Dear Sirs:
This Office has reviewed your Individual Permit application and is placing your project on hold.
After reviewing the permit application and public notice, the DWQ has determined that your application
was incomplete and/or provided inaccurate information as discussed below. The DWQ will require
additional information in order to process your application to impact protected wetlands on the subject
property. Therefore, unless we receive the additional information requested below, we will have to move
toward denial of your application as required by 15A NCAC 2H.0506 and 2B .0223(8) and will place
this project on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to review your project.
1. Please remove all "old" wetland areas proposed to be filled from the site plans and provide new
site maps with proposed fill and building footprints for lots 12, 93, and 2. Please show on the site
plans where you propose to install retaining walls (fill slopes can be no steeper than 2:1).
2. Please explain how you plan to proceed if a 404 Permit and a 401 Water Quality Certification are
secured. DWQ has concerns regarding who will actually be placing the fill on the lots, the
applicant or the future lot owners? If the lots are sold prior to placing the fill on the site, the
404/401 may expire prior to any additional wetland impacts in the subdivisions. In addition,
compliance issues may result if each future lot owner is responsible for the bill on his/her lot.
The additional information received on May 18, 2005, requested some wetland fill in "old"
wetland areas. The DWQ does see this as an option because those wetlands were placed in
preservation under the previous permits and all lots were deemed to be buildable at that time.
Please look to reducing the front setback on any lots where you determine you need more
building area. Please also note that the lots in these two subdivisions do have impervious
coverage limits under the State Stormwater Management Permits. Have the deed restrictions
concerning maximum built upon area been recorded in accordance with the stormwater permits?

weeks, we will assume that you no longer want to pursue this project and we will consider the project as
