Rocky Top Bank Parcel Credit Release — Tasks 1,2 & 7
Dear Mr. Howard:
On November 14, 2017 the Division of Water Resources (DWR) approved a Bank Parcel
Development Package (BPDP) for the above -referenced site under the terms and conditions of the
Restoration Systems, LLC (RS) Haw -River Subwatershed Phase One Umbrella Mitigation Banking
Instrument for Riparian Buffer Mitigation and Nutrient Offsets (UMBI). On April 28, 2017, the
DWR received a recorded conservation easement and corresponding plat for the subject site.
Additionally, RS provided confirmation that the conservation easement for the subject bank has been
successfully assigned to The North Carolina Wildlife Habitat Foundation, Inc (NCWHF). NCWHF
is a 501(c)(3) non-profit corporation and has been approved by DWR as a long-term steward for this
mitigation bank.
On June 4, 2018, the Division of Water Resources (DWR) received documentation from RS that the
subject site had been constructed in its entirety and monitoring plots had been installed. On July 17,
2018, Ms. Merritt, with assistance from Worth Creech with RS, inspected the site and confirmed
that all of the subject site had been completely planted and fenced, all monitoring plots were
installed, and all stream restoration and enhancement activities appeared to be completed with all
riparian areas, including the stream banks, seeded and stabilized.
In accordance with the UMBI and BPDP, signed on October 25, 2017 and approved on November
14, 2017 respectively, the following Project Milestones have been met and the corresponding credits
shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract. Therefore, 45% of your Jordan Lake riparian buffer Restoration credits
(0.45 x 102,471.10 W = 46,112 ft) and 45% of your Jordan Lake riparian buffer Enhancement
credits (0.45 x 20,431.48 ft' = 9,194.17 fe) are now released.
Additionally, 45% of your generated nitrogen offset credits (0.45 x 2,451.80 =1,103.31 lb -N) and
45% of your generated phosphorus credits (0.45 x 156.75 = 70.541b -P) are now released.
Generated credits are credits that have not been applied to the appropriate delivery factor.
The delivery factors applied to this bank due to its location in the 14 -digit HUC 03030002050050 are
71 % for nitrogen and 67% for phosphorous. Therefore, the total amounts of delivered nutrient offset
credits for this site are 1,740.78 lb -N and 105.02 lb -P. By copy of this correspondence, 45% of your
delivered nitrogen offset credits (0.45 x 1,740.78 lb -N = 783.35 ib -N) and 45% of your delivered
phosphorus credits (0.45 x 105.02 = 47.261b -P) are now available for sale.
Please note that onIN the delivered nutrient offset credits can be sold from this bank and used
for impacts in the Haw River Arm of Jordan Lake within the Cape Fear River Basin.
Additionally, riparian buffer credits can only be used to offset impacts located in the Haw
River Sub Watershed of Jordan Lake according to 15A NCAC 02B .0295, which became
effective on November 1, 2015.
