(applicant and recent owner) please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) and North Carolina Division of Water Resources (NCDWR) that the activities associated with the activities described herein may proceed under Nationwide Permit (NWP) 29 and the associated General Certification (GC) 4139. Please find attached a complete application and supplemental information. Please note that the county GIS site does not reflect the recent property purchase by Crosswind Development, Inc. Project Summary and Purpose The overall project is a single-family residential subdivision with residential streets and utilities that will connect to existing adjacent roads and utilities in the area. The 76.71-acre project is located immediately south of the intersection of South Cross Street and Tom Williams Road in Youngsville, Franklin County, NC. The corresponding Franklin County PIN for the property is (1852-65-3291), and the approximate center of the property is Latitude: 36.016748° N; Longitude: 78.471511° W. The purpose of the proposed project is to construct a residential subdivision and associated utilities to meet the demand for housing in this part of Franklin County. Project Detail The overall project is a single-family residential subdivision that consists of 176-detached residential lots. Residential streets will connect to existing adjacent roads in the area. Road construction and lot fill will result in impacts to wetlands. Utilities for the proposed project will connect to existing utility lines adjacent to the proposed project boundaries. A boardwalk and Timberlake Preserve Page 2 of 3 greenway trail are proposed for the development. Heavy equipment typically used for utility installation projects (e.g. back hoes, bull-dozers, etc) will be utilized. No federally threatened or endangered species are listed to occur within 1 mile of the site according to the NC Natural Heritage Program (NHP) Database (June 2018). See attached letter from NHP. No recorded historic properties are located on the project site according to the State Historic Preservation Office (SHPO) HPO Web Online (June 5, 2018). The Youngsville Historic District, J.B. Perry House, and several Surveyed Only (SO) properties are located within 1-mile of the project site (see attached Supplemental Documentation). Project History The site is and has previously been utilized for agricultural purposes or forested since the early twentieth century. The configuration of each type of land use on the site has changed over the years. A riparian buffer determination was made by NCDWR staff on July 15, 2015 and a determination letter (TPRRO# 15-272) was issued on July 20, 2015. A field verification meeting was held with Mr. James Lastinger of the USACE and Sean Clark on September 3, 2015 to verify streams and wetlands on the site. Action ID SAW-2015-01931 was assigned the project but a formal JD was not issued. Avoidance and Minimization Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff. Lot and road layouts were adjusted to avoid additional wetland fill along the back of the northern most lots. Small retaining walls will also be utilized to avoid lot fill within the wetlands. Stream impacts have completely avoided. A bridged greenway crossing will be used to avoid stream impacts. Similarly, an aerial sewer crossing will be used to avoid stream impacts. Pier footings and foundations for the sewer-line aerial crossing will not be installed within the stream footprint. Project Impacts Proposed riparian buffer and wetland impacts will result from wetland fill and permanent and temporary riparian buffer impacts associated with road construction, lot fill and sewer line construction. Proposed permanent wetland impacts total 0.1371 acre as a result of lot and road fill. Proposed impacts are to wetland referred to as WA on the previously submitted JD request. The Project is located within the Neuse River Basin. Permanent buffer impacts proposed for the project resulting from the installation of an aerial crossing of a sewer line include 830 Square Feet (ft2) in Zone 1 and 1,200 ft2 in Zone 2. Permanent buffer impacts resulting from the installation of a boardwalk associated with a greenway trail include 1,205 Square Feet (ft2) in Zone 1 and 804 ft2 in Zone 2. Overall riparian buffer impacts total 2,035 ft2 in Zone 1 and 2,004 ft2 in Zone 2. Timberlake Preserve Page 3 of 3 Mitigation Wetland impacts exceed 0.1 acre and will be mitigated at a 2:1 ratio. Riparian buffer impacts are considered “allowable” within the table of uses. The project is located in HUC 03020201. Riparian Wetland credits in the amount of at least 0.274-acre will be purchased from the Grantham Branch Mitigation Site (see attached Statement of Availability letter).
