Bell - Salty Shores Carteret County The applicant proposes to mechanically maintenance excavate an existing manmade canal measuring 1,260 feet in length, 65 feet wide, to a depth of -4 feet MLW. The project activity will generate approximately 9,100 cubic yards of spoil material to be placed on adjacent highground owned by Mr. Bell. A 930 foot bulkhead is also proposed at the MHW contour along a portion of the canal. The project is located adjacent to Bogue Sound, Classified SA. The project has been reviewed to determine impacts to water quality. The following comments are provided: 1. The project will require 401 certification, but should meet the conditions of a general 401 certification for bulkhead construction. 2. The project as proposed should reduce the amount of surface runoff entering the canal, and improve the flushing characteristics over the present system. 3. Project sununary -section of a man-made canal measuring 1,260' long by 65' wide to a depth of SR 1249.man-made canal off -' a ' MLT-- - s 9. Narrative description Over the past several years Mr. Bobby Bell has become the owner and developer of a waterfront subdivision known as Salty Shores commu- nity. The dominant physical feature of the subdivision (25 acre) is a 1500' long manmade canal that extends from Bogue Sound into the highground property. The project site is located some 9 miles west of Morehead City off Hwy. 24 just past the Broad Creek bridge near the end of SR 1249. In late 1984 the 65' wide manmade canal was reopened-to the tidal waters of Bogue Sound under the CAMA Permit authoritv (No. 84-157) which was issued in August of 1984. Prior to that time, the upper 1260' section of the canal above the earthen plug had remained closed under the order of the Corps of Engineers for approximately 8 years. Today the applicant proposes to maintenance dredge by the dragline method the upper 1260' section of the manmade canal to a water depth of -4' relative to MLW. This will generate approximately 9,100 cu. yds. of high quality sandy material. The plans show that the spoil will be directly stockpiled along the northern side of the canal, and along the southern leg trucked to the appropriate spoil sited In addition to the dredging, the applicant proposes to.bulkhead about 9.30 lin.ft. of canal shoreline which is directly under his obliga- tion. The southern side of the canal will also be bulkheaded by those individual property owners as shown on the work plat drawing. The onsite visit revealed that no coastal wetlands vegetation is in- volved and no submerged aquatic.vegetation occurs within the dimen- sions of the project channel. The onsite inspection also revealed that Mr. Bell has successfully completed riprapping the entire shoreline on the eastern side of the southern leg of the property adjoining the Radford property. This was a permit condition relative to No. 157-84 that had to be accom- plished in terms of legal requirements. As the project drawings show, on mean low tide there is little to no water within certain sections of the canal, typically 6-12" of water exists along a 20' wide center- line coridor of the canal. The shoaling problem has been compounded in recent times and (before the canal was opened) by a serious ero- sion problem of an existing drainage ditch which is positioned about half way along the north side of the canal. This washout of the ditch measures about 100' long by 50' wide and is perched above the MLW•level some 2-3'. The applicant proposes to do as much of the necessary maintenance excavation by the dragline method and during a low tide situation that will reduce the amount of turbidity. 10. Anticipated impacts 'The historical file on this Salty Shores project indicates that wa- ter quality within the manmade canal has not been a problem over the years, even before the earthen dike was removed. The original decision to close the canal was one'of a permit violation and lack of state and federal authority. The onsite inspection that was made of the project area revealed none of the ten individual septic systems on the various lots along the canal have failed, and no algea or other, signs of eutrophication are present within the canal. The applicant and all of the individual owners plan to bulkhead the canal shoreline and thus eliminate future erosion problems that would otherwise create shoaling within the canal. In addition, the project design includes side slopes away from the bulkhead rather than box- cutting the canal bottom. This should enhance the overall flushing capability of the canal. It is also noted that the projected -4' water depth will not exceed existing water depths connecting to Bogue Sound The maintenance excavation project should not significantly impact any biological functions within the canal or the near area of Bogue Sound, particularly since such a relatively short time period has elapsed since the canal was reopened that no resident populations of shell- fish or finfish have been established. CAMA Review The project has been reviewed with reference to the Carteret LUP and a determination has been made that it is consistent with the goals and objectives-of that document which characterizes the high ground property as "community" and the waterway as "conservation." Narrative description Over the past several years Mr. Bobby Bell has become the owner and developer of a waterfront subdivision known as Salty Shores.commu- nity. The dominant physical feature of the subdivision (25 acre) is a 1500' long manmade canal that extends from Bogue Sound into the highground property. The project site is located some 9 miles west of.Morehead City off Hwy. 24 just past the Broad Creek bridge near the end of SR 1249. In late 1984 the 65' wide manmade canal was reopened-to the tidal waters of Bogue Sound under the LAMA Permit authority (No..84-157) which was issued in August of 1984. Prior to•that time, the upper 1260' section of the canal above the earthen plug had remained closed under the order of the Corps of Engineers for approximately 8 years. Today the applicant proposes to maintenance dredge by the dragline method the'upper 1260' section of the manmade canal to a water depth of -4' relative to MLW. This will generate approximately 9,100 cu. yds. of high quality sandy material. The plans show that the spoil will be directly*stockpiled along the northern side of the canal, and along the. southern leg trucked to the appropriate spoil site, In addition to the dredging, the applicant proposes to.bulkhead about 930 lin.ft. of canal shoreline which is directly under his obliga tion. The southern side of the canal will also.be bulkheaded by those individual property owners as shown on the work plat drawing. The onsite visit revealed that no coastal wetlands vegetation is in- volved and no submerged aquatic vegetation occurs within the dimen- sions of the project channel. The onsite inspection also revealed that Mr. Bell.has successfully completed riprapping the entire shoreline on the eastern side of the southern leg of the property adjoining the Radford property. This was a permit condition relative to No. 157-84 that had to be accom- plished in terms of legal requirements. As the project drawings show, on mean low tide there is little to no water within certain sections of the canal, typically 6-12" of water exists along a 20' wide center- line coridor'of the canal. The shoaiing.prob'lem has been compounded in recent times and (before the canal was opened) by a serious ero- sion problem of an existing drainage ditch which is positioned about half way along the north side of the canal. This washout of the ditch measures about 100' long by 50' wide and is perched above the MLW,level some 2-31. The applicant proposes to do as much of the necessary maintenance excavation by the dragline method and during a low tide situation that will reduce the amount of turbidity. 10. Anticipated impacts 'The historical file on Iter'quality within the ;the years, even before this Salty Shores project indicates that wa- manmade.canal has not been a problem over the earthen dike was removed. The original decision to close the canal was one of a permit violation and•lack of state and federal authority. The onsite inspection that was made of .the project area revealed none of the ten individual septic systems on the various lots along the canal have failed, and no algea or other signs of eutroph.ication are present within the canal. The applicant and all of the individual owners plan to bulkhead the canal shoreline and thus eliminate future erosion problems that would otherwise create shoaling within the, canal. In addition, the project design includes side slopes away from the bulkhead rather than box- w cutting.the canal bottom. This should enhance the overall flushing capability of the canal. It is also noted that the projected -4' water depth will not exceed existing water depths connecting to-Bogue Sound' The maintenance excavation project should not significantly impact any biological functions within the canal or the near area of Bogue Sound, particularly.since such a relatively short time period has elapsed since the canal was reopened that no resident populations of shell- fish or finfish have been established. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. c. Vegetated wetlands will not be excavated or filled. d. Excavation will not exceed 4 feet below the elevation of mean low water (MLW). e.
