacent to
Country Club Road as requested in the permittee's application dated 1124/85 and 1/14/85
including attached plat schedule in condition number 1.
This permit, issued on `- t, is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The project will be constructed in accordance with the following schedule
of plats: "Plan view" dated recd 1/16/86, "plot and location"§ection looking
north" and "section and detail" dated rec'd 11/19/85, "channel" dated rec'd
1/16/86 and "disposal site"dated 9/18/85.
(2) The bulkhead will not be positioned farther than 3 feet waterward from the
existing bulkhead or the normal water level (NWL) elevation contour at any
point along its alignment.
(3) In order to protect juvenile finfish populations, no excavation or filling
will be permitted between February 1 through May 31 of any year without
the prior approval of the Division of Coastal Management.
(4) Excavation in both the channel and basin will not exceed 4 feet below the
elevation of normal water level.
(5) The access channel will not exceed a bottom width of 30 feet and a top
width of 50 feet.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(6) The length of the breakwaters perpendicular to the shoreline will not exceed
the length of the existing rock jetty (approximately 140 feet measured from
the landward most point of the existing bulkhead) on the western side of
the site. The width of the basin, including the breakwaters, will be no
longer than 100 feet.
(7) The proposed jetties will be constructed as shown on the attached plat labeled
-plan view."
(8) All excavated material will be directly placed and confined landward of
the normal water level (NWL) elevation contour and any marsh vegetation.
(9) No excavated or fill material will be placed, even temporarily, in any waters
or wetlands of the State. Fill material will not be placed in waters to
provide access for the dragline and there will be no double-handling of
excavated material.
(10) All fill material placed below the elevation of normal water will be confined
landward of the permitted bulkhead.
(11) In order to improve water quality circulation in the basin area, a 48" wide
section of the breakwater must be perforated with 3" holes every 32" on
center from 6" above the outside basin river bottom to mean high water.
A perforated 48" section will be inserted in the breakwaters a distance
of every 40', but not located at the landward or waterward ends (corners)
of the breakwaters".
(12) The activity will be conducted in such a manner as to prevent significant
increases in, turbidity outside the area of construction or construction-related
aischarge.
NOTE: In keeping with the provision of GS 146-6(c) the State Property Office
of the Department of Administration has granted authorization to fill
State-owned submerged lands as described in this permit.
NOTE: The proposed project is certified under General Water Quality Certification
No. 1272 issued on November 10, 1978, for bulkhead constuction.

Dear Mr. Black:
Reference your application for a Department of the Army permit
to excavate an access channel and basin and to excavate an access
channel and construct jetties on Albemarle Sound near Edenton,
Chowan County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWCO80-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

2 jetties at the entrance to the boat basin at property located on the

in Chowan County.

NARRATIVE-DESCRIPTION
The applicant's property consists of an approximately one and a
half acre tract of land which is located on SR 1129, Box 333-B, Country
Club Drive, adjacent to the Albemarle Sound, SE of Edenton in Chowan
County. The property is a private residential lot with one single
family residence located on it.
The applicant received a state permit #50-85 which authorized the
construction of a boat basin with steel sheet piling as a breakwater
around the basin. Currently, the applicant is undertaking construction
of the breakwater.
The applicant has indicated that shoaling has occurred to an
approximate distance of 960' which prevents entrance to his proposed
basin. The applicant is proposing to excavate an access channel from
the mouth of the boat basin out approximately 960' long and 50' wide
to a water depth of minus 4'. This would result in the excavation of
approximately 30,000 sq. ft. of sound bottom below N14L of the Albemarle
Sound.
The applicant proposes to perform the above by using a crane on
a barge to install the proposed jetties and to excavate the proposed
access channel. The excavated materials will be located onto a barge
which will have a retaining fence around all sides, then taken into an
unloading site and loaded onto dump trucks, which will then take the
materials to the approved spoil disposal site at Tee-Lok Corporation.
The applicant also proposes to place 2 jetties 50' long at the
mouth of the boat basin. The proposed jetties are to be constructed
of steel sheet piling in the same manner as the basin breakwater is
to be constructed.
ANTICIPATED IMPACTS
The proposed access channel will result in the excavation of
approximately 30,000 sq. ft. of sound bottom below NWL of the Albemarle
Sound, resulting in 1000 cubic yards of bottom material being removed.
The proposed steel sheet pile jetties will result in the filling of
approximately 200 sq. ft. of sound bottom, which will result in 29
cubic yards of fill. During excavation of the access channel, there
will be increased levels of turbidity in the local area.

On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received January 27, 1986, for a
Department of the Army permit to excavate an access channel and
construct jetties on Albemarle Sound, near Edenton, Chowan County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are.no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully

Reference the application of Mr. William H. Black for a
Department of the Army permit to excavate an access channel and
construct jetties on Albemarle Sound, near Edenton, Chowan County,
North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. All excavated materials will be confined landward of the
normal water level (NWL) elevation contour and any irregularly
flooded marshlands.
b. No excavated or fill materials will be placed at any time
in any marshes or waters of the State.
c. Excavation will not exceed 4 feet below the elevation of
normal water.
d. The temporary placement or double handling of excavated or
fill materials within waters or wetlands is not authorized.

authorizing development in Chowan County at the Albemarle Sound adjacent to
Country Club Road as requested in the permittee's application dated 1/24/85 including
attached plats. 4. "orooosed boat dock". "plat and location" and "section looking north"
dated received 10/10/85 and "section and detail" dated l/Z5/85.
This permit, issued on , is subject to compliance with the application (where consistent
with the permit), all applicabl regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a tine, ttnprisotunent or civil action; or may cause the permit to be null and void.
(1) The bulkhead will not be positioned farther than 3 feet waterward from
the existing bulkhead or the normal water level (NWL) elevation contour
at any point along its alignment.
(2) In order to protect juvenile fin fish populations, no excavation or filling
will be permitted between February 1 through May 31 of any year -without,
the prior approval of the Division of Coastal Management.
(3) Excavation in both the channel and basin will not exceed 4 feet below
.the elevation of normal water. level.
(4)- .The length of the breakwaters perpendicular to the shoreline will not
exceed the length of the existing rock jetty (approximately 140 feet measured
from the landward most point of the existing bulkhead) on the western
side of the site. The width of the basin, including the breakwaters,
-.will be no longer than 100 feet. The two (2) fifty feet jetties are hereby
deleted,
(5) All excavated material will be directly placed and confined landward of
the normal water level OWL) elevation contour and any marsh vegetation..

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as?the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the, permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(6) No excavated or fill material will be placed, even temporarily, in any
waters or wetlands of the State, Fill material will not be placed in waters
to provide access for the dragline and there will be no double-handling
of excavated material.
(7) All fill material placed below the elevation of normal water will be confined
landward of the permitted bulkhead.
(8) In order to improve water quality circul.ation in the basin area, a 48"
rectangular opening must be left every 40' in the breakwater's steel sheet
piles. These openings will extend from the bottom of the basin to the
MHW and not be located at the landward or waterward ends (corners) of the
breakwaters.
(9) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the.area of construction or construction-related
discharge,
NOTE: In keeping with the provisions of GS 146-6(c) the State Property Office
of the Department of Administration has granted authorization to fill
State-owned submerged lands as described in this permit.
NOTE: The proposed project is certified under General Water Quality Certification
No. 1272 issued on November 10, 1978, for bulkhead construction.
