Graham / I-40 Drive In – Responses 6-1-2018
Responses in all caps bold
1) Plan Sheet 2/2 states (and the PCN indicates) that no fill or permanent structures are proposed within the 100-year
floodplain. However, the National Flood Hazard map indicated that Crossing 1 would occur within Flood Zone AE.
Please explain this discrepancy and add the 100-year floodplain line to the plansheet(s). Note that NWP 39 cannot be
used to authorize above grade fills within the mapped FEMA 100-year floodplain (NWP 39 Regional Condition 4.1.4). If
proposed activities related to Crossing 1 occur within the mapped FEMA 100-year floodplain, we recommend that you
request to use NWP 14 for these impacts;
PLEASE NOTE THAT THE TEXT NOTE ON SHEET TWO AS REFERENCED ABOVE HAS
BEEN REVISED TO CORRECTLY REPRESENT THE WORK PROPOSED AT THE
PROPERTY. WHILE THE MAJORITY OF THE PROPERTY IS MAPPED WITHIN THE 100
FLOOD PLAIN, AND DEVELOPMENT OF THE MAJORITY OF THE PROPERTY IS
PROPOSED, NO WORK IS PROPOSED WITHIN THE MAPPED 100 YEAR REGULATORY
FLOOD WAY (both as defined below). THE PLAN NOTE HAS BEEN REVISED TO
ACCURATELY DESCRIBE THESE CONDITIONS. ADDITIONALLY, THE FLOOD PLAIN
LINE AND REGULATORY FLOODWAY LINES HAVE BEEN TAKEN FROM THE FIRM
PANEL AND ADDED TO THE PLAN SHEET AS REQUESTED FOR CLARITY. NOTE THE
BLUE AREA BELOW SHOWING THE 100 YEAR FLOODPLAIN AND THE BLUE/WHITE
AREA ILLUSTRATING THE REGULATORY FLOODWAY ALONG BACK CREEK. WE
PROPOSED NO DISTURBANCES WITHIN THE RESERVED REGULATORY FLOODWAY.
PLEASE NOTE THE FOLLOWING:
Flood hazard areas identified on the Flood Insurance Rate Map are identified as a Special Flood Hazard Area
(SFHA). SFHA are defined as the area that will be inundated by the flood event having a 1-percent chance of being
equaled or exceeded in any given year. The 1-percent annual chance flood is also referred to as the base flood or
100-year flood. SFHAs are labeled as Zone A, Zone AO, Zone AH, Zones A1-A30, Zone AE, Zone A99, Zone AR,
Zone AR/AE, Zone AR/AO, Zone AR/A1-A30, Zone AR/A, Zone V, Zone VE, and Zones V1-V30. Moderate flood
hazard areas, labeled Zone B or Zone X (shaded) are also shown on the FIRM, and are the areas between the limits
of the base flood and the 0.2-percent-annual-chance (or 500-year) flood. The areas of minimal flood hazard, which
are the areas outside the SFHA and higher than the elevation of the 0.2-percent-annual-chance flood, are labeled
Zone C or Zone X (unshaded).
A "Regulatory Floodway" means the channel of a river or other watercourse and the adjacent land areas that must
be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more
than a designated height. Communities must regulate development in these floodways to ensure that there are no
increases in upstream flood elevations. For streams and other watercourses where FEMA has provided Base Flood
Elevations (BFEs), but no floodway has been designated, the community must review floodplain development on a
case-by-case basis to ensure that increases in water surface elevations do not occur, or identify the need to adopt a
floodway if adequate information is available.
GIVEN THESE CONDITIONS AND THE PRESENCE OF THE ESTABLISHED
REGULATORY FLOODWAY, DEVELOPMENT IS PROPOSED AS SHOWN WITHOUT
DISRUPTION OF 2017 FEMA ESTABLISH ZONES. NW 14 WILL BE USED FOR THE
PROPOSED ACTIVITIES RELATED TO CROSSING #1
2) The Typical Culvert Crossing Illustration shown on Plansheet 2/2 is too generic to allow compliance inspections of this
project. Please provide zoomed‐in detail and plan view sheets of each road crossing, clearly showing the following:
ENLARGED PLAN AND PROFILE / CROSS SECTIONS FOR THESE ROAD CROSSINGS
HAVE BEEN ADDED TO THE PLAN SET FOR CLARITY AS REQUESTED. THESE
ENLARGED VIEWS SHOW THE STREAM AND WETLAND BOUNDARIES, HATCHING
AS REQUESTED, PERMANENT AND TEMPORARY IMPACTED AREAS, NOTES
INDICATING THAT RIP RAP IS TO BE IMBEDDED TO AT LEAST FLUSH WITH THE
BOTTOM OF THE EXISTING STREAM CHANNEL, TEMPORARY IMPACT AREAS AS
NEEDED FOR CONSTRUCTION ACCESS/DEWATERING, FOOTPRINTS OF EXISTING
CULVERTS, AND FOOTPRINTS OF THE PROPOSED CULVERTS. TEMPORARY
IMPACTS ARE TABULATED AS REQUESTED.
a. stream and wetland boundaries;
b. different hatching for the footprint of wetland and stream impacts, including impacts due to fill (in wetlands),
impacts due to culverts, impacts due to rip rap pads (clearly showing the rip rap will be imbedded), and temporary
impacts outside of the permanent impact areas needed for construction access/dewatering;
c. footprint of the existing culverts;
d. footprint of the proposed culverts;
3) Please confirm that the existing stream beds at Crossings 1 and 2 are wide enough to fit the proposed twin culvert pipes (42”
and 30”, respectively), so as to fit NWP 14 Regional Condition 3.6.4. Further, how will the crossings fit NWP Regional Condition
3.6.2?
CROSSING #1
AVERAGE CHANNEL WIDTH (EXISTING TOP OF BANK) AT ACTUAL PIPE CROSSING
LOCATION:
9.5’w,13.8’w = AVG.11.6’
PROPOSED TWIN 42” OUTSIDE TO OUTSIDE WIDTH: (2@51”+6”) = 9’
CROSSING #2
AVERAGE CHANNEL WIDTH (EXISTING) AT ACTUAL PIPE CROSSING LOCATION:
24’w,7’w = 15.5’
PROPOSED TWIN 30” OUTSIDE TO OUTSIDE WIDTH: (2@37”+6”) =6.7’
3) Wetland AA at Crossing 1 extends beyond the crossing corridor and should be noted as such on the plan sheet. Also,
the downstream end of Wetland AA does not appear to extend all the way to the end of the fill slope. This correction
should be made on the plansheet and the wetland impacts updated on the PCN;
THE NOTE IS ADDED AS REQUESTED, ADDITIONALLY, THE WETLAND AREA AA AS MAPPED
AND SURVEYED IS SHOWN AS SUCH ON THE PLAN AND IS TABULATED AS REQUESTED.
ALL OF THIS WETLAND AREA IS BEING IMPACTED AND IS REPORTED. THE 8” PIPE
SHOWN AS WETLAND FEEDING IS PLACED ACCORDING TO FIELD COMMENTS FROM
THE LAST VISIT AS REQUIRED TO SUPPLY WETLANDS OFF SITE AND DOWNSTREAM
OF THIS AREA WITH RUNOFF EVEN AFTER WETLAND AREA AA IS REMOVED.
4) Impacts to Wetland D include only a portion of the total wetland area, with the remaining wetland proposed to total 615
square feet. Since this remaining wetland is very small, and it’s location between two roads would eliminate any
remaining wetland function, this remaining wetland area should be considered a loss of wetlands. This loss should be
shown on the plan sheet and accounted for on the PCN. Note that, if this additional loss of wetlands causes the total
wetland impact amount to reach 0.1 acre, and if no compensatory mitigation is proposed, you will need to include a
justification based on Wetland D’s low aquatic function (see attached NCWAM form for Wetland D);
WETLAND AREA AFFECTED EXPANDED AS REQUESTED AND SHOWN ON THE PLAN AND
UPDATE TABLE OF IMPACTS, WETLAND D HAS A LOW AQUATIC FUNCTION ACCORDING TO
THE NCWAM ATTACHED AND NO COMPENSATORY MITIGATION IS PROPOSED.
5) Impacts to Wetland B appear to be proposed at the downstream end of Crossing 2, although they are not accounted for
on the Plans or the PCN.
IMPACTS OF A TEMPORARY NATURE HAVE BEEN ILLUSTRATED AND TABULATED AS
REQUESTED ON SHEET ONE OF THE SITE PLAN SET. THESE IMPACTS WILL BE SHOWN ON
THE PCN.
