Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* Site is partially undeveloped (townhome community currently under construction) located at the NW corner of the Chapel Hill Road/1-40 interchange. Richland Creek extends roughly NE to SE through the property, and a 20 -wide sanitary sewer easement runs along the west side of the creek. This easement contains an eight -inch PVC gravity sewer main, a portion of which (approx. 40 feet) has been exposed due to streambank erosion. Most of the exposed sewer line is encased in concrete. the surrounding area consists of 1-40 to the east, Chapel Hill Road to the south, existing residential and commercial properties to the west, and a newtownhome community to the north. 4b. Eventually, a new segment of sewer line will be added landward, to move the existing segment of line further from the stream. This second phase is not scheduled or funded. In the short/midterm, the stabilized bank will be periodically monitored to ensure no further exposure. This second phase has not been designed, and it will likely be 4-5 years before this additional work will be done. Any impacts associated with this phase will be limited to riparian buffer impacts only; no wetlands or stream channels will be affected. The existing length of sewer line will be abandoned in place. What data source did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? A NC Natural Heritage Program (NHP) database search was conducted for the USGS Raleigh West Quadrangle (www.ncnhp.org/web/nhp/database-search) on 7/12/18, and an IPac Trust Resources Report and an official threatened and endangered species list was requested from the USFWS Environmental Conservation Online System (ECOS) (http://ecos.fws.gov/ipac). Four species were identified. The Bald Eagle (Haliaeetus leucocephalus) was identified has having current occurrences within the Raleigh West quadrangle. The bald eagle is not listed as a federally endangered or threatened species; however, it is protected under the Bald and Golden Eagle Protection Act (BGPA). Bald eagles live near rivers, large lakes and marshes where they can find fish and other prey animals. Bald eagles require a good food base, perching areas, and nesting sites. Although several small ponds/lakes are located within the vicinity of the project site, no large water bodies are located within one mile of the project site. Based upon this information, the project is anticipated to have No Effect on this species. Michaux's sumac (Rhus michauxii) is listed by the NHP as having documented occurrences in Wake County. Michaux’s sumac is a woody shrub found in open woods in rocky or sandy soils. The project area consists of a maintained sanitary sewer easement, mostly under canopy cover, in a developed area. No specimens of Michaux’s sumac were observed. Based upon this information, the project is anticipated to have No Effect on this species. The Rusty-Patched Bumblebee (Bombus affinis) is listed as Endangered. While listed as having been seen in Wake County, this is a midwestern species that typically is found in grasslands and tallgrass praries. No suitable habitat was observed for this species in the project area. Based upon this information, the project is anticipated to have No Effect on this species. The Northern Long-Eared Bat (Myotis septentrionalis) is a Threatened species. According to the USFWS Endangered Species Fact Sheet on the northern long-eared bat, this species spends winter hibernating in caves and mines, called hibernacula. They typically use large caves or mines with large passages and entrances; constant temperatures; and high humidity with no air currents. No caves or mines are located in the vicinity of the project site. During the summer northern long-eared bats roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees. Males and non-reproductive females may also roost in cooler places, like caves and mines. This bat seems opportunistic in selecting roosts, using tree species based on suitability to retain bark or provide cavities or crevices. It has also been found, rarely, roosting in structures like barns and sheds. Project work is restricted to the stream bed and banks. Tree cutting will be limited to trees on the banks that are in danger of falling, and small trees (saplings) along the temporary access corridor. T he project is short duration (work will be completed over several days). Based upon this information, the project is anticipated to have No Effect on this species. Stormwater Issues This project involves restoring cover over an exposed sanitary sewer line and stabilizing the streambank. No concentrated stormwater flow will result from this project. Original contours will be restored and seeded upon completion of the work. No impervious surface will be added beyond the riprap used to stabilize the stream banks.
