Interim Director Subject: General Permit No. NCG020000 Souteast Bulk, LLC COC No. NCG020932 Edgecombe County Dear Mr. Wilfong: In accordance with your application for a discharge permit received on June 18, 2018, we are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state — NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except upon approval of the Division of Energy, Mineral, and Land Resources. The Division of Energy, Mineral, and Land Resources may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part IV, Section D of your permit. You must have an approved Operation and Monitoring Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. Your application included an Operation and Pumping Plan, but that plan is not currently sufficient for approval by our Division and the Division of Water Resources (DWR). Please contact Danny Smith in the Raleigh Regional Office of DWR at (919) 791-4252 to schedule a site visit to evaluate your facility and discuss additional information and adjustments that may be needed to your Plan. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. Per the requirements of the Tar -Pamlico Riparian Buffer Rule, all stormwater drainage to stream buffers, from portions of this site that have been constructed after January 1, 2000, must meet diffuse flow requirements per 15A NCAC 2B .0259. Diffuse flow requirements are described in Chapter 8 of the North Carolina Stormwater BMP Manual, available at: http:Hdeq.nc.gov/about/divisions/energy mineral-land-resources/energy-mineral-land-permit-guidance/stormwater-bmp-manual. You should also note that your facility is in a Water Supply Watershed and in an area covered by the Tar -Pamlico Nutrient Sensitive Waters Strategy. Edgecombe County implements the new development stormwater provisions of these requirements. You are encouraged to work with the county to assure that you are in compliance with any applicable requirements of these programs. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources, the Coastal Area Management Act, or any other federal, state or local government permit that may be required. NCG020000 CERTIFICATE OF COVERAGE No. NCG020932 MINE DEWATERING AND STORMWATER DISCHARGES NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the Federal Water Pollution Control Act, as amended, Barnhill Contracting Company is hereby authorized to discharge mine dewatering discharge and stormwater from a facility located at Dairy Farm Pit 107 Rhodes Dairy Lane Battleboro, NC Edgecombe County to receiving waters designated as Key Branch, class WS -IV; NSW waters in the Tar -Pamlico River Basin, in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III, and IV of General Permit No. NCG020000 as attached. This certificate of coverage shall become effective July 16, 2018. This Certificate of Coverage shall remain in effect for the duration of the General Permit. Signed this day July 16, 2018.
