On April 19, 2018, staff from the Wilmington Regional Office of the Division of Energy,
Mineral and Land Resources (DEMLR), conducted a site inspection for the tract/project known
as Jarrett Bay Boatworks located in Carteret County, North Carolina. The site drains to the Core
Creek (or Adams Creek Canal), which is currently classified as Class SA HQW Waters in the
White Oak River Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
1. The annual summary data monitoring report from 2016 and 2017 stated that the expense
of monthly monitoring does not improve water quality. Exceedances from outfalls in
Tier One require that the operator follow protocol that documents response to the
exceedance. Upon the second consecutive exceedance, the operator shall immediately
institute Tier Two protocols. Exceedances of benchmarks on four occasions during the
permit term requires Tier three actions. Outfalls one and two currently qualify for Tier
Three for Copper and Zinc. Relief from monitoring requirements can only be granted
from this office.
2. A stormwater pollution prevention plan has not been implemented and is a violation of
Permit Condition Part II Section A. There is no recorded documentation of responses for
these exceedances.

Required Response
1. You are directed to respond to this letter in writing within 30 calendar days of receipt of
this Notice. Your response should be sent to this office at the letterhead address and
include a schedule for compliance with the permit.
2. Evaluate all discharge points. During the inspection, an additional discharge point at the
boat lift is necessary.
3. Implement Tier Two protocols for Copper and Zinc at outfalls one and two. Report
sampling results to this office.
4. The recycled wastewater from the power washing station should be evaluated in that the
pond should be lined to prevent groundwater contamination. The gravel surrounding the
pad should be replaced on a schedule as to prevent pollutant concentration. This permit
does not authorize wastewater discharges.
5. Any chemical containers should be kept in a secure location. Remove all chemical waste
containers from the yard.
6. Used oil receptacles should be on spill prevention racks.
7. Provide documentation to this office of the best management practices for bottom paint
removal and painting.
Thank you for your attention to this matter. This office requires that the violations as described
above be properly resolved. Unresolved violations may lead to the issuance of a Notice of
Violation and/or assessments of civil penalties.
Thank you for your assistance and cooperation during this inspection. Please be advised that
violations of the NPDES Stormwater General Permit may be subject to a civil penalty
assessment of up to $25,000.00 per day for each violation. If you have any questions,

Inspection Summary:
Met with Dylan Cox of Jarrett Bay Boatworks, Inc. The annual summary of data submitted revealed that copper has
exceeded benchmark values at outfall one and two in the last four sampling events. Zinc has exceeded the benchmark
value for outfall one the last three samples, outfall two is the last four events. The summary includes a sample event on
11/30/2016 that far exceeded the benchmark values in which there is no written documentation of possible sources.
The site is generally well kept. There were some housekeeping items that needed to be addressed. A better used oil
station should be established as oil residue was on the ground around the containers. Used chemical containers should be
removed from the site. Label all containers used for trash to be labeled as such. Any containers with chemicals in them
should be stored in a secure location.
The power washing station should be evaluated to prevent infiltration to the ground. The area around the washing station
appeared to have a bluish tint. The gravel around this area should be scheduled to be replaced as needed. The wastewater
should be limited to the concrete area. The wastewater pond needs to be lined to prevent infiltration. You may need to
consult with the Division of Water Resouces regarding closed loop wastewater permitting.
