In order to install the road, it is necessary to fill 0.16 acres of a wooded wetland with a culvert and associated fill. Manakel Drive is being installed down -gradient of an existing pond dam. The pond does not have a functioning outlet pipe. Currently, surface flow is going over two areas of the dam and creating a safety hazard and unstable areas that are washing away on the back side of the dam. It is necessary to lower the water level and install a functioning outlet pipe and structure. In order to upfit the dam, it is necessary to impact 0.08 acres of a wetland fringe, emergency spillway wetlands and wetlands at the base of the dam that will be lost as a result of removing the hydrology. 3. REGAN Secretary Expiration of Acceptance: 12/26/2018 County: Guilford The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable.
