Dear Mr. Freaney:
The Division has reviewed your application requesting exclusion from NPDES stormwater permitting at
Colorpath Technologies located in Trenton, NC. Based on your submittal of a signed certification of no
exposure, and upon inspection by Mr. Bill Moore on June 7, 2018, the Division is granting conditional
exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in
North Carolina regulations.
Please note that with this No Exposure Certification, Colorpath Technologies is obligated to maintain no
exposure conditions at this facility. If conditions change, such that this facility can no longer qualify for a
no exposure exclusion, you are obligated to immediately obtain coverage for industrial stormwater
discharge under a general, or individual permit. Otherwise, the discharge becomes subject to
enforcement as an un -permitted discharge. State statute provides for fines of up to $25,000 per day for
un -permitted discharges.
Colorpath Technologies must self re -certify annually that the no exposure condition is being maintained
by completing the Annual Self Re -Certification Form (copy enclosed). Please note that this conditional
exclusion does not affect other permits that may be required for this facility under other federal, state, or
local regulations or ordinances.
