On behalf of S. Wake Properties, Inc. (applicant and owner) please find attached a
complete application and supplemental information requesting written concurrence from
the US Army Corps of Engineers (USACE) and North Carolina Division of Water
Resources (NCDWR) that the activities associated with the proposed road widening may
proceed under Nationwide Permit (NWP) 29 and the associated General Certification
(GC) 4139. Please find attached a complete application and supplemental information.
Project Summary and Purpose
The overall project is a single-family residential subdivision with residential streets and
utilities that will connect to existing adjacent roads and utilities in the area. The Project is
located in eastern Fuquay-Varina, NC immediately east of Kennebec Road at a point 0.3
mile southwest of the Kennebec Road and Hilltop Road intersection. The purpose of the
proposed project is to construct a residential subdivision and associated utilities to meet
the demand for housing in this part of Wake County.
Project Detail
The overall project is a single-family residential subdivision that consists of 48 residential
lots, two roads and other associated utilities such as sewer, electric, etc. Residential
streets and utilities will connect to existing adjacent roads in the area. The proposed
wetland impacts will result from road construction and wetland fill. Heavy equipment

typically used for utility installation projects (e.g. back hoes, bull-dozers, etc) will be
utilized.
No recorded federally listed species are located on the project site or within a 1-mile
radius according to the NC Natural Heritage Data Base (2018).
No structures are located on the subject property. According to the SHPO website, the
project is located approximately 250 feet northeast of the Charles Rowland House
(WA1127), which was labeled as survey only and ineligible.
Project History
Most of the project site has been in pasture since at least the mid twentieth century. A
riparian buffer determination was not made by NCDWR staff because the applicability of
the buffer rules to surface waters on the property were not contested. A site meeting was
held with MR. James Lastinger of the USACE on November 7, 2017. A preliminary
Jurisdictional Determination has not ben issued but the delineation was confirmed in an
email (copy attached) and SAW-2017-2370 corresponds to the project file for this
property.
Avoidance and Minimization
All stream, wetland, and riparian buffer areas on the site have been avoided with the
residential site plan. The proposed buffer and stream impacts will result from the
extension of an existing culvert under Kennebec Road at a curve in the road. The
extended culvert will allow for a wider shoulder needed to increase the safety of the
existing stream crossing.
Project Impacts
No impacts to wetlands are proposed. Proposed stream impacts will result from a culvert
extension/roadfill. Permanent stream impacts will total 16 LF and temporary stream
impacts required for the culvert installation will total 10 LF. The resulting riparian buffer
impacts needed to extend the existing roadway shoulder will total 1,658 ft2 (978 ft2 in Zone
1 and 680 ft2 in Zone 2). No other impacts are proposed.
Mitigation
No wetland impacts are proposed therefore wetland mitigation is not proposed. The only
proposed riparian buffer impacts will result from the widening of an existing perpendicular
road crossing that is considered “allowable” therefore no buffer mitigation is proposed.
Proposed permanent stream impacts have been minimized to a total of 16 LF. No stream
mitigation is proposed.
