Re: Modification to Permit and Water Quality Certification
for Ashton Properties (SAWCO 86-N-092-0187)
Dear Bill:
As we discussed by phone, I am enclosing a plan of the
proposed additional segment of drainage pipe at the above-
referenced project. Ashton could not install this segment at
the time of the initial application because at that time they
had not obtained an easement to do so. That problem now has
been solved.
Closing the gap between the two pipes should be a net
environmental gain by avoiding erosion and resulting sedimentation
from the existing open area between the pipes. I am requesting
on behalf of Ashton that the water quality certification be
modified to cover this work. If you have any questions, do not
hesitate to contact me.

Reference your Department of the Army permit, No. SAWC086-N-
092-0187, issued on May 5, 1986, authorizing the placement of fill
material in waters and wetlands of an unnamed tributary to Marsh
Creek in Raleigh, Wake County, North Carolina.
By letter of June 25, 1986, we notified you that your
Department of the Army permit was suspended as a result of the
revocation of your Water Quality Certification (No. 1894) by the
North Carolina Division of Environmental Management, NCDEM.
Through recent coordination with Mr. William Mills, NCDEM, we have
been informed that your Certification has been reinstated.
Accordingly, your Department of the Army permit is hereby
reinstated.

As a follow-up to my memorandum of June 4, and numerous discussions, this
is to report to you that our collective regulatory program to restrict
instream turbidities works great--except when it rains. The. brief shower
of the afternoon of July 10 immediately drove turbidities in the stream
and lake on which I reside (along with approximately 25 neighbors) to an
estimated +1500 NTUs. This follows the sediment dam blow-out of two weeks
ago. Your certification and subsequent '404 permit requires 25 NTUs.
The sediment and erosion control act requires visible si t'1 ation to remain
on site. Our community pond, a thirds a mile from the project, still
serves as the developers' true sedimentation pond. My suggestion to enlarge
the very small primary sedimentation pond and install filter fabric on
the upstream side of the dam has not been followed. There is no apparent
settling.
After weeks of discussion, revocation of the 401 certification and the
404 permit, there has been no improvement--when it rains. Is this a joke
or a bad dream? My fear is that this activity is state wide. But--what
can we expect when developers are issued permits, certifications and building
permits (from local government) to pipe streams, immediately clear 20 acres
out of 20 acres, move a hillside into the drain and build a shopping center?
I guess there is a shortage of the latter.

Water Quality Certification

Dear Mr. pJ rouse:
Water Quality Certification No. 1894, which was issued
to Ashton Properties for a project to relocate and culvert
sections of a tributary to Marsh Creek, was revoked June 10,
1986 because of violations of conditions in the
Certification. You were advised in the revocation letter
that once appropriate sedimentation and erosion control
measures had been installed at the project, reinstatement of
the Certification would be considered.
Members of our staff have made several follow-up visits
to the project and now advise that requested additional
facilities for erosion control have been. installed, the
remainder of the 96" metal pipe has been installed, sampling
on July 10 indicated that the project was now complying with
water quality standards, and that management practices now
in place provide reasonable control over the potential

sedimentation of downstream waters. In view of the findings
above, I am hereby reinstating Water Quality Certification
No. 1894. All conditions of the Certification remain in
effect and compliance with the conditions must be
maintained.

The staff of the Raleigh Regional Office has made
several follow-up visits to the Ashton Properties site on US
Highway 1 North. The following comments are offered:
1. All requested additions to the erosion control
measures have been installed.
2. The remainder of the 96" metal pipe has been
installed.
3. Samples collected by the contractor on July 10,
1986, and analysed by a certified laboratory
indicated the facility was complying with water
quality standards.
4. The management practices now in place should
provide reasonable control over the potential
sedimentation of the waters of the State.
In view of the above; it is recommended that the 401
Certification for this site be re-instated.

in turbidity outside of the area of construction and that
appropriate sedimentation and erosion control measures be
used to minimize siltation and turbidity impacts.

Sampling by our Raleigh Regional office staff on June
6, 1986 indicted that the turbidity at two sites above the
construction was measured at 12 NTU's and 14 NTU's while
turbidities downstream of the construction site were 1400
and 1700 NTU's'. These values are significantly in excess of
the conditions of the Certification. These high levels of
turbidity are a result of an apparent lack of appropriate
sedimentation and erosion control measures at the site.
Because of the violations of the conditions of the
Certification, I am hereby revoking Certification No. 1894
which was issued for this project. Once appropriate
sedimentation and erosion control measures havebeen
installed at this project, I will consider reinstatement of
the Certification. I am by copy of this letter advising the

a citizen complaint of excessive siltation from the Ashton
Properties Development. The developer is Robert Sprouse, Jr.
The investigation establishes a violation of conditions of
the 401 Certification, in addition to violations of the Water
Quality Standards.
The Division proposes the revocation of the 401
Certification and appropriate action on water quality violations.
The staff report and proposed letter of revocation are
attached.

due to noncompliance with the certification conditions concerning
erosion/sedimentation control. Your Department of the Army permit
is hereby suspended until the aforementioned Water Quality
Certification is reinstated. You should therefore immediately
cease from all fill activities in waters and wetlands onsite as
previously authorized by the suspended Department of the Army
permit.
A decision will be made to either reinstate, modify, or revoke
your permit pending a public interest review of your permit
suspension. You may, within 10 days of your receipt of this
notice of suspension, request a meeting with the District Engineer
and/or a public hearing to present information in this matter.

This is to request that you take immediate action to enforce the provisions
of Water Quality Certification #1894 issued to Ashton Properties of Raleigh
on March 27, 1986. The WQC should be revoked until compliance is assured.
In my opinion, the project is in daily violation of the certification
and has been for several weeks.
The entire project is a classic example of upper watershed destruction.
Unfortunately, it is authorized under Sections '401 and '404, and the
state sedimentation and erosion control program, delegated to the City
of Raleigh. I have been told that the developer is already on "notice"
from the City because certain sedimentation control measures have not
been followed. Additionally, grading or site preparation was restricted,
according to my information. To the contrary, work has advanced expeditiously.
with massive earth moving going on daily. The contractor has not, as
of this writing, installed a stilling riser in the (undersized) settling
pond as reportedly required by the City. What I shall call gray water
is piping through the bottom of a simple rock check dam, leaving the site
day after day and adversely impacting a community lake upon which I reside,
and there has, as yet, been little rain. There is no retention nor subsequent
settling of suspended materials. The water entering our community lake,
which is about a third of a mile downstream, appears to be carrying the
same sediment load (and who knows what else) as water entering the "settling
pond".
On my most recent site visit, the evening of June 3rd, I detected a strong
sewage type odor in the upper reaches of the remains of the watershed.
Also, I observed where grading activity had unearthed a refuse pile or
landfill. Some of the garbage and other artifacts was in the water, which
ultimately flows into the community recreation lake, to which I referred.
The gray water appears to originate on the project site. The primary
surface water entering the construction site is relatively clear and comes
from a lake immediately out of the grading zone.
I appeal to you to take action today to enforce the provisions of WQC
#1894. Without Department action there will be no "water quality". An
interesting "track record" for the site began as early as February, when,
on a clear Sunday morning, a slug of sediments entered our community lake
when the dam for a small pond on the project site was breached (apparently)

in preparation for clearing and grading). Therefore, one should not assume
that there wil be voluntary water quality management on the part of the
developer. Because the stream will be culverted and no vegetated buffer
remains, I must also ask on behalf of my community, if the WQC will protect
downstream water from parking lot runoff from the proposed shopping center,
which will have totally replaced the natural stream and forested watershed..

as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. That the applicant shall utilize appropriate
sedimentation and erosion control practices in
implementing the project. An erosion control
plan may be required to be filed with the N.C.
Division of Earth Resources, Land Quality Section
or an approved county erosion control program.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Dear Mr. Mills:
Enclosed is the application of Ashton Properties, represented
by Mr. H. Glenn Dunn of Poyner and Spruill, for a Department of
the Army permit and a State Water Quality Certification to place
fill material in the waters and wetlands of an unnamed tributary
to Marsh Creek to facilitate construction of a shopping center in
Raleigh, Wake County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by May 16, 1986, the District Engineer
will deem that waiver has occurred.

to do after you receive 401 certification. I also want to be
sure that.the application is complete so that there will be

Dear Mr. Sprouse:
On January 28, 1986, Mr. Ken Jolly of my staff met with
Messrs. Robert Hume, Glenn Dunn, David Beam and you to discuss
your proposed construction of the Ashton Square Shopping Center on
a tributary to Marsh Creek off North Boulevard in Raleigh, Wake
County, North Carolina. Your proposed culverting of the onsite
tributary and fill activities in the creek will require individual
Department of the Army permit authorizations pursuant to Section
404 of the Clean Water Act. A
A Section 401 Water Quality Certification must be obtained
from the North Carolina Division of Coastal Management, Water
Quality Section, Attn: Mr. William Mills, Post Office Box 27687,
Raleigh, North Carolina 27611-7687, prior to submission of an
application to this office for Department of the Army
authorization.
