This permit, issued on_T??? , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) Prior to excavation of the new section of the offshore channel, the approved alignment will be marked by staking and the permittee will request an inspec- tion by the Washington office of the Division of Coastal Management. (2) Prior to any discharge of excavated materials into the proposed spoil area, the permittee will request an inspection of the completed dikes and water control structure. (3) In order to reduce the potential for poor water quality in the canal system, the area delineated as "Turning Basin" must be excavated no deeper than five (5) feet at normal water level. The canal and offshore channel must be no deeper than six (6) feet at normal water level. (4) All excavated materials will be confined landward of the normal water elevation contour and any irregularly flooded wetlands within adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Ali work must cease when the permit expires on December 31. 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit #32-87 Page 2 of 2 ADDITIONAL CONDITIONS (5) The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. (6) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. (7) Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the normal water elevation contour to prevent gully erosion and resultant unnecessary siltation. (8) No excavated or fill materials will be placed or allowed to erode into any vegetated wetlands or waters of the State. (9) Vegetated wetlands will not be excavated or filled. (10) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTUs or less are not considered significant. NOTE: The proposed activity is authorized under General Water Quality Certifi- cation No 1273 issued by the Division of Environmental Management for discharge of liquid effluent from an upland diked disposal area. NOTE: Marking of the offshore channel should be done only after navigational aids have been approved under the Uniform State Waterway Marking System, administered by the N. C. Wildlife Resources Commission; or under U. S. Coast Guard approval. A marker system may require a modification of this permit. NOTE: The permittee should take all reasonable precautions available to him to prevent boats operating out of his basin from traveling at greater than no wake speed, while in the canal. No wake operation will reduce the frequency of canal maintenance and help protect adjacent properties from boat-caused erosion. 4 c? The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The project as proposed does require a 401 Water Quality Certification but meets the requirements of General Certification No. 1273 for the discharge of liquid effluent from an upland diked disposal area. b. Because of water quality problems which have occurred in the past due to stagnate water in this location; it is recommended that the maintenance dredging of the existing access canal and boat basin be limited to a maximum depth of -5 feet and the new access channel be dredged to -6 feet. Project summary The applicant is proposing to maintain an existing boating access channel and basin, excavate a new channel which will be excavated to the -6' contour of the Pamlico River and construct a concrete slab parking area 1W , 4 Environmental setting The applicant owns a + 35 acre tract of land adjacent to the Pamlico River in Beaufort County. Much of the property next to the Pamlico River is a wooded swamp vegetated mainly with cypress and various species of gums. On the upland portion of the property are various boat construction facilities. In 1981, the Division of Coastal Management issued a permit for the excavation of a boating access canal off of the Pamlico River. The canal terminates into a boat basin with a boat ramp. Project proposal The applicant is proposing the following: (1) The maintenance excavation of the existing aCCesc will he , _ T 50- in wi and to a depth of -6' at normal water. (2) The maintenance excavation of the existing boat basin. The maintenance area will be + 350' in length, + 50' in width and to a depth of -6' at normal water. (3) The excavation of a new channel into the Pamlico beginning near the mouth of the existing canal. This new channel will be excavated to the -6' NWL contour. The channel will be + 1,100' in length, + 30' in width and to a depth of -6' at NWL. This area has Fiad no previous excavation. All excavation will be done by a hydraulic dredge. A dike disposal area will be constructed on highground near the boat construction facility (see attached plats). (4) The construction of a 125' long by 75' wide concrete slab adjacent to the existing boat basin. This area will be used as a parking area for boats. Environmental impact The project as proposed will result in no wetland vegetation being excavated or ` filled. ± 33,000 sq. ft. of Pamlico River bottom will be excavated to a depth of -6' NWL.
