This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The project must be carried out in strict compliance with the stormwater
management plan approved by the Division of Environmental Management and
entitled "CAMA-Application Stormwater Plan" dated revised 8/18/86. All aspects
of the Plan must be mai ntai reed for the life of the authorized project unless
otherwise amended through modification of this permit.
(2) All retention basins shall be maintained and be grassed in order to keep
them as effective as possible.
The 2'- 3' berm around the perimeter of the tract next to the saltmarsh shall
Abe kept in place and be adequately stabilized to prevent sedimentation into
the adjacent marsh.
(4) Lot #14 must be combined with Lot #13 in order to have enough depth to meet
the minimum 60' setback.
(5) All first floor elevations shall be at or above the 14' BFE as specified
in the FIRM.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the.Project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval. -
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) The gazebo out over the basin shall not have heated space but must be open
or have no more than lattice work or insect screening.
(7) The 5' wide walkway out to Bald Head Creek shall be elevated over the marsh
to prevent shading impacts.
NOTE: The permittee and/or his contractor is urged to meet with representatives
from the local field office of DCM to discuss the permit conditions. Tele-
phone (919) 256-4161.
NOTE: An Erosion and Sedimentation control plan will be required for this project.
This plan must be filed at least thirty (30) days prior to beginning any
disturbing activity. Submit this plan to the Department of Natural Resources
and Community Development, Land Quality Section, 7225 Wrightsville Avenue,
Wilmington, NC 28403.
NOTE: Plans for the proposed inn and restaurant must be submitted to the local
health department for approval prior to construction. If the inn and/or
restaurant are part of a chain, plans should also be submitted to the Sani-
tation Branch, Division of Health Services.
NOTE: Plans and specifications for the water system to serve this project must
be approved by the Public Water Supply Branch, Division of Health Services,
prior to construction. ,
HOT&: Development on lot's 1-14 is not proposed by this application. Subsequent
construction on the lots will be subject to either minor development permits
or a modification of this permit.

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
1. The stormwater management plan designed by Joey S.
Hill, Jr. and Associates dated August 18, 1986 has
been reviewed. The plan, if implemented, is
expected to result in water quality impacts to
adjacent surface water that are not signficantly
different than natural conditions.
2. The proposed project will not require a 401 water
quality certification.

In reviewing the Stormwater Management Plant submitted by Joey Hill, Jr. & Associates
there were major discrepancies in.their conclusions and the supporting data provided.
The discrepancies indicated that the Stormwater Plan.was not adequate. David Cotton
talked with Mike Marsh, who is designing the system,.on July 30, 1986. Mr. Marsh
will be going back to the plan to adjust and redesign the stormwater plan as necessary.

Brunswick County
The applicant has submitted plans for construction of Phase II, including an Inn,
a restaurant, retail shops and offices, 3 multi-family buildings, 26 single family
houses, and 14 lots. The construction will surround the existing marina basin,
classified SA and closed. The project.is adjacent Bald Head Creek classified SA
and open to shellfishing. The effective impervious cover for the project will be
27% of the total site. The project does not require.a 401 certification. The
final stormwater retention plans submitted by Joey S. Hill, Jr. and Associates,
dated August 18, 1986, have been reviewed. It has been shown that the stormwater
retention will adequately contain a 10 year storm.event, both the one hour intensity
and the 24 hour duration,without. discharging to SA waters. It has also been
determined that all of the basins will dewater within 24 hours of a 10 year storm,
assuming dry conditions following the.storm.
The boat basin is presently classified SA; if it is reclassified to.SB, the
developer may opt to pipe the stormwater to the boat basin, eliminate the retention
basins and increase development density.
This office has no objections provided the stormwater plan dated August 18, 1986 is
implemented.

9(a) SITE DESCRIPTION:
The project site is located around the existing marina basin on Bald Head Island.
It exists between the basin and Bald Head Creek to the North and East and the
Cape Fear River to the West. The southern part of the marina basin presently
contains an administration building, barge ramp and wharf and a mixture of small
docks. The Ferry unloading platform also is located along the Southwestern edge
of the basin.
Most of the project site consists of Newhan fine sand and dredge spoil. The
underlaying horizons are fine-medium sand, grey with loose shell material. The
elevation of the site averages 8' above MSL. The top of the existing bulkhead
is about 5.5' above MSL and some of the higher spoil piles reach up to 14'
above MSL. Most of the tract's vegetation.is comprised of saltmarsh hay and
Sea Oats. The site is bordered by extensive saltmarsh vegetation consisting of
predominantely cordgrass (Spartina alterniflora); saltgrass (Distichlis spi.cata),
and patches of woody glass wort (Salicornia. spp.). Also Iva and Sea Ox-eye is
scattered extensively along the toe of the old spoil banks.
Water depths in the basin average about -6' (MLW) in depth. Tidal amplitudes
appear to be about 4.5' in the far corners of the basin. The boat basin and
this adjacent section of Bald Head Creek:.is classified as a secondary nursery
area. The waters are classified as S.A. and are closed to shellfishing. .
9(b) PROJECT DESCRIPTION:
The applicants proposed to start the second phase of buildings around the marina
basin which includes 29 single family houses; 14 lots; 3 multi-family buildings
retail shops and offices; a restaurant; an inn; and a marina clubhouse. The
proposed construction will consist of two to three story buildings.with wood
frame construction. The finish floor elevations will be at or above the BFE of
14' (MSL). There will be extensive use of wooden decking and walkways between
buildings. A grassed 2'-3' berm is proposed around the perimeter of the tract
bordering the saltmarshes of Bald Head Creek. Only electric carts will be
allowed around the buildings and an asphalt drive is proposed as the means of
access.
10. ANTICIPATED IMPACTS:
Most of the buildings and other improvements fall within 75' of the mean high
water line around the boat basin. Therefore, it becomes important to minimize
stormwater impacts. A series of five large retention ponds are proposed as well
as a long dutch drain type dry well running parallel with the bulkhead under-
neath the boardwalk. Most of the runoff water from a 10-year storm should
percolate into the sandy soils. Since most of the site is relatively high the
depth to groundwater doesn't appear to be a big problem. The grand totals for

In regards to the Inlet Hazard Area all of the large buildings and 13 lots will
fall outside of this zone. Lot #14 will not be buildable since it does not meet
