Draft cover letter is attached. Let me know if you have any comments/changes.
I talked with Brent Caudle with Barnhill Contracting about the plan. He will be the contact for the site visit and
changes. I may not get the letter out until early next week. If that is the case I am going to go ahead and email your
contact information to Mr. Caudle. It sounded like he wanted to set up a site visit as soon as he could.
It doesn't appear that they will actually need to dewater for a while (could be a couple of months) so I think they will
have all the other permits they need to do other work in the interim (roads, etc.).

Thanks Danny. Call when you get a chance and we can discuss.
They did include a pumping plan and it is included in the application information in Laserfiche if you want to look at
that. It is addressed to the Washington Regional Office when you look at the documents. They thought they were in
that region.. I am including language in the cover letter about Edgecombe County implementing WS and NSW
requirements and directing them to talk with the county. Also noting the NSW buffer requiremetns.

Hey — no worries. - Sorry for my delay. Our phones are down- I will call you when things are up and running.
I would like to talk to you about this mine site. [I do not have problems with the pit location. But, I do recommended
the development of a monitoring/dewatering plan to ensure they don't have impacts to features within their 400 foot
perimeter.]
Dairy Pit Farm, Edgecombe County, - Hwy 97
• Project is located in the Tar -Pamlico River basin. Unnamed tributaries to Key Branch, are depicted on USGS
topographic map [Class WS -IV, Nutrient Sensitive Waters.] These features are located on both the
North/Western and Eastern edges of the "400 foot perimeter" depicted on the site plans.
• Earthen fill/excavation - If wetland, riparian buffers or stream impacts are proposed, this project will need to
comply with/secure a 404 permit from the USACE, obtain a 401 Water Quality Certification authorization and a
riparian buffer authorization, as appropriate.
• The project is in a water supply watershed. The permittee should to contact local government (Edgecombe
County) to ensure compliance with local water supply watershed ordinances. (WS development densities may not
get triggered by mining.)
• Hydrology - NCG020932 permit application depicts the following: 1) "man-made ditch", 2) wetland "A", & "C",
"E", "D", and Jurisdictional Waters (a pond at 79 feet).
1) "man-made ditch" — Application explained that this feature is 304 feet from the proposed borrow pit at its
closest point and ESS (consultant) belief is that this feature is not a stream. (Note: If the feature is a stream
and dewatering removes the lotic hydrology of the feature, a stream standard violation could occur.)
2) Wetlands A, C and Jurisdictional Waters — dewatering and/or a monitoring plan is recommended to ensure
that resources (wetlands and waters) that are within the 400 foot perimeter are not impacted by borrow pit
dewatering.

Sorry to bug you on this one, but Judy issued the mining permit last Thursday. I'm guessing I might hear from them
pretty soon about our permit also. If you get a chance take a look and let me know if you see any issues with this one.

Here is the link to the NCG02 application and attachments in Laserfiche. I think Judy has sent the stuff for the mining
permit also. Let me know if you have comments. There are some ditches and wetlands that they have had delineated
by a consultant but I don't know if they need anything else on this.
