Vessie Sewer Maintenance Superintendent City of Raleigh Public Utilities Department PO Box 590 Raleigh, NC 27602-0590 SUBJECT: Rescission of Violations Related to NOV-2017-DV-0111 & NOV-2018-DV-0119 Collection System Permit No. WQCS00002 Raleigh Collection System Wake County Dear Mr. Vessie: On February 21, 2017 and on March 12, 2018, the City of Raleigh self-reported Sanitary Sewer Overflows caused by grease at the Orchard Point Apartment Complex. The City of Raleigh Public Utilities' GIS mapping showed that manhole SMH122451 and downstream main at the Orchard Point Apartment Complex were the City of Raleigh's infrastructure. These SSOs were entered into the Division's database as incidents 201700278 and 201800400, respectively, and were included in Notice of Violations NOV-2017-DV-0111 and NOV-2018-DV-0119. After deed research by the City of Raleigh Public Utilities, it was determined that both the manhole and associated downstream section of sewerline main are private, and therefore the responsibility of the apartment complex property owner. As a result of this determination, the City of Raleigh sent a letter to the Raleigh Regional Office of the Division of Water Resources dated May 30, 2018 requesting the Notice of Violations with Intent to Enforce (NOV-NOIs) that included the two incidents at Orchard Point Complex be rescinded (NOV-2017-DV-0111 and NOV-2018-DV-0119). Accordingly, by copy of this letter, the incidents at the Orchard Point Apartment complex (201700278 and 201800400) have been deleted from those NOV-NOIs in the Division's database.
