Hamilton, Executive IDircctor MEMORANDUM TO: Stephen Rynas, Federal Consistency Coordinator Division of Coastal Management North Carolina Department of Environment and Natural Resources FROM: Maria Tripp, Northeast Coastal Region Coordinator Habitat Conservation Section DATE: June 30, 2005 SUBJECT: Dolphin Ridge and Royall Oaks Subdivisions off of Coast Guard Road in Emerald Isle, Carteret County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the consistency determination with regard to impacts on fish and wildlife resources. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant has submitted a request to fill wetlands in both the Dolphin Ridge and Royall Oaks Subdivisions in Emerald Isle, NC. NCWRC reviewed and responded to this project under the US Army Corps of Engineers individual permit process and the NC Division of Water Quality 401 process (Tripp, 24 March 2005). We continue to believe the proposed mitigation will not compensate wetland impacts and stand by our comments referenced above. Please review the attached memorandum dated March 24, 2005 for more information. We appreciate the opportunity to review and comment on this consistency determination.
