I have had some recent correspondence with Rachel Capito at the Corps and it is possible that they will be permitting this project under something other than 13. Also, I didn't include any open water impacts to my original submittal. We are raising the dam elevation to a consistent 169.5 and for a large portion of the dam, that expansion of the dam footprint will occur on the downstream side of the dam. However, where Terry Sanford Drive and the existing buildings don't allow for this expansion, those sections of the dam will be expanded on the lake side. The lake is currently drained and most of the embankment work takes place above the normal water elevation. Leaving the open water impact off of the original submittal was an oversight. If the 401 approval letter needs to be revised based on the Corps permitting, let me know if you need any additional information from me. At this point, we do not have the 404 approval from the Corps.
