Dear Mr Simmons:
On July 10, 2018, staff from the Wilmington Regional Office of the Division of Energy, Mineral
and Land Resources (DEMLR), conducted a site inspection for the tract/project known as
Whiteville Ready Mixed Concrete located in Duplin County, North Carolina. The site drains to
Pine Log Branch, which is currently classified as Class C Sw Waters in the Lumber River Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
1. A stormwater pollution prevention plan has not been developed and implemented and is a
violation of Permit Condition Part III.
2. Analytical sampling has not occurred for the site and is a violation of Permit Condition
Part IV Section A and Section D which requires semi-annual sampling for 5 parameters.
3. Qualitative sampling has not occurred for the site and is a violation of Permit Condition
Part IV Section C which requires semi-annual observations for 10 parameters.
4. The site needs general housekeeping and implementation of best management practices
to keep potential pollution sources from entering stormwater and wastewater discharges.
5. Spill prevention and response procedures need to be implemented. Petroleum products
found on site were spilled on the ground.

6. Wastewater treatment has not been in accordance with permit requirements Part II section
B.2.
Required Response
1. You are directed to respond to this letter in writing within 30 calendar days of receipt of
this Notice. Your response should be sent to this office at the letterhead address and
include a schedule for compliance with the permit.
2. Develop and implement a Stormwater Pollution Prevention Plan (SPPP). Submit copy of
the SPPP to this office for review with 30 calendar days of receipt of this Notice. Include
all required minimum elements.
3. Implement the required sampling protocol as outlined in the permit.
Thank you for your attention to this matter. This office requires that the violations as described
above be properly resolved. unresolved violations may lead to the issuance of a Notice of
Violation and/or assessments of civil penalties.
Thank you for your assistance and cooperation during this inspection. Please be advised that
violations of the NPDES Stormwater General Permit may be subject to a civil penalty
assessment of up to $25,000.00 per day for each violation. If you have any questions,

Inspection Summary:
Complaint recieved regarding the Whiteville Readi-Mix facility.
The inspector met with the site operator. He was fairly new at the facility, having transfered from the Ocean Isle Beach
plant. He was unaware of the permit or the requirements; including the SPPP and sampling.
The site has three sources of wastewater discharge.
The drum cleanout pit, southeast corner of facility, is breached on the west side and appears to overtop frequently. The
berm of the pit is covered with dried concrete residue. A ditch is to the south of the pit. The ditch does have evidence of
concrete material in it. A secondary basin is to the west. The inspector is unsure of the definition of this basin, whether it is
constructed or natural low spot: due to vegetation. Outlet of this basin is unknown. The pit breach drains to this basin.
The truck washddown is on the south of the facility. No measures are installed to retain process wastewater from running
into the woods.
The stockpile spraydown is on the west side of the facility. No measures are in place to retain wastewater onsite. The
wastewater flows into the woods.
A truck maintenance facility is onsite. The used oil is deposited into a container inside, then pumped to a container outside.
A recent spill is evident around the outside container. Used oil container does not have secondary containment. The
employees had thrown sand on the spill, but did not clean it up. Secondary containment around the desiel fuel is in need of
repair. Some other containers are stored outside, generally used containers of various sources.
The facility generally sheet flows offsite. There is no containment to reduce suspended solids and sediment for the site.
The waste concrete area to the west of the facility is in the process of being crushed. The concrete did include offsite
concrete as there was rebar present. The conveyor belt spraydown was not contained on site.
