For the months of January through June, 1998, Hydro Tube was found in violation of the following parameter

The Phosphorus limits violations will be resolved by an IUP modification submitted to Hydro Tube under
separate cover. The Division appreciates Hydro Tube's cooperation with this matter. Hydro Tube may cease
the monthly monitoring for phosphorus required in the Division's February 10, 1998, NOV.
Hydro Tube may also cease the twice monthly monitoring for nickel and zinc required in the Division's
February 10, 1998, NOV. The data for January through June indicates the earlier zinc violations have been
resolved. The Division's concerns with the IUP limit for nickel discussed in our February 10th NOV will be
resolved by reducing the flow limit on Pipe 02 in an IUP modification submitted to Hydro Tube under separate
cover. If this flow limit reduction is of concern to the permittee, please feel free to discuss alternatives with
the Town of Pittsboro prior to their issuance of their IUP to you, currently set to occur on September 1, 1998.
The Division appreciates Hydro Tube's cooperation with these matters.

Hydro Tube was in violation of reporting requirements for flow for the period January — February 23, 1998,
however as of February 23, 1998, these violations have ceased and the SIU has performed proper monitoring
and reporting for flow. Thank you for your cooperation with this matter.
Hydro Tube continues to be in violation of reporting requirements in Part I, I., 5, and Part 111, 2, b., of the IUP,
most notably in their failure to report the above listed phosphorus violations by phone message and fax within
24 hours of becoming aware of the sample results and by mailing sample reports, postmarked by the 2nd day
the US post office is open after becoming aware of the sample results. These reporting violations are very
serious. The permittee must carefully read the reporting conditions in the IUP modification submitted under
separate letter, as well as all other IUP conditions. Any failure to properly report sample results, including
violations, or failure to meet any other IUP condition in the future may result in the requirement to submit
written monthly reports by certified mail, determination by the Division that Hydro Tube is in Significant Non-
compliance with Reporting with accompanying public notice, and/or civil penalty.
The Division of Water Quality may pursue enforcement actions for this and any additional violations. If you
