Yes, the SMP must be signed and approved by the delegated municipality.

NCDWR may request, and the applicant shall furnish, any additional information that
may be found necessary for the proper consideration of the application. [15A NCAC 02H

For continued review, please indicate which SCM(s) are proposed to treat the runoff.
After the review is finalized, the Water Quality Certification may be issued without the
signed SMP.

You are correct that the Town of Pittsboro is delegated for both the Jordan Lake
Riparian Buffers as well as delegated for stormwater. The Town of Pittsboro has
reviewed the Stormwater Management Plan but has not issued the approval yet. The
project has received the Town Board of Commissioners approval, as well as the DEMLR
Sediment & Erosion Control permit.
Typically, 401 WQC Additional Conditions specify that the stormwater management plan
must be approved by the delegated municipality and meet the requirements of the 401
WQC, and cannot be modified without written authorization from the municipality. But
there's not generally a requirement that the stormwater management approval must be
provided prior to issuance of the 401 WQC.
We can certainly provide a copy of the stormwater management plan approval once it
has been issued, but I just wanted to confirm that this won't delay issuance of the
revised 401 WQC & Buffer Authorization.

The Corps has determined that this project will be verified with a NWP 39; therefore, I
will have to reissue the General Certification. I am now reviewing the project using GC
4139.
I understand that the Town of Pittsboro has delegated authority for the Jordan Lake
riparian buffers. It appears that the Town of Pittsboro also has delegated authority for
stormwater. Could you please provide a copy of the locally approved stormwater
management plan with proof of approval?
