REGAN Secretary LINDA CULPEPPER Interim Director July 17, 2018 George Howard Restoration Systems, LLC 1101 Haynes Street, Suite 211 Raleigh, NC 27604 DWR Project #: 2014-1149v9 Caswell County Re: RS Haw River Subwatershed — Phase 1 Neuse Buffer & Nutrient Offset Umbrella Mitigation Banking Instrument (UMBI) Benton Branch Bank Parcel Credit Release — Tasks 1 (partial), & 6 Dear Mr. Howard: On January 22, 2018 the Division of Water Resources (DWR) approved a Bank Parcel Development Package (BPDP) for the above -referenced site under the terms and conditions of the Restoration Systems, LLC (RS) Haw -River Subwatershed Phase One Umbrella Mitigation Banking Instrument for Riparian Buffer Mitigation and Nutrient Offsets (UMBI). On April 28, 2017, the DWR received a recorded conservation easement and corresponding plat for the subject site. Additionally, RS provided confirmation that the conservation easement for the subject bank has been successfully assigned to The North Carolina Wildlife Habitat Foundation, Inc (NCWHF). NCWHF is a 501(c)(3) non-profit corporation and has been approved by DWR as a long-term steward for this mitigation bank. On June 4, 2018, the Division of Water Resources (DWR) received documentation from RS that the subject site had been constructed in its entirety and monitoring plots had been installed. On July 17, 2018, Ms. Merritt, with assistance from Worth Creech with RS, inspected the site and confirmed that all of the subject site had been completely planted and fenced, all monitoring plots were installed, and all stream restoration and enhancement activities appeared to be completed with all riparian areas, including the stream banks, seeded and stabilized. DWR has not received a performance bond to cover monitoring and maintenance costs; therefore, only a partial credit release for partial completion of task 1 will be issued. The remainder 5% for completion of task 1 will be issued when DWR has received a performance bond to cover monitoring and maintenance costs. The total mitigation credits associated with each mitigation type changed slightly from what was approved in the BPDP due to stream channel alignments. Therefore, for efficiency purposes, DWR is issuing this credit release based on the mitigation credit totals provided in the As -Built Report. In accordance with the LIMBI and BPDP, signed on October 25, 2017 and approved on January 22, 2018 respectively, the following Project Milestones have been partially met and the corresponding credits shall be released: Task/Milestones Credit 1) Instrument and BPDP Approved by DWR, Conservation Easement recorded, 35% Mitigation Site Earthwork, Planting and Installation of Monitoring Devices Completed, Monitoring Financial Assurance Posted (not received) 6) Item B (1) of Section X in the Instrument (assign the easement 5% to stewardship) has been completed and approved by DWR TOTAL: 40% By copy of this correspondence, DWR confirms that you have partially satisfied the above requirements for the above -referenced tract. Therefore, 40% of your Jordan Lake riparian buffer Restoration credits (0.40 x 455,056.93 fe =182,022.77 ft) and 40% of your Jordan Lake riparian buffer Enhancement and Preservation credits (0.40 x 224,557.63 fe = 89,823.05 fe) are now released. Additionally, 40% of your generated nitrogen offset credits (0.40 x 179.95 = 71.98 lb -N) and 40% of your generated phosphorus credits (0.40 x 11.5 = 4.6 lb -P) are now released. Generated credits are credits that have not been applied to the appropriate delivery factor. The delivery factors applied to this bank due to its location in the 14 -digit HUC .03030002050050 are 25% for nitrogen and 8% for phosphorous. Therefore, the total amounts of delivered nutrient offset credits for this site are 44.99 lb -N and 0.92 lb -P. By copy of this correspondence, 40% of your delivered nitrogen offset credits (0.40 x 44.99 lb-N=181b-N) and 40% of your delivered phosphorus credits (0.40 x 0.92 = 0.371b -P) are now available for sale. Please note that only the delivered nutrient offset credits can be sold from this bank and used for impacts in the Haw River Arm of Jordan Lake within the Cape Fear River Basin. Additionally, riparian buffer credits can only be used to offset impacts located in the Haw River Sub Watershed of Jordan Lake according to 15A NCAC 02B .0295, which became effective on November 1, 2015.
