The property is located on the north side of NC HWY 102, approximately 0.2 miles west of the intersection of NC HWY 11 and NC HWY 102, in the town of Ayden. The feaiure is labeled as "WaR0-07-1272" on the attached map initialed by me on August 27, 2007 The Division of Water Quality (DWQ) has determined that the portion of the feature that is highlighted in pink on the attached map is Exem t from the Neuse Buffer Rules. This feature should be identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future conespondences concerning this property. This determination pertains to the subject property only. This on-site determination shall expire five (5) years from the date of this letter. . Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a surface water exists and that it is subject to the buffer rule may request a determination by the Director. Four of the stream features were �determined to be intermittent or perennial and subject to the Clean Water:Act. W. L,ochner Inc (Lochner). The following people were in attendance: Bill Biddlecome, United States Army Corps of Engineers (LTSACE) Christina Breen, North Cazolina Division of Water Quality (DWQ) Eric Galamb, Lochner Heather Renninger, Lochner Cindy Szwazckop, Lochner The following is an account of the events of the day: � . Wetland IiRA: the USACE claimed the excavated azeas that were delineated by Lochner. Bill checked some areas adjacent to the excavated areas that contained water stained leaves, but did not claim these as jurisdictional wetlands. Wetland 18: This area was visited during the January verificarion meeting, and Bill could not decide whether to claim it or not. At that time, the azea contained some standing water. Heather and Emily Rackley (Lochner) explained that they visited that azea two tunes in the past (once in the spring and once in the winter) and the site did not meet wetland criteria. Furthermore, it did not contain any standing water. Bill requested later that Lochner send him the rainfall data around the rime of the verification. After extensive inspection of the site, Bill felt that there were enough wetland chazacteristics present to claim the azea as a jurisdictional wetland. Eric indicated that the azea would be added to the mapping. Stream HR 3 was called an agriculture ditch by Christina (exempt from Neuse River buffer rules). Bill stated the stream was intemuttent and unimportant along the length of the stream that appears on the USDA soils mapping (from the comer of the field edge and wooded azea). Bill and Christina noted that the water was stagnant, and there was a moderate amount of leaf litter in the channel. Both Bill and Christina agreed that the streams HR 1 and HR 2 aze not jurisdictional and therefore buffer exempt. Very few features that would indicate a jurisdictional stream were present. Stream M40: Bill and Christina agreed the stream was not jurisdictional until �the point where it crosses Forlines Road. The non jurisdictional section of streazn needs to be removed from the WEX file and mapping. Stream M40A will remain as inteimittent (unimportant). Riparian buffer rules and mirigation wili apply to stream M40A. The group broke for lunch, and Bill Biddlecome left the group for the remainder af the day. For the remainder of the afternoon, the group reviewed sites to determine whether they were exempt or subject to riparian buffer rules. The following determinations were made: • Christina agreed with Lochner's determinations that streams HR 29., HR 25, HR 26, HR 50, HR 51, and HR 52 were all non jurisdictional ditches and exempt from buffer rules. These features had varying amounts of vegetation, dryness, and Iack of geomorphology. � • Stream HR 28 was claimed as a jurisdictional intermittent stream. Riparian buffer rules and mitigation rules apply. This stream flows into stream 6SA. • HR 6SA was originally claimed as a perennial stream in 2002. Christina felt that the Iack of water in the charinel on the day of the site visit warranted a change to an intermittent status. She directed Lochner to change the forms for this stream to indicate that it is intermittent for a portion of its length. The intermittent/perennial transition point was located about 75 feet downstream from the confluence with HR 28 at the confluence with a non jurisdictional agriculture ditch. HR 6SA will require buffer mitigation for its entire length. Lochner's mapping will be updated to show this change. � Stream HR 16: Christina determined this feature to be intermittent (and subject to the Neuse riparian buffer rules) on the south side of Pocosin Road and ephemeral (buffer exempt} on the north side of Pocosin Road. � Stream HR 13: Christina determined this feature to be ephemeral and not subject to riparian buffer rules. No water was present in the channel at the time of the site visit. i�Vater-stained leaves were present in the bottom of the channel. Lochner agreed to send an updated package to Bill and Christina, including a copy of the meeting minutes. In addition, Lochner agreed to provide Christina with a copy of the field mapping showing the sites reviewed for buffer detemunations, a copy of the pertinent data sheets, and a copy of the field notes when the sites were first reviewed. Tlris meeting was arranged due to the fact that hydrology in the area had changed significanUy since the field work was performed in summer of 2002, and stream determination calls on many of the streams will likely be changed following another review. Mike Thomas with NCDWQ and Heather Renninger and Emily Fentress with H.W. Lochner, Inc. attended the meeting. A site-by-site visit was conducted on the following streams: • CC2 — significant amount of vegetation in streambed; no flow; ephemeral • CC9 — no flow; ditch through agricultural field • Jolly 27 — contains fish; perennial • WS (upper reach) — possible lineaz wetland; Mike Thomas will contact Mike Bell regazding the determinarion on this segment of stream; Mike Thomas is inclined to call the entire segment non- jurisdictional. FOLLOW-UP: Mike T'homas contacted Emily Fentress on July 6, 2004 and said the entire upper reach of stream WS is non jurisdictional and should not be included on mapping. • G-12 — does not contain water; ephemeral • NCl 1-26 — begin jurisdiction at the fann road crossing on the east side of NC 11.
