Asheville, NC 28806 Scott Gregory, Thanks for speaking with me recently about your e-mail dated April 25 for the proposed multiple stream stabilization projects with the City of Hendersonville. We discussed the proposed work for each site and possible 404 permitting routes for each project. The information you submitted with your e-mail contained enough detail for each site to determine potential permitting avenues for each project. Based on the information you provided, the work in WoUS at each site can be authorized under a NWP 13 or NWP 17 verification. The right columns of the attached MS Excel spreadsheet provide a summary of the Corps' possible permitting for each site and if you will need to submit a PCN. If there are significant changes to the project designs you submitted for the Corps' review, then the potential permitting route may change. Five sites meet the terms & conditions of NWP 13 and would not require submittal of a PCN to the Crops (i.e., notification). On March 19, 2017, the regional conditions of NWP 13 pertaining to notification requirements changed. These changes affect the requirements for submittal of PCN for work conducted in the western counties of North Carolina. Based upon details provided for the projects which are noted as no PCN submittal required, you are not required to submit PCN notification to our office. You may proceed with your work as proposed at these sites provided it is accomplished in accordance with all the conditions of the attached NWP 13. For the projects which will be authorized under an issued NWP 27 verification, the Corps will require post -construction monitor of the project. When permit verifications are issued for these projects it will contain special conditions for monitoring. The following are drafts for these special conditions: 1) Within 30 -days of completion of the restoration activities, as -built photo log report of the project will be submitted to the Corps, NC Division of Water Resources, and NC Wildlife Resources Commission. Photos of the entire project reach will be collected after project completion. Photo points will be established at a minimum every 75 linear feet in the stream channel. At each photo point, photos will be taken of upstream and downstream views of the channel and perpendicular to the channel from the channel toward the left bank and right bank. 2) Three (3) years of visual monitoring of the restored stream reaches and stream buffers shall be conducted after completion of the restoration activities to ensure the reaches are stable and vegetation of the buffers is successful. During the monitoring period any failures of stream restoration structures and/or stream buffer vegetation will be replaced/repaired by the Permittee upon identification by the Permittee, the authorized agent, or the Corps. 3) Annual monitoring reports are to be submitted to the Corps, NC Division of Water Resources, and NC Wildlife Resources Commission. These reports will be similar to the as -built photo log reported noted above.
