On June 18, 2018, the Division of Water Resources (Division) received your application dated June 6, 2018, requesting a
401 Water Quality Certification from the Division for the subject project. The Division has determined that your
application is incomplete and cannot be processed. The application is on hold until the following item is addressed:
1. Please provide the Division a copy of your response to the July 2, 2018 email from the U.S. Army Corps of Engineers
requesting additional information. [15A NCAC 02H .0502(c)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received, the Division will be unable to
approve the application and it will be returned. The return of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee.

The Corps has received and reviewed your recently submitted PCN application and supporting documents (received June
19) for the Warriner Residence New boathouse project at 264 Indian Trace in Lake Toxaway, Transylvania County, NC.
The site is located on a 1.58 acre tract of land (PIN 8522-06-9484-000) at coordinates 35.13239 N, 82.94443 W. The
submitted information requested this project be verified under Nationwide Permit (NWP) 3 for the work associated with
the repairs to the existing lakeshore wall and NWP 18 for work associated with the new boathouse. Based on our
review, the Corps is requesting the following additional information in order for us to consider the application to be
complete:
1. Demonstrate the amount of new fill below the ordinary high water mark (OHWM) in Lake Toxaway for the boathouse
is less than 25 cubic yards. Based upon the submitted information the estimated amount of fill below the OHWM is
approximately 106 cubic yards.
As proposed, the activities for the new boathouse do not met the terms and conditions of NWP 18, Minor Discharges. As
noted above, submit details to the Corps which note the amount of new fill below the OHWM for the boathouse is less
than 25 cubic yards.
Please note in order for the Corps to verify the use of NWP 18 the applicant must meet these terms and conditions. If
the project cannot meet the terms and conditions of NWP 18, then redesign the project to meet NWP 18; resubmit the
project under another NWP; resubmit as an individual permit request; or withdraw the permit request.
Once the Corps receives the additional information we can continue to process your application. If you have any
