Scott,
The Division cannot determine the appropriate 401 Water Quality Certification to issue for the projects noted in David's
email below until the appropriate permit is confirmed by the Corps. In accordance with 15A NCAC 02H .0502(c) I will
place the following projects on hold until a final decision regarding the use of the NWP program is made by the Corps:
Comet Drive, Patton Park Site, and Meadowbrook Terrace.
Please notify me once the Corps makes a determination regarding the use of the NWP program, so that the Division may
continue to process the noted projects.

The Corps has requested informal consultation/coordination with US Fish and Wildlife Service (USFWS) for Mountain
Sweet Pitch Plant (Sarracenia jonesii) on the recently submitted PCNs/applications for the Comet Dive Site (Site Q113),
Patton Park Site (Site Q1G), and Meadowbrook Terrace Site (Site Q1C) Stream Restoration Projects in Hendersonville,
Henderson County, NC. We are required to make a determination of effect on federally listed species prior to issuing a
permit to impact jurisdictional waters of the United States. If other than a "no effect" determination is made, we must
consult with the USFWS. At this time, the Corps cannot make a determination of no effect, therefore we will
coordinate/consult the application with the USFWS.
Until the Corps completes consultation or can make a determination of no effect, we cannot make a final decision
regarding the use of the NWP program for this project. We will contact you once we have made a determination for this
project. USFWS usually responds within 30 days with comments. The Corps has placed processing your application on
hold until comments are received from USFWS.
