Reference your application for a Department of the Army permit
to construct and backfill a bulkhead on Albemarle and Currituck
Sounds, Point Harbor, Currituck County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

as requested in the permittee's application dated 4/14/86 including
attached plats, 3, location, plan view and cross section dated received 4/15/86.
This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The bulkhead will not extend waterward more than 12 feet from the normal
water level at any point along its alignment and will average 3 feet waterward
of the NWL at the time of construction. To prevent an unintentional violation
of this authorization, representatives of the N. C. Division of Coastal Manage-
ment and the Corps of Engineers are available to stake the alignment prior
to construction.
(2) All backfill material will be obtained from a high ground source and confined
behind the permitted bulkhead.
(3) The fill material. will be clean and free of any pollutants, except in trace
quantities. Metal products, organic materials, or unsightly debris will
not be used.
(4). The backfill material will be properly graded and provided a ground cover
sufficient to restrain erosion within thirty (30) days of project completion.
(See attached sheet for Additional Conditions
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(5) The activity will be conducted in such a manner as to prevent a significant
increase in turbidity outside the area of construction or construction-related
discharge.
NOTE: The permittee and/or his contractor is urged to meet with representatives
of the Division of Coastal Management and/or the Army Corps of Engineers
prior to project initiation.
NOTE: The proposed project is certified under General Water Quality Certification
No. 1272 issued on November 10, 1978, for bulkhead construction.
NOTE: In keeping with the provisions of GS 146-6(c) the State Property Office
of the Department of Administration has granted authorization to fill
State-owned submerged lands as described in this permit.

PROJECT DESCRIPTION
The applicant has just purchased the point at Point Harbor which separates
Currituck and Albemarle Sounds. The property supports a single family residence
which is serviced by a septic tank. The shoreline is bulkheaded on all sides but
the old bulkhead is in need of repair. A portion of the bulkhead on the northeast
corner of the lot has been authorized for repair under provisions provided in 07K.
0209 because of damage from severe northeasters this winter. However, 200 feet of
the bulkhead on the Currituck Sound side (north) has been in need of repair for some
time. This work would be eligible for a general permit except that a 20 foot long
section has washed out resulting in 10 feet of water behind the bulkhead in this
one place. About 50 square feet of Spartina patens and one small clump (1 foot square)
of Juncus has established itself in this area. The soils at this site are not organic
and are sandy as is most of the highground.
The applicant is requesting to place the new bulkhead two feet waterward of the
existing bulkhead which will result in the bulkhead extending 12 feet below the NWL
along the small 20 foot section of shoreline where the bulkhead has been breached.
This will result in an average alignment along the 200 feet to be 3 feet beyond the
NWL.
ANTICIPATED IMPACTS
The construction of the bulkhead will result in the filling of 400 square feet
of shallow water habitat and 50 square feet of Spartina patens. Some short term
elevated turbidity levels can be expected but should be localized.
CAMA REVIEW
The project site is classified as rural in the Currituck LUP. This proposal is
consistent with that plan.

Reference the application of Mr. Richard F. Barry III, for a
Department of the Army permit to construct and backfill a bulkhead
on Albemarle and Currituck Sounds, Point Harbor, Currituck County,
North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The bulkhead will be positioned no farther than an average
of 3 feet waterward of the normal water level (NWL) elevation
contour. The bulkhead will be constructed in strict accordance
with permit plans. To prevent an unintentional violation of this
authorization, representatives of the N.C. Divison of Coastal
Management and the Corps of Engineers are available to stake the
alignment prior to construction.
b. All backfill materials will be obtained from an upland
source and confined landward of the permitted bulkhead.
c. The fill material will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials, or
unsightly debris will not be used.

d. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.

Enclosed is the application of Mr. Richard F. Barry III, for a
Department of the Army permit and a State Water Quality
Certification to construct and backfill a bulkhead on Albemarle
and Currituck Sounds, Point Harbor, Currituck County, North
Carolina. Your receipt of this letter verifies your acceptance of
a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by June 23, 1986, the District Engineer
will deem that waiver has occurred.

Dear Sirs:
Albetuck Point is one of the prettiest spots in
North Carolina - but it is in danger of washing away.
Last fall, backwash from Hurricane Gloria and Hurricane
Juan inflicted serious damage to portions of the
bulkheads surrounding the property. Successive
northeasters during this past winter further weakened
these bulkheads and caused leaks to appear in several
spots. Last month, I closed on the purchase of this
site. My wife and I sank our life savings into this
property and are going deeply into debt to fix it up. We
plan to use it as a vacation home for our family and
ultimately for retirement.
DESCRIPTION OF AREA
"Albetuck Point" is the southern extremity of the
Currituck County peninsula. It appears on the enclosed
U.S.C.G chart as, and is also known as, "Powells Point".
A detailed physical survey is also enclosed, along with
an aerial photograph. Located south of the Wright
Memorial Bridge, this narrow point is at the confluence
of Currituck Sound and Albemarle Sound. The point is
completely surrounded by wooden bulkheads. The Albemarle

Sound shoreline, extending westerly and northerly from
Albetuck Point, is virtually all bulkhead for over a
mile, except for a few stretches of beach secured by
jetties. In some areas, including the property
immediately adjacent, granite rip-rap has been placed in
front of the shoreline to prevent erosion.
Running east and to the north, around the harbor of
Point Harbor, and beyond to Harbinger, the shoreline, for
over two miles, consists of bulkhead, rip-rap, or beach
(usually with jetties). There are no natural m_arsh1a

bulkhead replacement project is entirely consistent with
other development in the vicinity.
DESCRIPTTQN OF PROPOSEp_n1OBE
I propose to construct a new wooden bulkhead
alongside and within two feet of the existing bulkhead
along the approximately 200 feet shown between points E
and F on the attached Work Plat.
This portion of the bulkhead lies on the northern
side of the point. The existing bulkhead was constructed
fifteen years ago. The previous owner said a floating
log punched a hole in the bulkhead in a recent storm.
This hole has caused a slight washout, up to 10 feet
behind the bulkhead, over a sandy area along a 30-foot
stretch. With every northeaster this washed out area is
enlarged and presents a serious erosion problem. A new
bulkhead will be constructed alongside the existing
bulkhead and the washed out area filled with white sand.
F UTURE KANGEMENT
After the bulkhead has been renewed, I will plant
and cultivate beach grass similar to that now on the
point. I will clean up the property and restore it as
nearly as possible to its natural state, with a sandy
terrain growing beach grass on the northern perimeter and
Bermuda grass on the southern perimeter. I will plant
and cultivate mulberry, yaupon and pine, all indigenous
to the region. We plan to maintain a wildlife habitat,
encouraging ducks, osprey, and other birds to feed and
nest on the property. I will not allow hunting or
trapping. Under my management and care, this will be a
vast improvement to the environmental quality of the
property.

application your prompt attention. This point of land is
dangerously exposed and I must replace 200 feet of the
existing bulkhead to protect it.

Dear Sirs:
Richard F. Barry, III has delivered to me and we have
discussed in detail his recent application to replace portions of
the bulkhead on his property at Point Harbor. I am the adjacent
riparian owner and wish to advise as follows:
-- I have no objection to the proposed bulkhead replacement,
as described in Mr. Barry's application.
-- I waive any and all objections to issuance of Federal and
State permits for the bulkhead replacement requested by
Mr. Barry.'
-- I strongly urge that you promptly grant Mr. Barry his
permits, without delay, so that he can proceed with the
work necessary to protect his property from erosion.
-- The bulkhead replacement requested by Mr. Barry is
entirely consistent and compatible with the nearby
shoreline; in fact, most of the shoreline in the vicinity
is similarly bulkheaded.

Dear Mr. Barry:
On February 6, 1986, we renewed general permit No. SAWCO80-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 18, 1986, for a
Department of the Army permit to construct and backfill a bulkhead
on Albemarle and Currituck Sounds, Point Harbor, Currituck County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWC086-N-027-0249 and will be coordinated by
