Applicant cannot make reasonable use of property for the proposed Triangle Tyre facility without impacting the buffer B. Hardship from application of the Rule combined with other constraints C. Hardship is due to configuration of property and location of buffered streams D. Applicant has not violated the Rule E. Purchased some parcels prior to the effective date of the Rule and others after F. Unique for application of the Rule to prevent intended use of a property, a portion of which was purchased prior to implementation of the Rule Findings of Fact —9(a) (ii) & (iii) • The variance is in harmony with the general purpose and intent of the State's riparian buffer protection requirements and preserves its spirit • In granting the variance, the public safety and welfare have been assured, water quality has been protected, and substantial justice has been done. • Propose to purchase 300,713 buffer mitigation credits • Propose a Stormwater Management Plan to treat stormwater runoff from the facility DWR Recommendation • DWR recommends the Water Quality Committee grant this major variance request • If the Water Quality Committee approves this request, the Division recommends approval with the following conditions or stipulations: • Mitigation • The applicant shall provide mitigation for the impacts to the buffer by purchasing 300,713 buffer credits from the Division of Mitigation Services • Stormwater Management Plan (SMP) • The applicant shall secure an approved SMP from Edgecombe County before any impacts authorized in this approval occur Question. ?
