I am including all responses in this email so you both have the same information. USACE Comments: 1. A mitigation acceptance letter from the NCDMS was not included with your application. - A DMS acceptance letter was requested but it seems did not get included in the application. It is attached (Autu m n La kes I LF. pdf). 2. Based on the information provided in your PCN, and information obtained through the town of Zebulon website it is clear that there will be future phases to the Autumn Lakes subdivision, that will result in further loss to waters of the U.S., therefore these impacts from future phases must be considered together before we are able to determine the appropriate Department of the Army permit for the subject property. Please provide more information on all phases of the project. Project plans and updated PCN should depict the entire project parcel, including all impacts to jurisdictional features, roadways, utility lines, lot lines, greenway trails etc. Project plans should be no larger than 11x17. - At the time of application the Phase 3 plans were not developed to the extent that impacts could be depicted. The impacts for Phase 3 are now available and have been included in the updated impact sheets and calculations attached (180709 - Wetland Impact Exhibits.pdf). The only additional impacts anticipated are two greenway crossings that will impact streams and associated riparian buffers as shown at Impact Sites C and D. The attached site plan (180625 - Overall Site Plan.pdf) shows the Phase 3 proposed development and avoidance of all other features. A revised PCN form is attached that incorporates all impacts (PCN_Revised_07112018). 3. Please ensure that all aquatic features are labeled correctly on all plans submitted with your response to this notice per the delineation that was verified in the field on March 10, 2017. An accurate delineation map is attached to this notice for your reference. - The features on the plans were compared with the information you provided and matched locations and extents. The only discrepancy was a "non -jurisdictional" label on the pond in Phase 1. This has been corrected (it was labeled non - jurisdictional as State buffers do not apply but was not intended to refer to Clean Water Act jurisdiction). The updated Overall Site Plan has corrected that and is attached. 4. It appears that another sewer line crossing on the north side of phase 2 (east of impact area A) is anticipated and unaccounted for within the PCN. Please address this crossing in your response to this notice. - This crossing is subsurface and will be achieved through bore/directional drill. Please see attached utility profile (Autumn Lakes Ph 2 Sanitary Profile.pdf). NCDEQ Comments: 1. How wide the permanent maintenance crossing for the sewer will be? - The permanent sewer easements will be 30 feet per City of Raleigh requirements. However, the maintained corridor through buffers/wetlands/streams will be limited to 10 ft. 2. Can the supports for the sewer be moved back 2.5' on each side (increasing the sewer pipe span for 45' to 50') in order to avoid the permanent wetland impacts all together? - The maximum span length allowed by the City of Raleigh for aerial sewer lines is 45 ft. Therefore completely avoiding permanent impact is not feasible. The supports have been designed to minimize impacts as much as possible. REGAN Secretary Expiration of Acceptance: 10/18/2018 County: Wake The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved.
