Sediment flagged in the wetlands behind lots 40, 41, and 42 still needs to be removed. 5. Silt fence needs repair behind lot 40. Sediment has entered the wetlands and needs to be removed. 6. Silt fence needs to be repaired behind Lot 42. Sediment has entered the wetlands. 7. Silt fence by lot 8 needs to be cleaned of sediment. Sediment is close to overtopping this silt fence. 8. Silt fence needs maintenance behind lots 24, 29, 31, 32/33, and 45. Stones Landing: 1. Establish groundcover in bare areas as soon as practical. 2. Install inlet protection around all catch basins, yard inlets, and pipe inverts. 3. Sediment flagged in wetlands behind lots 60 and 61 still needs to be removed. 4. Silt fence needs repair behind lots 59, 60, and 61. Sediment needs to be removed from wetlands. 5. Erosion is occurring in rear lot swale 1-1. 6. Sediment still needs to be removed from the stream at the stream crossing. Sediment is more than 300' down the stream. The silt fence on the upstream side of this crossing needs repair as more sediment is entering the stream. 7. Silt fence needs to be repaired around the wetlands across from lot 11. Everett Place: 1. Stormwater mailbox needs to be installed. 2. Silt fence needs repair behind lots 122-123 3. ST#1 has been filled due to sewer installation. Reinstall this sediment trap now that sewer has been installed through this area. 4. Silt fence is underwashing at the tip of the wetlands finger on Lot 97. 5. Water is running between the berm and the silt fence behind the skimmer basin installed on Lot 99. The area needs to be filled to divert water into the skimmer basin. 6. SHFS at the pond has been filled with rip rap. Reinstall the SHFS and level the rip rap in the outlet swale. Sediment is still in the wetlands and needs to be removed by hand. 3. Project: Onslow Bay Date: 6/04/18 (continued): 4. Silt fence by Lot 8 has been repaired. 5. Silt fence behind Lots 30 and 33 still needs to be repaired. Sediment is leaving the site behind Lot 30 and is entering the wetlands behind Lot 33. 6. The silt fence on Lot 10 needs to be extended beyond this lot. Sediment is washing around the silt fence and into the wetlands. Stones Landing: 1. Establish groundcover in bare areas as soon as practical. 2. Silt fence needs repair behind lots 59. Sediment has entered the wetlands and needs to be removed. 3. Sediment still needs to be removed from the stream at the stream crossing. Sediment is approx. 1000' down the stream. Silt fence has been repaired around the stream and the slopes dressed, seeded, and matted. Grass is beginning to grow on the slopes and no more sediment is entering the stream. 4. Install proper sediment control features on lots under construction to prevent sediment from leaving these lots. 5. Sediment traps and skimmer basins in the un -built portion of Stones Landing need to be maintained. Most need new RCDs installed. Everett Place: 1. Stormwater mailbox needs to be installed. 2. Establish groundcover in bare areas as soon as practical, especially in roadside ditches and outlet swales. 3. Install wire with 57 stone at the inverts to all pipes. 4. ST#1 has been filled due to sewer installation. Reinstall this sediment trap now that sewer has been installed through this area. 5. Water is running between the berm and the silt fence behind the skimmer basin installed on Lot 99. The area needs to be filled to divert water into the skimmer basin. The rip rap behind this basin needs to be cleaned as sediment is beginning to leave the site. 6. More seed needs to be spread behind lots 99-102. Response to the items requested is as follows: 1. Restoration of the impacted area is currently underway. After the site inspection on May 22, Mr. Sydes' staff began working on the stream crossing to grade the slopes and establish groundcover with seed and excelsior matting. New silt fence was installed around this crossing to help prevent any further sedimentation into the stream. Stormwater was also diverted away from this area and into the Stormwater Pond, which is currently being built. On May 25 wattles were placed in the wetlands at the limits of the impacted area to prevent the spread of the impacted area. On May 29, sedimentation removal began as the weather. permitted. On June 5, Mr. Sydes' staff moved to the end of the impacted area and began removing sediment while moving upstream. Since June 5, Mr. Sydes' staff has been in the stream removing sediment. It is anticipated that by July 13, Mr. Sydes will be ready to contact NCDEQ and the Army Corps of Engineers to determine if the sediment removal is sufficient. If the sediment removal from the stream is sufficient, Mr. Sydes' staff will begin bringing all of his sediment control measures up to date and repair all sediment control measured as noted. Pending future inclement weather conditions, Mr. Sydes plans to have all sediment removed from the wetlands and .all erosion control measures installed and properly functioning within 20 days of this letter. 2. Rainfall data and Inspection Reports are enclosed. 3. To prevent these types of problems from recurring in the future, Mr. Sydes and the contractor will review the design plans and the construction sequence prior to beginning work, and will contact the engineer if any questions or modifications arise in regards to erosion control. Stormwater Self -Inspections have been conducted on site and Mr. Sydes and the contractor will thoroughly review these reports and implement any repairs that are needed. In addition, Mr. Sydes has directed Parker and Associates, Inc. to call him directly should the contractor be non-compliant or the threat of environmental impacts be anticipated. 4. An 11" x 17" restoration plan for Stones Landing, Section I titled, "Sediment Removal and Wetlands Restoration Plan" is enclosed for your use. The plan shows the current 404 wetlands delineation, and the limits of impacts from sedimentation. The impact limits were flagged by Robb Mairs and Joanne Steenhuis of the Division of Water Resources on May 25, 2018. The sediment impact totals 0.05 acres and is approximately 1.0' deep and contained inside the banks of the stream per the site visit with Mr. Mairs and Ms. Steenhuis on May 25, 2018. The total accumulation of sediment totals approximately 2,178 cubic feet. All restoration will be done by hand labor (buckets, shovels, and wheelbarrows) as noted. We have been in direct contact with Mr. Sydes and his employees since the NOV letter was delivered to him to assure restoration is implemented in this manner as soon as practical. 5. We do not feel Mr. Sydes deserves a penalty due to how quickly he is trying to correct the violations after the site meeting on May 22. As stated above, the stream crossing, which is the most severe violation (no other areas have sedimentation into the wetlands), was graded, dressed, and had seed and excelsior matting installed within two days after the site meeting. At that point, the only water traveling to the crossing was what fell on the slopes. With the crossing stabilized with groundcover sufficient to restrain erosion, Mr. Sydes' staff began removing sediment from the stream in hopes to return it back to its natural state as soon as possible. We also feel Mr. Sydes does not deserve a penalty due to most of the sedimentation and erosion control measures in Stones Landing, Section I having been installed. The traps and basins in the developed portion of Section I have been filled due to sufficient groundcover to restrain erosion. The ones in the undeveloped portion were dug when the site was originally being timbered, with the exception of SB#10, ST#15, and ST#16. All of the traps and basins from Lot 20-29 are functioning properly and many are oversized. Mr. Sydes understands the ones from Lot 1-19 need to be repaired and maintained, but feels the stream crossing was a more demanding issue as there is currently no sediment leaving the site along Lots 1-19. All of these traps and basins will be brought up to date once all of the sediment has been removed from the stream. Mr. Sydes also now understands he can no longer dewater a pond without a sediment removal device. Mr. Sydes was trying to pump it out correctly by using floats to dewater the pond from the surface. He was also pumping it into a pile of rip rap just beyond Skimmer Basin #7, which measures approximately 30' from the stream. This pump is just being stored on site due to lack of access from wet soil conditions, and is no longer being used. Mr. Sydes contractor has also recently been informed to dewater Stormwater Pond #1 from the surface by using floats, and to dewater into a silt bag on a grassed surface. Page Three of Three July 3, 2018 Mr. Sydes is working diligently and has been working diligently since the site meeting on May 22 to correct all of the listed violations in the Notice of Violation dated May 29, 2018; therefore, we strongly recommend a penalty should not be assessed. There are a couple of areas around this crossing where the silt fence is beginning to underwash and needs repair. 4. Sediment traps and skimmer basins in the un -built portion of Stones Landing need to be maintained. Most need new RCDs installed. Everett Place: 1. Stormwater mailbox needs to be installed. 2. Establish groundcover in bare areas as soon as practical, especially in roadside ditches and outlet swales. 3. Install wire with 57 stone at the inverts to all pipes. 4. ST#1 has been filled due to sewer installation. Reinstall this sediment trap now that sewer has been installed through this area. 5. Water is running between the berm and the silt fence behind the skimmer basin installed on Lot 99. The area needs to be filled to divert water into the skimmer basin. The rip rap behind this basin needs to be cleaned as sediment is beginning to leave the site. 6. More seed needs to be spread behind lots 99-102.
