Dear Mr. Wojoski:
Dewberry Engineers Inc. (Dewberry) is providing additional information per the letter from NCDEQ
dated June 21, 2018.
Impacts
Comment:
It is unclear if the proposed work will occur within an existing maintenance corridor where vegetation is
currently removed and mowed or if work will occur outside of the existing corridor and a new
maintenance corridor is being proposed to be aligned with the new sewer location. Please clarify by
providing additional information as to the location of the work in relation to any existing maint enance
corridor. Please revise the plans to show the existing maintenance and new proposed maintenance
corridor, if applicable. The Division is only concerned with the maintenance corridors (existing and
proposed) where vegetation will be/is removed to maintain the sewer line. This area will likely be smaller
than the area proposed to be sanitary sewer easement.
Response:
The entire existing or proposed maintenance corridor is the full width of the existing or proposed sanitary
sewer easement. The vegetation will be removed and maintained from the full width of the new easement.
The majority of the new sewer will be installed in a new 30-foot or 40-foot wide easement, but there are a
few areas where the sewer will be replaced within an existing, maintained, sewer easement (see sheets
C2.3, C2.4 and C2.5). The new and existing maintenance corridors have been indicated on each sheet. An
overall view of the new sewer and existing sewer to be abandoned/removed can be found on Sheet C1.0 .
Mitigation
Comment:
It appears that some of the proposed work may require mitigation. If the proposed buffer impacts are
outside of the footprint of an existing, maintained, maintenance corridor, are greater than 10 feet in width
and are in Zone 1 of the buffer, the activity is allowable with mitigation….
Please calculate the impacts that fall in the above described areas and revise the Buffer Impact table on
section 6 of the PCN to clearly show these....
Please clarify if mitigation if being proposed for the impacts and revise the PCN as necessary.
Response:
The Impact Exhibit has been revised to show permanent and temporary buffer impacts outside of the
existing, maintained sewer corridor (existing easement). The Buffer Impact table (page 5) has been

updated accordingly. Mitigation is being proposed for Zone 1 buffer impacts for new sanitary sewer
maintenance corridors (new easement). The Buffer Mitigation section on page 7 has been completed.
Avoidance and Minimization
Comment:
The Division has concerns about the permanent impacts of the manholes located in Zone 1 of the buffer.
Section D.1a. of the PCN stated that efforts were made during design to site manholes outside of the buffer
zones where possible and that more information was included in the cover letter. The cover letter does
not include a narrative of how the minimization was attempted and why there are no alternatives to
locating the seven (7) manholes of running the sewer line parallel to the stream (sheet C2.4) in Zone 1 of
the buffer. There appears to be practical alternatives to locating some of the manholes in Zone 1 of the
buffer. For example on Sheet C2.3, it appears the two new manholes and sewer line can be redesigned to
cross the stream approximately 5-10 feet to the southeast and avoid impacts to Zone 1 completely. On
Sheet C2.4, it appears the sewer line and manholes can also be moved southeast t o avoid running parallel
to the stream on Zone 1. On sheet C2.8, it appears the manhole on the north side of the western stream
crossing can be moved slightly north to avoid Zone 1 impacts. Please provide a narrative of avoidance and
minimization measures considered in the design and explain why the practical alternatives described are
not feasible.
Response:
Narrative of Avoidance and Minimization: During the design phase, efforts were made to locate the sewer
manholes outside of Zone 1 or use existing, maintained sanitary sewer easements.
C2.3, C2.4, C2.5: There is an existing sanitary sewer within a 30-ft maintenance corridor within the
riparian buffer zone. The sewer and manholes will be replaced within the existing maintenance corridor
in a location that places the new sewer further away from the stream. The existing sewer and manholes
within Zone 1 will be abandoned or removed.
C2.8: Manhole 25 was located in a paved parking lot that lies within Zone 1; there will be no new impacts
to Zone 1.
Comment:
Also, please clarify that the stream impacts for the placement of rip -rap in the channel for stabilization
will be at the existing channel bed elevation and conform to the existing contours of the channel banks.
Response:
In order to shift the sanitary sewer away from the stream so as to avoid stream and riparian impacts south
of manhole 16, the sanitary sewer was designed to cross the stream between manhole 16 and 17. The
stream bank is eroded behind the existing structure at 2516 S. Saunders Street. The rip-rap is being
added to stabilize bank and match the existing contours on both sides of the crossing. The plans do not
modify the existing channel bed elevation.
Other
Comment:
Sheet C2.3 shows a laydown yard on the southwest (top right) corner of the sheet. This laydown yard
appears to be in the buffer zone of the unnamed tributary to the northeast, but it is not listed in the impact
table. Please clarify if this is a buffer impact and revise the PCN if necessary.
Response:
The entire laydown yard is on an existing paved parking lot; there will be no new impacts to Zone 1.
Comment:
Sheet C2.3 shows a rip rap pad listed as 24-inches deep and 40-feet wide with impacts to Zone 1 and 2 of
the buffer. Please clarify if this is a new impact or an existing impact. If it is a new impact, please explain
the purpose of the impact and note that riprap placed in the buffer is considered a permanent impact.

Response:
There is an existing rip-rapped sewer crossing here. The existing one will be removed and the new rip-
rapped sewer crossing will be installed approximately 10 feet further away from the stream and within the
existing maintained sewer easement. This is an existing impact.

This document confirms that City of Raleigh Public Utilities Department (Applicant) for the South
Saunders Street Sewer Replacement (Project) has expressed an interest to utilize 38,790 Square Feet
of Riparian Buffer Mitigation Credits from one of the following banks, EBX-Neuse I, LLC Neuse
Riparian Buffer Umbrella Mitigation Bank or EBX Upper Neuse Riparian Buffer Umbrella Mitigation
Bank. Specific bank sites that may be debited are Arrington Bridge I, Arrington Bridge II, Buffalo
Branch, Selma Mill, Cedar Grove, Hatley, and Ezell, all located in HUC 03020201. As the official Bank
Sponsor, EBX-Neuse I, LLC and EBX, attests to the fact that mitigation is available for reservation at this
time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
