However, the National Flood Hazard map indicated that Crossing 1 would occur within Flood Zone AE. Please explain this discrepancy and add the 100-year floodplain line to the plansheet(s). Note that NWP 39 cannot be used to authorize above grade fills within the mapped FEMA 100-year floodplain (NWP 39 Regional Condition 4.1.4). If proposed activities related to Crossing 1 occur within the mapped FEMA 100-year floodplain, we recommend that you request to use NWP 14 for these impacts; PLEASE NOTE THAT THE TEXT NOTE ON SHEET TWO AS REFERENCED ABOVE HAS BEEN REVISED TO CORRECTLY REPRESENT THE WORK PROPOSED AT THE PROPERTY. SFHA are defined as the area that will be inundated by the flood event having a 1-percent chance of being equaled or exceeded in any given year. The 1-percent annual chance flood is also referred to as the base flood or 100-year flood. SFHAs are labeled as Zone A, Zone AO, Zone AH, Zones A1-A30, Zone AE, Zone A99, Zone AR, Zone AR/AE, Zone AR/AO, Zone AR/A1-A30, Zone AR/A, Zone V, Zone VE, and Zones V1-V30. Moderate flood hazard areas, labeled Zone B or Zone X (shaded) are also shown on the FIRM, and are the areas between the limits of the base flood and the 0.2-percent-annual-chance (or 500-year) flood. The areas of minimal flood hazard, which are the areas outside the SFHA and higher than the elevation of the 0.2-percent-annual-chance flood, are labeled Zone C or Zone X (unshaded). A "Regulatory Floodway" means the channel of a river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than a designated height. Communities must regulate development in these floodways to ensure that there are no increases in upstream flood elevations. For streams and other watercourses where FEMA has provided Base Flood Elevations (BFEs), but no floodway has been designated, the community must review floodplain development on a case-by-case basis to ensure that increases in water surface elevations do not occur, or identify the need to adopt a floodway if adequate information is available. Further, how will the crossings fit NWP Regional Condition 3.6.2? Also, the downstream end of Wetland AA does not appear to extend all the way to the end of the fill slope. This correction should be made on the plansheet and the wetland impacts updated on the PCN; THE NOTE IS ADDED AS REQUESTED, ADDITIONALLY, THE WETLAND AREA AA AS MAPPED AND SURVEYED IS SHOWN AS SUCH ON THE PLAN AND IS TABULATED AS REQUESTED. ALL OF THIS WETLAND AREA IS BEING IMPACTED AND IS REPORTED. Since this remaining wetland is very small, and it’s location between two roads would eliminate any remaining wetland function, this remaining wetland area should be considered a loss of wetlands. This loss should be shown on the plan sheet and accounted for on the PCN. Note that, if this additional loss of wetlands causes the total wetland impact amount to reach 0.1 acre, and if no compensatory mitigation is proposed, you will need to include a justification based on Wetland D’s low aquatic function (see attached NCWAM form for Wetland D); WETLAND AREA AFFECTED EXPANDED AS REQUESTED AND SHOWN ON THE PLAN AND UPDATE TABLE OF IMPACTS, WETLAND D HAS A LOW AQUATIC FUNCTION ACCORDING TO THE NCWAM ATTACHED AND NO COMPENSATORY MITIGATION IS PROPOSED. 5) Impacts to Wetland B appear to be proposed at the downstream end of Crossing 2, although they are not accounted for on the Plans or the PCN.
